AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING APPENDIX A SECTION 6A.1 TO SET
OUT CONDITIONS FOR RESTAURANTS IN THE
C-1 DISTRICT AS AN ACCESSORY USE;
PROVIDING FOR SEVERABILITY, CONFLICTS
AND CODIFICATION; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission has considered the overall
benefit to the citizens of setting forth conditions for
restaurants as an accessory use in the C-1 Zoning District;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
DF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Appendix A of the Code of Ordinances is
amended by adding the words and figures in underlined type
and by deleting the words and figures in struck-through type
as follows:
A. C-1 OFFICE AND PROFESSIONAL COMMERCIAL

1. No restaurant is to be allowed in an officn
building or complex of less than 25,000 square feet.
2. No restaurant shall occupy more than 5% of
total square footage of the office building
structure.
3. No siqnaqe for the restaurant shall be placed
any freestandinq sign for the office building oF
co~lex.
4. Hours of operation shall be 11~ted from 6:00 A.M.
to 5:30 P.M.
5. Seating shall be limited to 40 seats or less.
Section 2. That all ordinances or parts of
ordinances in conflict herewith be and the same are hereby
repealed.
~ection 3. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
this ordinance.
Section 4. Authority is
ordinance.
Section 5. This ordinance shall become effective
immediately upon adoption by second reading.
