AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING APPENDIX C - SUBDIVISIONS,
PLATTING, ARTICLE XII. ACCEPTANCE AND
MAINTENANCE OF REQUIRED IMPROVEMENTS.~ OF
THE CODE OF ORDINANCES OF THE CITY OF
BOYNTON BEACH; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
~each, upon recommendation of staff, has determined that it
is in the best interests of the citizens and residents of
the City to clarify and amend Appendix C, Article XII,
subsection 1.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. That Appendix C - Subdivisions,
Platting, Article XII. Acceptance and Maintenance of
Required Improvements, subsection 1, shall be amended by
adding the word and figures in underlined type and by
deleting the words and figures in struck-through type as
follows:
ARTICLE XII. ACCEPTANCE AND MAINTENANCE
OF REQUIRED IMPROVEMENTS.
Section 1. Workmanship and material
agreement.

the City Commission by Resolution or
other acceptable surety in an amount to
be determined by the city engineer, kn

surety shall be delivered to the CitV
contemporaneously with delivery of tho
certificate of completion referred to in
Article XI, Section 4 of Appendix C.
The one (1) year guarantee period shall
run from the date the City Comm{ssion

certificate.
Section 2. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 3. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or
~ord be declared by a court of comgetent jurisdiction to be
invalid, such decision shall not affect the remainder of
this ordinance.
Section 4. Authority is hereby granted to codify said
ordinance.
Section 5. This ordinance shall become effective
immediately upon passage.
