O91-69 1 2 3 4 5 6 7 8 9 10 ll 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 ORDINANCE NO. ~91-~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 14-10 OF THE CODE OF ORDINANCES OF THE CITY OF BOYNTON BEACH, FLORIDA, ENTITLED "LIABILITY FOR PAYMENT OF PARKING TICKET VIOLATIONS" BY CREATING A NEW SUBSECTION 14- 10(e) TO PROVIDE THAT THE CITY POLICE DEPARTMENT AS THE CITY'S TRAFFIC VIOLATION BUREAU SHALL SUPPLY THE STATE DEPARTMENT OF HIGHWAY SAFETY AND MOTOR VEHICLES MAGNETICALLY ENCODED COMPUTER TAPE REELS OR CARTRIDGES LISTING ALL PERSONS WITH THREE OR MORE OUTSTANDING PARKING VIOLATIONS OR ANY OUTSTANDING HANDICAP/DISABLED PARKING VIOLATIONS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, this Ordinance is enacted pursuant to Chapter 316, Florida Statutes also known as the State Uniform Traffic Control Act which authorizes cities to regulate the parking of vehicles and to enforce regulations relating to handicap/disabled persons parking; and WHEREAS, Section 316.1967(6) Florida Statutes which authorizes the city to provide by Ordinance that the City Police Department as the City's Traffic Violations Bureau shall supply the Department of Highway Safety and Motor Vehicles magnetically encoded computer tape reels or cartridges listing all persons who have three or more outstanding parking violations or any outstanding handicap/disabled parking violation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. That Section 14-10 of the Code of Ordinances of City of Boynton Beach Florida is hereby amended to CODING: Words in s%~-~h~h type are deletion from existing law; Words in underscore type are additions. Payment of Parking Ticket (e) The City Police Department as the City's Traffic Violations Bureau shall periodically SUPPly the Florida Department of Highway Safety and Motor Vehicles ¢"DeDartment,,) with magnetically encoded computer tapn reels or cartridges which are machine readable by thm installed computer system at the Department, listing persons who have any outstanding violation for parking in a handicap/disabled parking space or three or mor,- unpaid Darkin~ violations; with the intent that nn license plate or revalidation sticker shall be issueJ by the DePartment or the tax collector to such person.. until the registered owner presents a receipt showino that such parking fines have been paid, or the person is removed from the tape after update Section 3. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SectiOn 4.
