AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 2.5, "ALARM SYSTEMS," SECTIONS 2.5-12
AND 2.5-15 OF THE CODE OF ORDINANCES OF THE
CITY OF BOYNTON BEACH, FLORIDA, TO CLARIFY
THE LIMITED 3-MONTH EXEMPTION FOR NEW ALARM
SYSTEMS AND THE 20-MINUTE AUTOMATIC ALARM CUT
OFF REQUIREMENT; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION, AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Chapter 2.5 of the Code of Ordinances of the City
of Boynton Beach, Florida, regulates alarm systems within the
City; and
WHEREAS, subsequent to the latest amendments to this Chapter
the administration noticed and has bought to the attention of the
City Commission certain inconsistencies in the Chapter with
respect to the 3-month exemption for new alarm systems and the
20-minute automatic alarm cut off requirement; and
WHEREAS, the City Commission desires to hereby amend
Sections 2.5-12 and 2.5-15 of the Code to eliminate such
inconsistencies;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby
made a specific part of this Ordinance.
Section 2. Section 2.5-12 of the Code of Ordinances of
the City of Boynton Beach, Florida is amended to provide as
follows:
Sec.2.5-12. Excessive false alarms declared a public
nuisance; exceptions.
(a) The emission of more than three (3) false alarms within
any twelve-month period of time is excessive and

constitutes a serious nuisance, and is hereby declared
to be unlawful and a violation of this section. No
person shall allow, permit, cause, or fail to prevent
the emission, for any reason, by any alarm used by such
person, or any alarm serving a premises or a building
occupied and controlled by such person, of more than
three (3) false alarms within any twelve-month period
of time.
(b)
Ail new fire alarm systems shall be exempt from the
application of this section for the first three (3)
months from the date of initial installation.
Section 3. Section 2.5-15 of the Code of Ordinances of
the City of Boynton Beach, Florida is amended to provide as
follows:
Sec. 2.5-15. Audible alarms.
Ail alarms which may be heard in any public place shall
be equipped and maintained to automatically cut off no
longer than ~h&~M-~9~ twenty (20) minutes after being set
off.
Section 4.
That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 5.
In the event any portion of this Ordinance is
deemed invalid, illegal or unconstitutional by any court of
competent jurisdiction, such decision shall in no manner effect
the remaining portions or sections of this Ordinance and shall
remain in full force and effect.
Section 6. Authority is hereby granted to codify said
ordinance.
Section 7.
This ordinance shall become effective
immediately upon adoption by second reading.
