AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER 10. GARBAGE, TRASH AND
OFFENSIVE CONDITIONS, ARTICLE II,
SECTION 10.29 OF THE CODE OF ORDINANCES
OF THE CITY OF BOYNTON BEACH, TO
ESTABLISH RATES AND CHARGES FOR CITY
SERVICES; PROVIDING THAT EACH AND EVERY
OTHER PROVISION OF CHAPTER 10 NOT
SPECIFICALLY AMENDED HEREIN SHALL REMAIN
IN FULL FORCE AND EFFECT AS PREVIOUSLY
ENACTED; PROVIDING FOR AN IMPLEMENTATION
DATE; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN
EFFECTIVE DATE.
WHEREAS, Palm Beach Solid Waste Authority changed the
)illing structure for commercial properties; and
WHEREAS, the City of Boynton Beach annually establishes
la Sanitation budget and establishes Sanitation rates to
generate funds for the budget; and
WHEREAS, it is necessary to amend the commercial
sanitation rates to reflect these changes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That Chapter 10, Garbage, Trash and
~ffensive Conditions, Article II, Section 10-29, paragraphs
A. and B. are amended by deleting the current language in
its entirety and substituting therefor the following new
language.

A. Commercial Containerized, excluding

Monthly commercial charges shall consist of a
total of the following six items:
(a) Container rental charge - A monthly charge to
cover the actual cost of the container
(amortized over five (5) years) as annually
calculated and certified by the City
Commission. The certified container
charge will be as follows:
2 cu yd container - $3.95 per month
3 cu yd container -
4 cu yd container -
6 cu yd container -
4.85 per month
5.43 per month
7.37 per month
rental
8 cu yd container - $8.25 per month
(b) Disposal charge - a fixed charge per cubic
yard as charged by the Palm Beach County
Solid Waste Authority for disposal of waste
at the landfill as annually calculated and
certified by the City Commission. The amount
certified as the disposal charge is
Thirty-seven ($37.00) Dollars per ton.
(c) Operating charge - A fixed charge per cubic
yard to cover the operating cost less
disposal cost. The operating charge will be
Five Dollars ($5.00) per cubic yard per

Capital equipment charge
pick up to cover total
- A fixed charge per
capital costs for
vehicles as annually calculated and certified
by the City Commission. The certified
capital equipment charge will be Seven
dollars and ninety-five cents ($7.95) per
month per pick up.
Overhead charge - The monthly overhead charge
will be a fixed charge of Fourteen dollars
and forty-three cents ($14.43) per month per
pick up.
Landfill closure charge - A fixed charge of
eighty-seven cents ($.87) per cubic yard per
pick up will be charged to meet the cost of
closing the City's landfill.

(2) Partial monthly service will be charged on a
prorated basis, as appropriate, based on the
guidelines in (1) above.
(3) Removal charges for mechanically compressed refuse
in a dumpster shall be computed at three-to-one
(3:1) (containers furnished by owners).
(4) Two (2) or more places of business establishments
using a single container per pick up as outlined
in (1) above. Any joint use generating two (2)
cubic yards or less per month shall be charged a
minimum of Sixty-four dollars ($64.00) per month
to be shared equally.
B. Non-Containerized Commercial Service:
(1) Refuse picked up from residential type cans
at commercial establishments shall have their
level of service negotiated by the Public
Works Department with an opportunity to
appeal the rate to City Commission.
Section 2. That each and every other provision of
~hapter 10. Garbage, Trash and Offensive Conditions.,
Article II, not specifically amended herein shall remain in
full force and effect as previously enacted.
Section 3. That the new rates and charges for city
services will become effective on October 1, 1991.
Section 4. That all ordinances or parts of ordinances,
or resolutions in gonflict herewith be and the same are
hereby repealed.
