AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA
AMENDING SECTION 5-51 OF THE CODE OF
ORDINANCES OF THE CITY OF BOYNTON BEACH,
FLORIDA ADOPTING THE MOST CURRENT
EDITION OF THE FLORIDA ENERGY EFFICIENCY
CODE FOR BUILDING CONSTRUCTION IN
ACCORDANCE WITH THE REQUIREMENTS OF
SECTION 553.901, FLORIDA STATUTES;
PROVIDING FOR CONFLICTS, SEVERABILITY,
CODIFICATION AND AN EFFECTIVE DATE.
WHEREAS, Section 5-51 of the Code of

WHEREAS, the City of Boynton Beach is required to
~omply with the provisions of Section 553.901, Florida
~tatutes, as amended from time to time; and
WHEREAS, the City Commission of the City of Boynton
~each, Florida desires to comply with the requirements of
~ection 553.901, Florida Statutes, and authorizes the
~doption of the most current edition of the Florida Energy
~fficiency Code For Building Construction;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
)F THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The "WHEREAS" clauses above are hereby
~atified and confirmed as being true and correct and
incorporated herein by this reference.
Section 2. Section 5-51 of the Code of Ordinances
)f the City of Boynton Beach, Florida, is hereby amended by
ldding the words in underlined type and by deleting the
;ords in struck-through type, as follows:
ARTICLE V. ENERGY EFFICIENCY
Sec. 5-51 Code adopted.
The City hereby adopts the most current
edition of the Florida Energy Efficiency
Code For Building Construction, 2989
Ed~%~on, copies of which are now-on-~ke
available in the office of the Building
Official, ~s-he~eby-adopted as part of
the building code of the City, subject
to such amendments, corrections and
additions as shall appear ~n--~h~s
ar~e~e or are adopted pursuant to
Section 553.901, Florida Statutes.
Section 3. That all ordinances or parts of ordinances
conflict herewith be and the same are hereby repealed.
Section 4. Should any section or provision of this
)rdinance or portion hereof, any paragraph, sentence, or
· ord be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
~his ordinance.
Section 5. Authority is hereby granted to codify said
)rdinance.
Section 6. This ordinance shall become effective
Lmmediately upon passage.
