WHEREAS, the City Commission, with the advice and counsel of the City Administration deems it in the best interests of the residents and business owners of the City to amend the City Code to designate license fees for temporary portable retail activities in regional mall concourse areas; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. CHAPTER 13 SECTION 13-22-603 603 Me~eham~empe~a~Re~a~. Temporary Retail. Activities which would otherwise be subject to ~ 602(a) retail license fees, ab~ve--~ha~ but which are temporary and portable and located in ~e~e~a~ mall concourse areas~ ~-a-pe~e~-~e~e~-~ha~-e~e ~-~e~-~--l~s~-~%~a~--~h~ee-~-3~--me~hs~ shall be charged a license fee of $37.50 as pe~e~= for each three-month period or Do,ion thereof. Fees will be paid ~arterly in advance bw the mall operator. Fees shall be paid based upon the maximum projected nu~er of spaces the mall allocates for temDora~ and portable retail locations within the mall for the twelve-month period commencing October the first of each year. Fees maid shall be subject to adjustment to reflect actual operatinq locations. Adjustment shall be made yearly durinq the month of Auqust for the precedinq twelve- month period and on written request from th~ mall operator. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 3. In the event any portion of this Ordinance is deemed invalid, illegal or unconstitutional by any court of competent jurisdiction, such decision shall in no manner effect the remaining portions or sections of this Ordinance and shall remain in full force and effect. Section 4, Authority is hereby granted to codify said ordinance. Section 5. This ordinance shall become effective immediately upon adoption by second reading.
