O91-44O DINANCE NO. ogi- Z+z AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REZONING A CERTAIN PARCEL OF LAND WITHIN THE CITY OF BOYNTON BEACH, FLORIDA FROM C-3 (COMMUNITY COMMERCIAL) TO R-3 (MULTI-FAMILY RESIDENTIAL) LIMITED TO 2-STORY BUILDINGS; PROVIDING FOR APPROPRIATE NOTATIONS ON THE OFFICIAL ZONING MAP; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AUTHORITY TO CODIFY; AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Beach, 89-38 in Florida, has adopted a Comprehensive Plan by ~ccordance with Chapter 163, Florida Statutes; /~'~nd~ WHEREAS, Christopher Cutro, Planning Dir~ctor of this City, las heretofore filed a petition with the City of Boynton Beach, ?lorida, pursuant to Section 9 of Appen~d%x A Zoning, of the lode of Ordinances, City of Boynton Beach, Florida, for the ~urpose of implementing the recommenda-tions in Planning Area ,f the Land Use Problems and OpportUnities Section of the 1989 2ity of Boynton Beach Comprehensiye Plan by rezoning a certain )arcel of land within the municipal limits of said City, said ~roperty being more particularly described hereinafter, from C-3 Community Commercial) to R-3 (Multi-Family Residential), .imited to 2-story buildings; and WHEREAS, after public hearing and study, and after ~onsideration of the recommendation of the City's Planning and Zoning Board, the City Commission deems it to be in the best interest of the inhabitants of said City to rezone the property. NOW, THEREFORE~ BE IT ORDAINED BY THE CITY COMMISSION OF THE ~ITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1.' Containing 1.66 acres, more or less, and subject to easements and rights of way record.
