AN ORDINANCE OF THE CITY COMmiSSION OF
THE CITY OF BOYNTON BEACH, FLORIDA
ESTABLISHING A SERVICE FEE FOR THE
COLLECTION OF DISHONORED CHECKS, DRAFTS
OR OTHER ORDER FOR THE PAYMENT OF MONEY
TO THE CITY; PROVIDING FOR CONFLICTS,
SEVERABILITY, AND EFFECTIVE DATE.
WHEREAS, the City Commission is authorized pursuant to
lorida Statute Section 166.251, to adopt a service fee for
~he collection of a dishonored check, draft or other order
!or the payment of money; and
WHEREAS, the City Commission, based upon recommendation
the City Administration, deems it in the best interest of
;he City to adopt such fee.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. There is hereby established a service
!ee of $15.00 or five (5%) percent of the face amount of any
~heck, draft, or order, whichever is greater, for the
:ollection of a dishonored check, draft, or other order for
:he payment of money to the City of Boynton Beach or any
)artment thereof. The service fee shall be in addition to
ill other penalties imposed by law.
Section 2. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 3. Should any section or provision of this
)rdinance or portion hereof, any paragraph, sentence, or
be declared by a court of competent jurisdiction to be
such decision shall not affect the remainder of
this ordinance.
Section 4. This Ordinance shall become effective
;ely upon passage and shall apply to all checks
n after that date.
