AN ORDINANCE OF THE CITY CO~4MISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA
REZONING A CERTAIN PARCEL OF LAND
WITHIN THE CITY OF BOYNTON BEACH,
FLORIDA FROM R-lA, (SINGLE FAMILY
RESIDENTIAL) TO REC (RECREATION),
PROVIDING FOR APPROPRIATE NOTATIONS ON
THE OFFICIAL ZONING MAP; PROVIDING A
CONFLICTS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING
AUTHORITY TO CODIFY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach,
Florida, has adopted a Comprehensive Plan by Ordinance 89-38 in
accordance with Chapter 163, Florida Statues; and

WHEREAS, Christopher Cutro,
heretofore filed a Petition
Florida, pursuant to Section 9 of Appendix A Zoning, of the
Code of Ordinances, City of Boynton Beach, Florida, for the
of implementing the recommendations in Planning Area 7.b
the Land Use Problems and Opportunities Section of the 1989
Boynton Beach Comprehensive Plan by rezoning a certain

WHEREAS, after public hearing and study, and after
consideration of the recommendations of the City's Planning and
Zoning Board, the City Commission deems it to be in the best
interest of the inhabitants of said City to rezone the property.
NOW THEREFORE, BE IT ORDAINED BY THE CITY CONNISSlON OF THE
CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The following described land, located in the
City of Boynton Beach, Florida, to wit:
West 31.77 feet of Lot 170 and Lot marked
Reserved, lying west of and adjacent
thereto, "Laurel Hills subdivision 4th
Addition," according to the plat thereof, as
recorded in Plat Book 23, Page 142, in
Section 20, Range 43, east Township 45 south,
of the Public Records of Palm Beach County,
Florida.
Containing .43 of an acre, more or less, and
subject to easements and rights of way
record.

be and the same is hereby rezoned from R-iA (Single Family
Residential) to REC (Recreation).
Section 2. The City administration shall make an
appropriate notation on the City's Official Zoning Map
indicating the rezoning, pending the adoption of a revised
Official Zoning Map.
Sec____tion 3______~. That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 4. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or word be
declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the remainder of this ordinance.
Section 5. Authority is hereby granted to codify said
ordinance.
Section 6. This
