O91-33ORDINANCE NO. 091-33 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA REZONING A CERTAIN PARCEL OF LAND WITHIN THE CITY OF BOYNTON BEACH, FLORIDA FROM R-2, (DUPLEX RESIDENTIAL) TO R-lA (SINGLE FAMILY RESIDENTIAL), PROVIDING FOR APPROPRIATE NOTATIONS ON THE OFFICIAL ZONING MAP; PROVIDING A CONFLICTS CLAUSE, PROVIDING A SEVERABILITY CLAUSE; PROVIDING AUTHORITY TO CODIFY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, Florida, has adopted a Comprehensive Plan by Ordinance 89-38 in ~ccordance with Chapter 163, Florida Statues; and WHEREAS, Christopher Cutro, Planning Director of this City, ~as heretofore filed a Petition with the City of Boynton Beach, Florida, pursuant to Section 9 of Appendix A - Zoning, of the 2ode of Ordinances, City of Boynton Beach, Florida, for the purpose of implementing the recommendations in Planning Area 7.a Df the Land Use Problems and Opportunities Section of the 1989 2ity of Boynton Beach Comprehensive Plan by rezoning a certain parcel of land within the municipal limits of said City, said ~roperty being more particularly described hereinafter, from R-2 (Duplex Residential) to R-iA (Single Family Residential); and WHEREAS, after public hearing and study, and after ~onsideration of the recommendations of the City's Planning and 5oning Board, the City Commission deems it to be in the best interest of the inhabitants of said City to rezone the property. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE :ITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The following described land, located in the City of Boynton Beach, Florida, to wit: The northern 330 feet of the east 1/4 of southeast 1/2 of southwest 1/4 of southeast 1/4, north and east of abandoned Old Boynton Road right of way, in Section 20, Range 43, east, and Township 45, south, of the Public Records of Palm Beach County, Florida, also, South 269.64 feet of Lot 12, Sub. of Section 20/29, PB 7, PG 20, less Old Boynton Road right of way, in Section 20, Range 43 east, and Township 45 south, of the Public Records of Palm Beach County, Florida. 08-43'45-20-00-000-5010 & 08~3~45~20-01,000.0121 Containing 2.76 acres, more or less, and subject to easements and rights of way record. ~e and the same is hereby rezoned from R-2 (Duplex Residential) ;o R-lA (Single Family Residential). Section 2. The City administration shall make an Lppropriate notation on the City's Official Zoning Map indicating rezoning, pending the adoption of a revised Official Zoning :he lap. Section 3. That all ordinances or parts of ordinances in :onflict herewith be and the same are hereby repealed. Section 4. Should any section or provision of this ~rdinance or portion hereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this ordinance. 5. Authority is hereby granted to codify said Section Drdinance. Section 6. This immediately upon passage. FIRST READING this 1991.
