ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA REZONING
A CERTAIN PARCEL OF LAND WITHIN THE CITY
OF BOYNTON BEACH, FLORIDA FROM C-2,
(NEIGHBORHOOD COMMERCIAL) TO R-1
(SINGLE FAMILY RESIDENTIAL), PROVIDING
FOR APPROPRIATE NOTATIONS ON THE
OFFICIAL ZONING MAP; PROVIDING A
CONFLICTS CLAUSE, PROVIDING A
SEVERABILITY CLAUSE; PROVIDING FOR
AUTHORITY TO CODIFY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
Beach, Florida, has adopted a Comprehensive Plan by
~rdinance 89-38 in accordance with Chapter 163, Florida
;tatues; and
WHEREAS, Christopher Cutro, Planning Director of this
Zity, has heretofore filed a Petition with the City of
Boynton Beach, Florida, pursuant to Section 9 of Appendix A
Zoning, of the Code of Ordinances, City of Boynton Beach,
lorida, for the purpose of implementing the recommendations

WHEREAS, after
~onsideration of the
public hearing
recommendations
and study, and after
of the City's Planning
~nd Zoning Board, the City Commission deems it to be in the
pest interest of the inhabitants of said City to rezone the
property.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
DF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The following described land, located in
the City of Boynton Beach, Florida, to wit:
The west 324.05 feet of east 364.05 feet
of south 658.62 feet of southeast 1/4 of
southeast 1/4, less the south 270 feet,
thereto, in Section 9, Range 43 east,
and Township 45 south, of the Public
Records of Palm Beach County, Florida,
also,
The westerly 255.46 feet of easterly
341.34 feet of the northerly 217.79 feet
of northeast 1/4 of northwest 1/4, in
Section 16, Range 43 east, and Township
45 south, of the Public Records of Palm
Beach County, Florida.
Lot 10 of Block 20, "Rolling Green Ridge
1st Add.," according to the plat
thereof, as recorded in Plat Book 24,
Page 223 of the Public Records of Palm
Beach County, Florida.
Containing 3.96 acres, more or less, and
subject to easements and rights of way
record.
De and the same is hereby rezoned from C-2 (Neighborhood
lommercial) to R-1 (Single Family Residential).
Section 2. The City administration shall make an
)propriate notation on the City's Official Zoning Map
indicating the rezoning, pending the adoption of a revised
fficial Zoning Map.
Section 3. That all ordinances or parts of ordinances
n conflict herewith be and the same are hereby repealed.
Section 4. Should any section or provision of this
)rdinance or portion hereof, any paragraph, sentence, or
~ord be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
~his ordinance.
Section 5. Authority is hereby granted to codify said
)rdinance.
Section 6. This ordinance shall become effective
immediately upon passage.
