O91-23ORDINANCE NO. 091-~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REZONING A CERTAIN PARCEL OF LAND WITHIN THE CITY OF BOYNTON BEACH, FLORIDA FROM R-3, (MULTI-FAMILY RESIDENTIAL) TO PU, (PUBLIC USAGE) PROVIDING FOR APPROPRIATE NOTATIONS ON THE OFFICIAL ZONING MAP; PROVIDING A CONFLICTS CLAUSE· PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of · has adopted a Comprehensive the City of Boynton Beach, Plan by Ordinance 89-38 in ~ccordance with Chapter 163, Florida Statutes; and WHEREAS, Christopher Cutro, Planning Director of this City, has heretofore filed a Petition with the City of Boynton beach, Florida, pursuant to Section 9 of Appendix A Zoning, of the of Ordinances, City of Boynton Beach, Florida, for the Dose of implementing the recommendations in Planning Area 8.a Df the Land Use Problems and Opportunities Section of the 1989 of Boynton Beach Comprehensive Plan by rezoning a certain parcel of land within the municipal limits of said City, said property being more particularly described hereinafter· from R-3 (Multi-Family Residential) to PU (Public Usage); and WHEREAS, after public hearing and study, and after =onsideration of the recommendation of the City's Planning and Zoning Board, the City Commission deems it to be in the best interest of the inhabitants of said City to rezone the property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The following described land, located in the City of Boynton Beach, Florida, to wit: Lots 1, 2, 3 of Block i-A, "Lake Boynton Estates, Plat 1," according to the Plat thereof, as recorded in Plat Book 13, Page 32 of the Public Records of Palm Beach County, Florida. Containing 0.44 of an acre· more or less. be and the same is hereby rezoned from R-3 (Multi-Family Residential) to PU (Public Usage). Section 2. The City administration shall make an appropriate notation on the City's Official Zoning Map indicating the rezoning, pending the adoption of a revised Official Zoning Map. Section 3. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 4. Should any section or provision of this any paragraph, sentence, or competent jurisdiction to be not affect the remainder of is hereby granted to codify said ordinance or portion hereof, be declared by a court of invalid, such decision shall this ordinance.
