AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
REPEALING SECTION 33 OF THE CITY CHARTER
CONCERNING CODIFICATION OF ORDINANCES
AND CREATING A NEW SECTION 1-9 OF THE
CODE OF ORDINANCES, ENTITLED
"ORDINANCES; CITY LAWS AND
CODIFICATION"; PROVIDING A CONFLICTS
CLAUSE; PROVIDING A SEVERABILIT¥ CLAUSE;
PROVIDING AUTHORITY TO CODIFY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, in the Municipal Home Rules Power Act the
Florida Legislature extended to municipalities the broad
home rule powers granted by the Constitution and removed
any limitation other than those expressly prohibited by law
or those matters identified in Section 166.021(4), Florida
Statutes, which require voter approval; and
WHEREAS, the City Commission desires to repeal Section
33 of the City Charter concerning codification of
Ordinances consistent with the powers granted to it in
Chapter 166, Florida Statutes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA:
Secti6n 1. That the Municipal Home Rules Power Act
extended to municipalities the broad home rule powers
granted by the Constitution and removed any limitation
other than those expressly prohibited by law or those
matters identified in Section 166.021(4), Florida Statutes,
which require voter approval.
Section 2. That Section 33 of the City Charter
entitled "Codification of ordinances; authority,
publication." is hereby repealed in its entirety.
Section 3. That a new Section 1-9 of the Code of
Ordinances of the City of Boynton Beach, Florida, is
created to read, as follows:
1-9. Ordinances;
Codification.
City Laws and
Ordinances of the City Commission
adopted in a manner provided by law
shall constitute the laws of the City
and shall be in full force and effect
until repealed. The City Commission
shall have the power to have the City
ordinance codified, and published in
book form.
Section 4. That all ordinances or parts of ordinances
in co~ ~ewith be and the same are hereby repealed.
