AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING SECTION 5-28 OF THE CITY
CODE ADOPTING THE STANDARD PLUMBING CODE,
1988 EDITION, BY ADDING A NEW SUB-SECTION,
PROVIDING FOR WATER SAVING DEUICE
REQUIREMENTS IN ALL NEW COMMERCIAL AND
RESIDENTIAL DEVELOPMENT, REDEVELOPMENT, AND
RESTORATION; PROVIDING A CONFLICTS CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING
AUTHORITY TO CODIFY; AND AN EFFECTIVE DATE.
WHEREAS, the Standard Plumbing Code, 1988 Edition,
together with the Uniform Minimum Palm Beach Countywide
Amendments, became the code of the City of Boynton Beach
upon the passage of Ordinance No. 89-54 (codified as Section
5-28 of the City Code); and
W~RREAS, Section 166, Florida Statutes, empowers local
government to provide for the health, safety and general
welfare, including the enactment and enforcement of
construction and related technical codes and regulations;
and
WHerEAS, Chapter 74-565, Laws of Florida, in order to
promote uniformity of building codes and standards,
established the Palm Beach County Building Code Advisory
Board, with the power to recommend uniform countywide
amendments to the building codes; and
WHEREAS, the Building Code Advisory Board has
recommended the adoption of this amendment in order to
conserve water use throughout Palm Beach County; and
WHEP~EAS, pursuant to Section 163.3202 Florida Statutes,
the City of Boynton Beach Code of Ordinances and Land
Development Regulations must be consistent with the Boynton
Beach Comprehensive Plan; and
WHEREAS, to comply and implement the Comprehensive
Plan, the City of Boynton Beach Commissioners desire to
require water saving devices in all new development,
redevelopment, and restoration, both commercial and
residential; and
NOW, THEREFORE, BE IT ORDAINED BY T~E CITY COI~4ISSION
OF THE CITY OF BOY1TTON BEACH, FLORIDA, THAT:
Section 1. That Article II. Plumbing. Sec. 5-28.
Code adopted, of the Code of Ordinances of the City of
Boynton Beach is hereby amended by adding the words and
figures in underlined type and by deleting the words and
figures in struck-through type, as follows:
Sec. 5-28. Code adopted.
The Standard Plumbing Code, 1988 Edition, together with
the Model Count!;wide Amendments to the Standard Plumbing
Code, 1988 Edition, copies of which are now on file in the
office of the building official of the city, are hereby
adopted and established as the Uniform Standard Plumbing
code of the city, subject to the following additional
amendments:
1. All faucets, showerheads and their packagin9 shall
be marked by the manufacturer in accordance with the
provisions of ANSI Standard Al12.18.1M (1989).
2. Water closets and urinals and their packaginq shall
be marked in accordance with the provisions of ANSI
AlI2.19.2M (1990).
3. No new or replacement water closet~
or showerhead shall be installed with
urinal~ faucet
a flow rate or
flush volume in excess of the maximum specified i~
Table 901.2.2 and tested in accordance with the ANSI
Standards Al12.18.1M (1989) or Al12.19.6 (1990).
EXCEPTION: In retrofit applications, an exemption
from low consumption water closet requirements may
be permitted when approved by the buildinq
official, if calculations show that the reduced
waste flow may cause the building drainage system
to function improperly. Calculations shall be
prepared by a design professional except for 1 & 2
family dwellings and those systems which are
exempt from FS Chapters 471 & 481, in which case
calculations shall be prepared by a licensed
plumbing contractor.
4. Table 500 shall be modified when appropriate to
reflect flow rates specified in Table 901.2.2.

1. Maximum allowable water usage for plumbing fixtures and
fixture fittings not listed in this table shall conform to tha
applicable ANSI standard listed in Table 500.
2. Meterin9 type is not required when prohibited by thm
handicapped accessibility code.
Section 2. All ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 3. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or word be
declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the remainder of this ordinance.
