AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING SECTION 16-94.5 OF THE CODE OF
ORDINANCES OF THE CITY OF BOYNTON BEACH,
FLORIDA, TO PROHIBIT THE FUELING OR
REFUELING OF WATER CRAFTS AT ANY PUBLIC
BEACH OR PARK; PROVIDING A CONFLICTS
CLAUSE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AUTHORITY TO CODIFY; AND
PROVIDING AN EFFECTIVE DATE.
WHBREAS, the City Commission of the City of Boynton
each Florida, believes it is in the best interests of the
ealth, safety and welfare of the citizens of the City to
rohibit the fueling or refueling of water crafts on public
eaches and parks;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
F THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That Section 16-94.5 of the Code of
rdinances of the City of Boynton Beach is hereby amended to
rovide as follows:
Sec. 16-94.5 Mooring~ oF docking~
fueling or refueling of water crafts
prohibited.
a-- No persons shall moor or fasten a
vessel in the intracoastal Waterway to
the wooden overlook built along the
Intracoastal Waterway at the terminus of
Casa Loma Boulevard, except in case of
emergency.
b__. No persons shall at any park or
beach fuel, or refuel any water craft.
For purposes of this section water craft
shall include but is not limited to
motorized boats and Jet skis.
Furthermore, as used in this section Jet
skis shall mean any personal water craft
designed for riding enjoyment of
person(s), being propelled by a jet pump
with a fully enclosed impeller.
c__t. Anyone found to violated any
provision of this section shall be
punished as provided for in th~s Chapter
or as otherwise provided by law.
Section 3. That all ordinances or parts of
)rdinances in conflict herewith be and the same are hereby
:epealed.
Section 4.
Should any section or provision of this
;rdinance or portion hereof, any paragraph, sentence, or
lord be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
~his ordinance.
Section 5. Authority is hereby granted to codify
~aid ordinance.
Section 6. This
~mmediately upon passage.
