~ayor Moore called the meeting to order at 6:00 P.M. The
Invocation was given by Reverend John Block, followed by the
Pledge of Allegiance to the Flag led by Commissioner Arline
Weiner.
Comments by Commissioner Hester
Commissioner Hester remarked that he was appalled by the
recent effacement of public property in this City following
the resignation of former City Manager Peter Cheney.
Decisions are made by the entire Commission and not by an
individual person on the Commission. Commissioner Hester
encouraged the City to move forward.
AGENDA APPROVAL
Under ADMINISTRATIVE H., Commissioner Weiner wished to move
the Approval of expenditure for advertising for City Manager
to the CITY MANAGER'S REPORT.
Under ANNOUNCEMENTS, Vice Mayor Olenik wished to add
discussion on the City's entrance signage. Under OLD
~USINESS, C. he wished to add discussion on the Internal
Auditor. Under ADMINISTRATIVE, J. the Vice Mayor wished to
~dd discussion on the workings between the City Manager's
office and the City Attorney's office based on memoranda
received recently by the Commission.
Under CITY MANAGER'S REPORT, Mayor Moore wished to have a
r:eport on the postal rate in connection with the City's
Newsletter. He also wished to have a report on the City's
practice of "renting out" Police Officers. Also, under CITY
MANAGER'S REPORT, the Mayor wished to add discussion on
Charter Changes, Tradewinds, the Shooter's cleanup and
C.A.T.V.
ANNOUNCEMENTS
1. Proclamation - Fire Prevention Week -
October 8 - 14, 1989
Mayor Moore will be executing this Proclamation. It will be
forwarded to the appropriate parties.

2. Boynton Beach - Entrance Signage
Vice Mayor Olenik remarked that on the City's entrance
signage we identify members of the community who are
outstanding athletes in various sports. It has come to his
attention that a City employee, Brian Croft, is a National
Champion in arm wrestling. Interim City Manager George Hunt
will see to it that Mr. Croft's name is added to the
entrance signage.
II. CITY MANAGER'S REPORT
Approve expenditure for advertising for City Manager
Commissioner Weiner stated in the two weeks since Mr. Cheney
had resigned she was impressed with the way George Hunt had
"taken the reins" in the City Manager's office. She felt he
was competent and of high moral and ethical character.
Commissioner Weiner moved that the City hire George Hunt, on
a permanent basis, as City Manager. Vice Mayor Olenik
seconded the motion.
Commissioner Hester felt Mr. Hunt had done a marvelous job
but more time should pass before the Commission renders such
a decision.
Vice Mayor Olenik felt Mr. Hunt had picked up on issues that
have remained unresolved. The Vice Mayor remarked that on
August 17, Mr. Hunt's resignation will stand. The Vice
Mayor was concerned that Mr. Hunt might accept a position
with another City, because the City had not given him a
definite answer one way or the other. The Vice Mayor felt
the continuity of knowledge in the workings of the City is a
definite asset that should be considered.
Commissioner Wische stated he did not previously recommend
George Hunt for City Manager. It was agreed at the last
Commission meeting that the Commission would send out
"feelers" for a City Manager. This would take place for 30
days after which the Commission would sort through the
applicants that applied. Another month would be allowed to
pick the new City Manager. Commissioner Wische felt if Mr.
Bunt wished to apply, there was no reason why he shouldn't.
After only two weeks he was not prepared to appoint Mr. Hunt
as permanent City Manager.
Mayor Moore felt Mr. Hunt had performed admirably. The
Mayor hoped Mr. Hunt would withdraw his resignation until
the City has run out the time for the acceptance of applica-
tions. He thought Mr. Hunt agreed to serve for 60 days.
The Mayor wouldn't want to leave Mr. Hunt "hanging" on the

Civil Service technicality. The Mayor encouraged Mr. Hunt
to apply for the job.
The Mayor called for a vote on the motion to appoint George
Hunt as permanent City Manager. The motion failed 2-3.
Mayor Moore, Commissioner Hester and Commissioner Wische
voted against the motion.
Mr. Hunt agreed to withdraw his resignation until the
Commission has had time to receive applications and evaluate
them.
Vice Mayor Olenik moved to proceed with the advertising for
a City Manager as indicated in Mr. Hunt's memorandum dated
August 11, 1989. Commissioner Hester seconded the motion
which carried 5-0.
2. City Hall Leaks
Interim City Manager George Hunt reported a problem with
leaks has been discovered at the front of the renovated City
Mall. New flashing is to be installed near the gutters and
this should solve the problem.
3. Dick Webber Child Abuse Prevention Center
Mr. Hunt reported that approximately 950 sq. ft. has been
found for the Dick Webber Child Abuse Prevention Center. A
series of moves are to be made in the next week that will allow
them to enter into the building complex on October 1, 1989.

4. Rent a Cop Program
Interim City Manager Hunt asked the Commission to set a
budget hearing during the week of August 28th. The
Commission needed to review a proposal in which an increase
in rates for "renting" of Police Officers is discussed as
well as supplementing it with an insurance program which
will allay any fears about City liability.
The Commission agreed to set the budget hearing for August
28, 1989 at 6:00 P.M.
5. Tradewinds
After brief comments by the Mayor relative to Mr. Burman's
recent memorandum, Commissioner Weiner moved that the
Commission authorize consent or approval of the team of
experts that will back up the City's side of the case.
Commissioner Hester seconded the motion, which carried 5-0.
Despite the fact that the Commission has done everything
possible to implement the Judge's Order, Mayor Moore
reported there has been a charge made that staff has been
attempting to impede this settlement or to impede the direct
order of the Commission with regard to approval of the
necessary planning portion of this project in Tallahassee.
The Mayor felt it was the consensus of the Commission that
by adoption of those Ordinances, the Commission agreed it
had done everything within it's power, as a Commission, to
comply with the Court Order and put an end to this
situation. The Commissioners agreed. Reference was made to
a hearing on August 21, 1989 before the Court by the
Tradewinds people to attempt to reestablish or clarify
whether the $1,000 per day fine and $1,000,000 bond is still
in force and effect. This is going to be part of the posi-
tion they are taking. The Mayor reiterated the Commission
had done everything in it's power to comply. It has no
Control over what the Dept. of Community Affairs does in
Tallahassee.
6. C.A.T.V.
Mayor Moore noted he had received a number of complaints
that there is a wide divergence of service in our City. The
Mayor has asked Mr. Hunt to provide the Commission with a
copy of the franchise. The Mayor wasn't sure if the City
had any right to control the rates but the City certainly
had the right to control whether the franchise is renewed or
not. The Mayor felt some of these complaints were valid.
Mr. Hunt noted the report was in the mail and would be
received by the Commission the next day.

7. Status of Shooter's Cleanup
Charlie Frederick, Director of Recreation & Parks noted the
Contractor is to start the work August 28, 1989. It is a
seven day job and thirty days is allowed for completion.
8. Charter Changes
Mayor Moore expressed his feelings relative to the
Ordinances he has proposed with regard to the City Manager's
portion of the Ordinances and the Charter. Discussion took
place. The Mayor asked if there was any objection to the
City Attorney returning with a proposed Ordinance incor-
porating the recommendations in Mr. Hunt's August 11, 1989
memorandum?
Commissioner Weiner objected to the fact that the Commission
is seeking to make a Charter change by a majority vote of
the Commission. She felt any change in the Charter should
take place by referendum. Discussion took place on the
Home Rule provision and Florida Statute 166.21, paragraph 4.
Commissioner Hester stated it is in the Charter now. It has
not been used but it could be used. He did not think any
appointed official should have the right to take a person
elected by the people to Court. Commissioner Hester got the
opinion from the City Attorney that the Commission could do
this by majority vote.
The consensus of the Commission was to have City Attorney Rea
bring an Ordinance to the next meeting for the Commission's
consideration, incorporating the items in Mr. Hunt's recom-
mendation.
For the sake of clarification, Mr. Rea stated the two
Ordinances are essentially going to remain unchanged. The
provision will be removed that the City Manager can't fire
~he employee without the Commission's approval. A clause
will be added stating there is no penalty for going around
~he chain of command. Commissioner Weiner was not in favor
of changing the Charter this way.
City Attorney Rea commented part of the basis for his deci-
sion that these can in fact be legally amended by Ordinance,
is based on the Attorney General's opinion dated December
21, 1977. Additionally, this particular Charter provision
was amended in 1973 and again in 1976, specifically by a
majority vote of the Commission, by Ordinance. Mr. Rea
stated he does not make public policy as to whether or not

it would be preferable to do it one way or the other. But,
from a legal point of view, these can be legally amended or
removed by Ordinance.
9. Postal Rate for Mailing of City Newsletter
Mayor Moore reported the City had received information that
we could possibly get third class postal rates for bulk
mailing of the City Newsletter through the Library for 13¢
per Newsletter.
III. CONSENT AGENDA
A. Minutes of Regular City Commission Meeting
of August 1, 1989
Two corrections should be made to the Minutes of the
August 1, 1989 regular Commission Minutes as enumerated in
Betty Boroni's August 4, 1989 memorandum to Interim City
Manager Hunt.
B. Bids - Recommend Approval - Ail expenditures are
approved in the 1988-89 Adopted Budget.
1. Construction of the Containment Structures and Fuel Tank
at the Water Treatment Plant
The Tabulation Committee recommends awarding the bid to the
lowest bidder, Cherokee Petroleum Equipment, Inc. of
Hollywood, Florida, in the amount of $78,100.00.
2. Replacement of One Air Compressor and One Air Storage
Tank at the Water Treatment Plant
The Tabulation Committee recommends awarding the bid to Air
Compressor Works, Riveria Beach, Florida in the amount of
$6,543.20.
3. Written Printing Quotation 14 Items
The Tabulation Committee recommends awarding the printing
quote to the printers as listed on the Tabulation Sheet in
the amount of $1,946.75.
4. Joint Co-op Bid Bulk Quicklime
The Cooperative Purchasing Council of Palm Beach County
jointly awarded the bid to Allied Products, of Birmingham,
Alabama in the amount of $48.50 per ton plus $34.09 for
freight for a total of $82.59 per ton.

5. Warehouse Shelving and Racks
The Tabulation Committee recommends awarding the bid to the
overall lowest bidder, Abba Equipment of Miami, Florida in
the amount of $2,334.09.
6. Knuckleboom Crane and Flat Bed
The Tabulation Committee recommends awarding the bid to SIA
Fabricating & Truck Equipment, Inc. of Largo, Florida in the
amount of $118,603.00.
Discussion took place relative to situations when this crane
would be needed, how frequently it is needed and what
departments would use the crane. John Guidry, Director of
Utilities indicated it would actually be more economical to
purchase the crane rather than having to contract such work
out. The Commission agreed to defer this item until Mr.
Guidry can return with cost justification and answers to
other questions.
7. Sale of City vehicles by sealed bid
(Deleted at City Commission Meeting of August 1, 1989.)
The Tabulation Committee recommends awarding the bid to the
highest bidders on each vehicle for a total amount of
$11,797.00.

Vice Mayor Olenik noted there was an error on the Clean
Irrevocable Letter of Credit on page 1, paragraph 8,
reference is made to the signature of the County Engineer.
This should be corrected to City Engineer of the City of
Boynton Beach.
Discussion took place relative to the difference between a
Letter of Credit and a Bond. City Attorney Rea commented
that we could extend the length of time on a Letter of
Credit. He explained that years ago bonds were the best
type of surety you could get. However, today, unless you
get bonds from one or two bonding companies, they are for
all practical purposes worth as much as the paper they're
written on. A lot of bonding companies are going bankrupt.
Letters of Credit are easier to collect on if the need ari-
ses. The Mayor agreed a Letter of Credit was the way to go.
Further discussion took place relative to monitoring these
things. Interim City Manager Hunt noted the County has a
software system set up on a computer with three people who
monitor Letters of Credit and Surety Bonds for engineering
improvements within the County. The City could develop a
sophisticated system like that, but it would obviously take
manpower. The Mayor suggested investigating whether we
could rent computer space from the County and asked Mr. Hunt
to look into it.

would be legal to impose stricter requirements than those in
the Code. The Commission agreed to TABLE this site plan
until the information is received.
Additional comments were made by Mr. Richard Grimes at the
very end of the meeting on this item.
E. List of Payments - Month of July

F. Consider approval of emergency purchase of 24" Butterfly
Valve for Utility Department
As per John Guidry, Director of Utilities' memorandum to
Bill Sullivan, dated August 1, 1989, emergency purchase of
this valve is recommended from A&P's Water and Sewer in the
amount of $4,553.
G. Consider approval of demolition of 105 N.E. llth Avenue
The Building Department recommends approval of the bid
received from Thomas B. Cushing Demolition, in the amount of
$2,399.00, which reflects the same bid price from Palm Beach
County.
City Attorney Rea noted the City had complied with legal
requirements in this process. This case had been heard by
the Building Board of Adjustment & Appeals.

Interim City Manager Hunt explained this would authorize the
City Manager's office to sign, under the guidelines
established by the Commission, on the three separate housing
programs. The City Manager's office would continue to
report to the Commission as payments are made.
Johnnetta Broomfield, Director of Community Improvement pro-
duced a sign that would be displayed temporarily at indivi-
dual projects, to make other citizens aware of the programs.
I. Consider approval of sewer lateral repair at Silver
Lakes Subdivision
John Guidry, Utilities Director recommends emergency repair
to a sewer line located in Silver Lakes. The repair com-
pany, Griner's/A-One Pipeline Services, Inc. of Orlando,
Florida will be responsible for all necessary work, labor,
equipment, materials and insurance for a total of $1,140.
J. Approve transmittal of Road Impact Fees to Palm Beach
County
As per Grady Swann, Finance Director's August 10, 1989
memorandum to Interim City Manager Hunt, Mr. Swarm recom-
mends transmittal of these collections to Palm Beach County.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF

MAKING THIS POSITION PART OF THE PAY PLAN.
Interim City Manager Hunt remarked the selection committee
would meet next week to begin scheduling interviews.
Applications were received from 150 people.
N. Consider request to dispose of junk furniture
Per Interim City Manager Hunt's August 15, 1989 memorandum
to the Commission, he has recommended this assortment of
junk furniture be destroyed. The Mayor and Vice Mayor
suggested contacting Faith Farm or the Salvation Army prior
to disposal to see if any items would be considered
reusable.

Relative to a payment to Seppala & Aho in the amount of
$61,273.80, Mayor Moore indicated he had stated previously
he would not authorize payment of any more money to Seppala
& Aho, general contractors on renovated City Hall, until the
project is finished, the C.O. is issued and the Commission
has a report from an independent structural engineer on what
the structural status of the building and the parking garage
is. He voted against any payment on this item. Further
discussion took place regarding structural integrity of the
building, the parking garage and the inspection process.
Interim City Manager Hunt stated a meeting was scheduled to
discuss six items enumerated in his recent memorandum and
hopefully come to a resolution of these items.

IV. Bids
A. Accept low bid for North Fire Station with negotiation
proviso
Interim City Manager Hunt remarked bids on Fire Station ~3
were opened on August 10, 1989. The base bid, which was the
low bid from S.T. Wicole Construction, for $1,403,442.00 is
higher than the anticipated budget. We currently have in
the Capital Improvement Program, $1,281,000.00. Mr. Hunt
stated they believed there are portions of the program where
the City could negotiate with the low bidder to either shelf
ar defer for a future phase. In doing so, authorization is
required to accept the low bid with the proviso that we
negotiate to bring the project back into the budget. This
bid is for the fire station only, not the range. Discussion
took place.
Vice Mayor Olenik moved to accept the low bid of S.T. Wicole
Construction, with the proviso that ultimate contract costs
do not exceed our original budget of $1,281,000.00.
Commissioner Weiner seconded the motion.
Mr. Hunt asked if they were unsuccessful in this nego-
tiation, would the Commission grant authorization to go
ahead and proceed by redesigning the project and getting it
back out for new bids so that it could possibly be awarded
at a meeting in September. The Commission agreed.

The Mayor stated he didn't want to do anything without
getting the Police range. He felt they've been without one
for a long period of time and he felt it was essential.

REZONING: Request for a rezoning

allow for substantial changes to

(5) acre public park, the elimination
of a public street connection to
Citrus Glen to allow for a private
security system, an increase in
approved units from 106 to 113,
and a change in layout and design

Carmen Annunziato, Planning Director, explained the history
of the project. He indicated staff feels strongly that the
park is essential to serve the residents of the Lawrence Rd.
corridor.
The application of Citrus Park proposes several things:
1) To eliminate the park, 2) To eliminate the public roads
which would connect to the public roads at Citrus Glen Phase
I, 3) To reconfigure the site and 4) To add a few units.
The Planning and Zoning Board recommends approval of the
request. Staff recommends denial based on the fact that the
recreational area is needed and the roadway connections are
essential.
Jim Golden, Senior Planner, discussed the Comprehensive Plan
policies that come into play in reviewing this application.
Roger Saberson explained when this project originally came
to the City it was brought in by Alan Miller as Citrus Glen
I & II. He had an option on Mr. Saberson's client's land
that is now known as Citrus Glen. He brought these projects
into the City and sought to satisfy the recreation require-
ments for both projects on Mr. Saberson's client's site. He
Came to the applicant with a Quit Claim Deed towards the end
of 1988, asking them to execute it so they could go ahead
and get the park requirement satisfied for the City, even
before he had exercised his option and closed. At that
point the applicant became alarmed. They refused to sign
the Quit Claim Deed. Mr. Miller did not exercise the
option. The plan came into the City and the applicant is
now "saddled" with a plan that has a 5 acre recreation faci-
lity in the middle of a 28 acre parcel.
The applicant is requesting elimination of the public street
system and would like to substitute for the public park area
a private recreation facility on 1.37 acres, together with
the payment of the recreation impact fees. Also the appli-
cant would like to reconfigure the lakes and add approxima-
tely 7 more units to the project.

Mr. Saberson discussed the issue of public vs. private
streets, security, the PUD regulations and the Subdivision
Ordinance.
Mr. Saberson commented that virtually every buyer who has
spoken to the applicant about the property reviews the plan
and when they see how the park area dominates the site, back
away from purchase, because of the public park. He
explained the facilities that will be available in the
school park and felt there would be plenty of park area on
the school site to serve the Lawrence Ave. corridor.
Mr. Agustin Hernandez, Government Liason for the School
Board, explained events that had taken place in recent
months. He commented they were concerned with minimizing
traffic loads on Lawrence Rd. Comments were made about a
joint use road.
Mr. Hernandez remarked they were prepared to come to the
Planning and Zoning Board with a neutral position because
they had entered into a tri-party agreement with the City,
the Boynton Nursury and the School Board. At the Planning
and Zoning Board hearing it was not revealed to them until
that night that there was a different site plan than what
had been presented to the School Board previously.
At the present time the School Board would like to see a
sidewalk system. The School Board would not approve the
joint use road as designed and ask the applicant to return
to the School Board to renegotiate what is going to be
needed to accommodate the road design.
Mayor Moore asked if children in those nearby developments
would be able to attend the new school. Mr. Hernandez did
not know. Mr. Hernandez felt if the 5 acre park were elimi-
nated it would result in a great injustice to the community.
Mr. Saberson produced a letter from the School Board which
indicated children in developments on Lawrence Road are not
assigned to the new school. Vice Mayor Olenik thought the
Commission should try to make some headway with the School
Board on the bussing issue. The Mayor agreed.
Former Mayor Marchese, 1901 S.W. Roma Way, recommended sup-
port of the park adjacent to the school. He hoped the
Commission would "get after" the School Board so that nearby
children could attend the new school. He asked the
Commission to stand by the decisions made by previous admi-
nistrations.
Since there was no one else in the audience who wished to
speak in favor of or in opposition to the request, THE

Vice Mayor Olenik seconded the motion. Discussion took place.
Interim City Manager Hunt remarked for clarification, when
the School Board came to the City Manager's office and
expressed their surprise at the Planning and Zoning Board
presentation, Mr. Hunt investigated the situation and could
find no irregularities on the part of staff. He felt it was
simply staff disagreement with the Planning and Zoning Board
on a matter of perspective and priorities.
Motions
The Mayor called for a vote on the motion to deny the appli-
cation. The motion failed 2-3. Mayor Moore, Commissioner
~ische and Commissioner Hester voted against the motion.
Commissioner Wische moved to grant the approval as
requested, and as recommended by the Planning and Zoning
Board. Commissioner Hester seconded the motion, which
carried 3-2. Vice Mayor Olenik and Commissioner Weiner
voted against the motion.
Mayor Moore called a brief recess at 8:05 P.M. The meeting

VI. PUBLIC AUDIENCE
Left Turn Lane - Catalina Center
Mr. Alan Ciklin, attorney for the developers of Catalina
Center addressed the Commission. He stated his client had
requested on August 2, 1989 to be included on the Agenda.
For one reason or another they were never placed on the
Agenda. His client considers the matter urgent. The matter
concerned a left turn lane waiver for the Catalina Center.
Mr. Ciklin explained a variance was granted previously to
reduce a collector road. As a condition to the variance
there was a left turn lane attached. The County refused to
reissue the permit to Ocean Properties, the developer,
because they were concerned about the structural stability
of the bridge over which the left turn lane would have to
cross. Based on that, the Commission agreed to waive the
left turn lane construction, but based on staff's recommen-
dation it was suggested that a Public Hearing be held. Mr.
Ciklin had requested a Public Hearing of the City Manager
but for some reason it was never scheduled. A cost feasibi-
lity and structural study was completed in June and was sent
to the City and County.
At this time, Mr. Ciklin stated they would like the
Commission to waive the left turn lane requirement. They
would like their C.O. because they have done everything they
are supposed to do. Based on the fact that they haven't
constructed the left turn lane they have incurred a Code
Enforcement Board lien.
Assistant City Manager Hunt commented that a meeting had
been arranged with Mr. Walker's office to discuss this
situation. Mr. Hunt felt they could return to the next
Commission meeting with a resolution.
The Mayor had researched previous Commission Minutes which
indicated this was acted upon 18 months ago by the
commission, approving a waiver, subject to technical points.
Robert Walshak, Chairman of the Planning and Zoning Board
offered technical comments.
Discussion took place regarding maintenance of the
landscaped medians on Congress Ave. between 22nd Ave. and
the canal. Mr. Ciklin commented this issue had been
rlesolved and he explained.
Motion
Mayor Moore passed the gavel to Vice Mayor Olenik. Mayor
Moore moved to relieve Catalina Center of the requirement
for the left turn lane, to void the Code Enforcement lien

against them and to issue them their final C.O, providing
that all other areas of concern are met. Commissioner
Wische seconded the motion, which carried 4-1. The Vice
Mayor voted against the motion.
Platting Requirements - Village Shoppes of Boynton
Mr. Derek Vander Ploeg, Architect for the Village Shoppes of
Boynton addressed the Commission relative to a problem he is
experiencing with this project and the platting
requirements. The shopping center is to be located at
Congress Ave. and 22nd Ave. and is bi-sected by a private
road, Quantum Drive. He does not feel they are required to
plat. Staff says they are.
City Attorney Rea explained staff had determined these
people had to plat. It remains, under one ownership in the
platting regulations.
Mayor Moore stated staff should be instructed to accept the
premise that the Ordinances provide that unless you break it
up into at least four pieces of property, the platting
Ordinances are not applicable. The concensus of the
Commission was that they did not have to plat.
Appeal from Code Enforcement Lien - N.W. 7th Avenue*
City Attorney Rea stated this matter appeared before the
Commission a few months ago. Staff recommended no relief.
Elizabeth Merceret was present at the meeting to represent
Mr. Alan Olinick who is President of A. Stuart Realty
Company. Ms. Merceret explained there are mangroves on this
parcel and the owner has a great deal of difficulty finding
anyone willing to mow it. The Code Enforcement Board has
fined the owner $100 per day for failing to mow the pro-
perty. The fine has now accumulated up to $16,000. The
owner has been caught in the middle, because the State has
threatened him with arrest and a fine if the mangroves are
hlarmed. Mr. Olinick admitted he was waiting for the City
a~d HRS to settle it between themselves and he ignored the
slituation.
Interim City Manager Hunt commented that through the lien
appeal process none of the City's letters or inquiries to
the owner were answered. Ms. Merceret felt the fine was
unreasonable. Discussion took place.
Scott Blasie, Code Enforcement, indicated the weeds were
anywhere from 8' to 12' high and complaints were being
received daily from Harbor Hall.
Mayor Moore felt a breakdown in communication had taken
place and asked Mr. Hunt to revisit this item. The lien was
not waived.

Mr. Curtis Shenkman stated applicant agreed with staff com-
ments. Mr. Larry Reid, Director of Development, Assisted
Living Division, Marriott Corporation was also present at
the meeting. Mayor Moore welcomed the Marriott Corp. to
Boynton Beach.
Discussion took place relative to the placement of a water
main. Mr. Shenkman stated applicant had agreed to place it
above as requested by City staff.
Further conversation took place regarding project signage.
The Planning and Zoning Board agreed at their meeting not to
vote on that particular sign at this time because the
Building Dept. indicated there was a good chance the Sign
Ordinance will be relaxed between now and the time the sign
permit is needed. Vice Mayor Olenik hoped City staff would
not be making policy decisions for the Commission before the
Commission actually decides. He strongly urged staff
through the City Manager, to not indicate to a developer
that an Ordinance may change. The Commission has the final
say.

Vice Mayor Olenik stated the project came up for review at
the Community Appearance Board. A member of the C.A.B. had
asked if the sign was part of the package. Nobody said no
and they voted on and approved the sign. The Vice Mayor
indicated this sign is non-conforming according to our
present Ordinance. The Building Dept. acknowledged it is
non-conforming now but indicated it would be addressed and
"fixed" by the time the City issues the sign permit.
Perhaps the Ordinance will change, but the Vice Mayor did
not want to see signs becoming a permit issue. He ela-
borated.
Mayor Moore asked if the applicant understood the sign had
been cut out of the process at this point? Mr. Shenkman
stated he understood that. The applicant will have to
return with the sign at a later date and the sign will have
to conform to the Ordinance at that time.
Mr. Shenkman stated the Police Dept. comment about the fence
along the canal had been resolved.

Discussion took place dealing with landscaping of the
medians on Federal Hwy. The applicant stated they are not
planning on doing anything to the medians on Federal Hwy.
They do intend to landscape and assume maintenance on the
traffic islands to be built at the right turn onto Old Dixie
from Federal Hwy. They have already dedicated land to the
County to make that right turn in. The plans also call for
them to put a signal in at that intersection.
Motion
Vice Mayor Olenik moved to approve the site plan and shared
parking arrangement for the Grove Shopping Center.
Commissioner Wische seconded the motion, which carried 5-0.
D. Consider approval of Site Plan Extension - Glass Buildinq
This building is located on the northwest corner of Federal
Hwy., at Martin Luther King Blvd. The parking lot is across
the railroad tracks to the west. Staff recommends the
extension of the site plan to July 19, 1990.
Commissioner Wische moved to approve the extension.
Commissioner Hester seconded the motion, which carried 5-0.
Consider request for site plan approval to construct an
86,117 sq. ft. mini-warehouse complex on 4.35 acres on
the east side of Industrial Ave., north of Boynton Beach
Boulevard.
The Planning and Zoning Board recommended approval, subject
to staff comments.
Jim Golden, Senior Planner stated the TRB recommended the
applicant resubmit this because there were some issues
related to building codes and the separation of buildings
and firewall protection.
Mr. Michael Scavuzzo, Architect, addressed the Commission and
indicated the only issue at hand now is that the applicant
is requesting relief of Table 600 and is scheduled to appear
before the Board of Adjustment and Appeals. They are
willing to accept approval subject to getting the variance.
Discussion took place relative to traffic circulation,
the D.O.T., medians and turn lanes.
Mr. Scavuzzo stated he was aware of the flooding problems on
Industrial Ave. The client is amenable to providing ade-
quate drainage in the right-of-way, especially on the south
side.

Vice Mayor Olenik would like the Commission to meet in
workshop session to discuss with the auditor what the
Commission feels should be done. He felt the auditor should
report to the Commission as a whole, to assure an unbiased

Mayor Moore felt it had been discussed previously that he
would be asked to look into the overruns encountered on the
City Hall renovation. Discussion took place.
Interim City Manager Hunt will arrange for a meeting with
Mr. Rubin to speak with the Commission at the Budget
Workshop meeting on August 28, 1989.
X. NEW BUSINESS

Board
Mayor Moore had provided the Commission with a copy of a
proposal which was self explanatory.
2. Morey's Lounge Litigation
Mayor Moore implored the Commission to take a second look at
the Morey's Lounge litigation. He felt the Commission was

Carmen Annunziato, Planning Director, commented the Planning
Depto didn't think it was appropriate to have this kind of
use in C-3 because of the potential of a large number of
trucks. Beyond that there was no problem.
Discussion took place relative to chemicals that might be
Used and the quality of the effluent. Utility Director,
John Guidry, remarked an objection had been raised because
of pre-treatment. Elaboration took place.
Commissioner Weiner noted a resident who lives nearby to
where Doug's Carpet Cleaning intends to open an office had
expressed concern about the location abutting residential.
Comments were made about this use abutting residential
neighborhoods.
John Guidry remarked in the proposed budget there is a need
to address these kinds of issues, with putting in a faci-
lity, probably at the old sewage treatment plant where there
is a major regional lift station, that can address these
types of issues from a utility base. Therefore, he felt it
became a moot point.

Commissioner Weiner and Commissioner Hester both expressed
the desire to wait until after the hearing in mid-October to
see which way the Court would rule.
City Attorney Rea stated the public purpose issue is set
the second week in October. After that hurdle, the jury
trial on compensation will be in the Spring.

The concensus of the Commission was to leave the situation
as is.
3. New Multi-Purpose Center
Mayor Moore felt this project was premature and would cost
far in excess of what was budgeted. The architects had
determined it would be $800,000 over budget. He felt
another site should be considered. Commissioner Weiner
stated the Commission had voted on this item and only the
prevailing side of the issue can bring it up again.
Comments were made about proceeding without the Park Lane
Apts. and parking.
Commissioner Wische made remarks as he was not present when
this was discussed previously. He felt until we get the
final construction costs the matter should be TABLED because
the overrun may be staggering. He reminded the Commission
that the fiscal responsibility of the City was different 2~
years ago from what it is today. He elaborated and
suggested this be put on the "back burner" for a while.
Vice Mayor Olenik stated perhaps the project should be rede-
signed so that it will fit within our guidelines fiscally
and yet still satisfies the needs of the citizens. He
acknowledged traffic is a problem wherever a large number of
people converge. He did feel the project should be "toned
down."
Commissioner Hester agreed that since it is going over
budget that we should go back and redesign the plan. He
felt the project had been in the works long enough and the
citizens want to see it completed. He felt corners could be
cut. If another site is chosen that would increase costs.
Former Mayor Marchese was allowed to address the Commission.
He remarked the size could be decreased but you have to be
careful because you can build something that is outdated
before it is even completed. He felt the center should stay
at the present site. Relative to the property next to
Rumbottoms, the majority of the input from citizens was
that they desire boat ramps there.

Mr. Walter Michel, 3532 Quentin Ave., Boynton Beach,
addressed the Commission. Mr. Michel is President of the
Boynton Concert Community Assoc. Their organization is con-
cerned with cultural growth in Boynton Beach. He
explained about concert series and productions that would
take place on an increased basis if seating capacity is
increased.
Mr. Thomas Corcoran, 215 S.W. 3rd St., Boynton Beach,
addressed the Commission. Mr. Corcoran is the Chairman for
Community Concerts. They are interested in finding ways to
bring world-reknown artists into the community. He ela-
borated on exposing the City's youth to such cultural acti-
vities.
Mr. James Buffan, 2563 S.W. 10th St., Boynton Beach, is
founder and Director of the Boynton Beach Gold Coast
Community Band. This band of professional musicians has
glrown to 65 members. For years they have had to turn away
citizens that wish to attend the concerts because the Civic
~enter is too small. He felt the City needed a befitting
Civic Center for the citizens.
FDrmer Mayor Cassandra, 2554 S.W. 10th Court, Boynton Beach,
rleferred to specifics from the final page of a Report issued
by WRT which compared sites and short term advantages vs.
long term advantages. He felt the Commission should be con-
cerned with long term issues. The overall recommendation
from the outside consultant was to build the center down-
town. Costs can be addressed.
Interim City Manager Hunt remarked he would proceed and come
back to the Commission with a report on revised costs. The
$i800,000 overrun did not include the cost for a parking
garage or condemnation of the Park Lane Apts. The purchase
of the apartment property would probably be in the area of
$!750,000 to $800,000. As an alternate, the parking garage
would cost about $550,000.
B. Items for discussion requested by Commissioner Arline
Weiner
1. Impact of height limitation on Utilities
Commissioner Weiner wanted the voters to be aware of the
impact that could come from the height limitation. She had
asked Mr. Guidry to address impact on drainage, water and
sewage. She was going to ask Mr. Hunt to provide a traffic
impact report on the three areas under consideration, before
the citizens vote on the issue.

John Guidry, Utilities Director, explained how technical
data was arrived at. He questioned his own numbers and
requested it be reviewed by CH 2 M Hill. He read part of
their statement which indicated Mr. Guidry's assessment of
the utility impacts to be conservative. Mr. Guidry stated
we need to proceed with a comprehensive rate study in order
to establish the true impacts.
Technical elaboration took place on increased water treat-
ment, wells, raw water capacity and sewage pumping.
Mr. Guidry explained what the study was predicated on and
remarked that it was simply a "discussion paper."
Commissioner Hester questioned the logic of requesting a
traffic impact study prior to knowing what will stand on the
property.
C. Odor Abatement recommendation from South Central Regional
Wastewater Treatment and Disposal Board
John Guidry, Director of Utilities, explained that at the
last SCRWTD Bd. meeting the Board approved the expenditure
of $636,000 for the final design of four projects. He was
requesting ratification of Boynton Beach's share of
$318,000.
Vice Mayor Olenik stated the board had previously reviewed
engineering options on how to eliminate the odor. Three
different consulting engineers were interviewed. The board
chose to go with the fine bubble diffused aeration system.
Discussion took place at the Delray Beach Commission meeting
last week by the new Interim City Manager and new Utility
Director on why Boynton Beach's engineer hasn't researched
other ways to get rid of the odor. The board at the last
m~eting gave it's approval to cover the tanks, to provide
the system and to proceed. He wanted to clear the air
because it seemed our engineer was getting a "black eye."
Mr. Guidry stated the engineer is marching on the orders
given by the board.
Vice Mayor Olenik stated they voted at the last sewer board
meeting to authorize the engineer to go into final design
s~age for the covering of the tanks, the F-1 pumping station
expansion and the electrical system modifications. He felt
i{ would be fiscally prudent Of the board if they are going
to authorize such a large expenditure that we have given the
okay on, that once those design programs are back we could
go out to bid. He cautioned the board from authorizing a
$700,000 expense for engineering and then turn around and
say they weren't sure if we're going to do it. That was why
they went through the preliminary design stage.

Further conversation took place and Mr. Guidry stated they
approved the project on a 3-1 vote. However, they caveated
that they wanted it to go back to the two Utility Directors
and the engineer to assess that the design approach is abso-
lutely correct.

recommendation from the SCRWTD Bd. Commissioner Hester
seconded the motion, which carried 5-0.

Commissioner Wische's observation was that certain boards
~equire certain expertise. He felt if someone with that
Expertise applies to that board and there is an opening,
they should be made a regular member instead of an alter-
nate.
~ice Mayor Olenik stated the Commission at one time wanted
tio be able to accommodate alternates and move them up when-
ever possible. This was never put in writing or agreed
upon, however.
I~nterim City Manager Hunt was instructed to bring the
Commission a written policy for consideration at the next

donate. The President's Council says this is supposed to be
donations from private donors.
Interim City Manager Hunt remarked we paid $5,000 for
research dealing with reverse osmosis and golf course turf.
Consider approval of Lien Appeal - F.D. and Katie Miller

Vice Mayor Olenik moved that leniency be granted in this
case. Commissioner Wische seconded the motion, which
carried 4-0. Commissioner Hester abstained from voting on

Vice Mayor Olenik had requested the addition of this topic
to the Agenda and requested it be TABLED until the next
meeting.
Remarks by Richard Grimes - Homing Inn Project
Mr. Richard Grimes addressed the Commission in regard to
this project which was discussed earlier in the meeting. He
stated that the Code requires 25% handicap accessibility.
Their plan provides for 33% accessibility. He elaborated
and stated if all rooms were filled on the first floor, he
could only refer to other agencies that could accommodate
them, but he would try to accommodate the handicapped per-
son. A gentleman accompanying Mr. Grimes remarked that the
Code does not require what the Commission has chosen to
TABLE and discuss at another meeting. Disagreement took
Place between the gentleman and the Vice Mayor on what the
~andicap Code provides for.
