O90-78ORDINANCE NO,E~90- 7~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE NO. 89-38 OF SAID CITY BY AMENDING THE FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY BY ALLOWING ADULT ENTERTAINMENT ESTABLISHMENTS WITHIN THE INDUSTRIAL LAND USE CATEGORY; PROVIDING FOR A CONFLICTS CLAUSE; PROVIDING FOR SEVERABILITY; PROVIDING CODIFICATION; EFFECTIVE DATE. AUTHORITY FOR AND PROVIDING AN WHEREAS, the City Commission of the City of Boynton Beach, Florida has adopted a Comprehensive Plan and as part of said Plan a Future Land Use Element by Ordinance No. 89-38 in accordance with the Local Government Comprehensive Planning and Land Development Regulation Act; and WHEREAS, Ordinance No. by the City Commission of 90-7 which was duly adopted the City of Boynton Beach, Florida on Second Reading on May 15, 1990 allows adult entertainment establishments as permitted uses within the C-3, C-4, M-l, and PID zoning districts, provided that such uses are located not less than 1,000 feet from any house of worship, any school, any residential, recreational, or public use zoning district, or any other adult entertainment establishment; and WHEREAS, the procedure for amendment of the Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed; and WHEREAS, after public hearing and study, the City Commission deems it in the best interest of the inhabitants of said City to amend the aforesaid Future Land Use Element of the Comprehensive Plan as adopted by the City herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1: Ordinance No. 89-38 of the City is hereby amended to add the following words and figures in underlined type to the Industrial Land Use Category of Policy 1.16.1 of the Future Land Use Element of the Comprehensive Plan: Industrial: This land use category shall consist of all M-1 and Planned Industrial Development Zoning Districts, and any other industrial zoning districts which may be established provided that all of the above mentioned zoning districts are shown on the Future Land Use Map within the industrial land use category. The uses allowed in this land use category shall be limited to, but shall not necessary include, the following: Industrial uses, research and development, wholesale and distribution, business and repair services, warehousing and storage; transportation, communication, and utility facilities, retail sale of home improvement goods, tools, machinery, and the like; adult entertainment establishments; trade and industrial schools; major recreation facilities such as racetracks, arenas, amusement parks, exposition halls, and the like; offices and restaurants which are accessory to the above uses; temporary amusements, revival tents, and the like; uses allowed in the Office Commercial, Local Retail Commercial, and Public and Private Governmental/Institutional land use categories, if approved as such in a planned industrial development; provided, however, that all of the abovementioned zoning districts are shown on the Future Land Use Map within the industrial land use category. Section 2. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 3. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this ordinance. Section 4. Authority is hereby granted to codify said ordinance. Section 5. This ordinance shall become effective immediately upon passage. FIRST READING this ~ day of December, 1990.
