AN ORDINANCE OF THE CITY COM}4ISSION OF
'THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING THE TEXT OF THE SUPPORT
DOCUMENTS OF THE FUTURE LAND USE ELEMENT
OF THE COMPREHENSIVE PLAN IN CONNECTION
WITH THE MALL CORNER INC., AND
WINCHESTER BOULEVARD RESTAURANT
PROPOSALS; SAID TEXT AMENDMENT WILL
ALLOW PARCELS OF A CERTAIN SIZE TO BE
REZONED TO C-3 IF THE INTENT OF PLANNED
ZONING DISTRICT SETBACK AND GREENBELT
STANDARDS ARE MET; PROVIDING A CONFLICTS
CLAUSE; pROVIDING FOR SEVERABILITY;
PROVIDING AUTHORITY FOR CODIFICATION;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
~each, Florida has adopted a Comprehensive Plan and as part
of said Plan a Future Land Use Element by Ordinance No.
89-38 in accordance
with the Local Government Comprehensive
and Associates, agent for Bill R.
Planning Act; and
WHEREAS, Ki!day

a portion of the Support
Element entitled Land Use
Planning Area 7, Area 7.f.; and
WHEREAS, the procedure for amendment of the
2omprehensive Plan as set forth in Chapter 163, Florida
~tatutes, has been followed; and
WHEREAS, after public hearing and study, the City
2ommission deems it in the best interest of the inhabitants
Df said City to amend the text of the aforesaid Support
Documents of the Future Land Use Element of the
Comprehensive Plan as adopted by the City herein;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The portion of the Support Documents of
the Future Land Use Element entitled Land Use Problems and
Opportunities, Planning Area 7, Area 7.f. is hereby amended
by adding the words and figures in underlined type, as
follows:
This area contains a number of parcels
in an unincorporated enclave, all of
which should be annexed. These parcels
have unique characteristics, since
there are relatively few owners, the
area is bounded by collector and
arterial roads, and the area is adjacent
to a regional mall and two community
.shopping centers. Consequently~ the
City should encourage intensive
commercial development in this area.

parcels.
In order to minimize land use conflicts
with the residential land. uses which lie
to the west, those parcels which abut
the east side of Knuth Road should be
placed in the Office Commercial land use
category. The City should require that
commercial development of these
properties includes the provision of
adequate buffers to protect the
residential land uses which lie to the
west.
High Density Residential or mixed-use
residential and commercial development
should be considered to be an
alternative land use, if roadway
capacity proves to be a problem.
Residential densities up to 10.8
dwelling units per acre would be
permitted in this case.
The rights-of-way for Congress Avenue,
Knuth Road, Old Boynton Road, abutting
this area should also be annexed, as
well as any platted Palm Beach Farms
roads within the area.
Section 2. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
