AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
REGARDING THE BOYNTON BEACH BLVD. PCD
(SOUTH SIDE OF BOYNTON BEACH BLVD.
APPROX. 950 FEET WEST OF CONGRESS
AVENUE), AMENDING ORDINANCE NO. 80-19 OF
SAID CITY BY REZONING A CERTAIN PARCEL
OF LAND MORE PARTICULARLY DESCRIBED
HEREIN, FROM AR (AGRICULTURAL
RESIDENTIAL) TO PCD (PLANNED COMMERCIAL
DEVELOPMENT); AMENDING THE REVISED~
ZONING MAP ACCORDINGLY; PROVIDING A
CONFLICTS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
W~EREAS, the City Commission of the City-~f Boynton
each, Florida, has heretofore adopted Ordinance No. 80-19,
in which a Revised Zoning Map was adopted for said City; and
W~EREAS, Kieran J. Kilday/Kilday & Associates, Inc.,
~gents for Michael A. Schroeder, Trustee, the property
Dwner, has heretofore filed a Petition with the City of
3oynton Beach, Florida, pursuant to Section 9 of Appendix
A-Zoning, of the Code of Ordinances, City of Boynton Beach,
Florida, for the purpose of rezoning a certain parcel of
land consisting of approximately 14.76 acres located within
the municipal limits of said City, said property being more
)articularly described hereinafter, from AR (Agricultural
esidential) to PCD (Planned Commercial Development), which
requests that the 14.76 acre parcel be removed from the
boundaries of the AR to allow for the processing of the
rezoning application; and
W~ER~AS, Ordinance 89-38, which is the Comprehensive
Plan for the City of Boynton Beach, shows the property in
!the Agricultural Residential land use category, and section
163.3202(1), Florida Statutes, requires that the City's land
development regulations be amended in order to bring these
regulations into compliance with the Comprehensive Plan; and
WHEREAS, the City Commission deems it in the best
interestS of the inhabitants of said City to amend the
~foresaid Revised Zoning Map as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: The following described land, located in
City of Boynton Beach, Florida, to-wit:
Lots C thru E, Less State Road
right-of-way, Block 4; Lots C thru E,
less State Road right-of-way, Block 5,
Lots A thru E, Block 28 and Lots A thru
E, Block 29, as recorded in Palm Beach
Farms Company Plat No. 8 in Plat Book 5,
Page 73 of the Public Records of Palm
Beach County, Florida.
Together with that part of the 30' road
right-of-way as shown on above said
plat, bounded on the north by the south
right-of-way line of Boynton Beach Blvd,
and bounded on the east by Lots C, D.E.
Block 4, and Lots A, B, C., D., E. Block
29 of above said plat and bounded on the
west by Lots C, D, E, Block 5, and Lots
A, B. C.D.E. Block 28 of above said Palm
Beach Farms Company Plat No. 8, and
bounded on the south by the Easterly
extension of the north line of Tract "G"
as recorded in Stonehaven Plat No. 1,
Plat Book 48, pages 1-5, of the Public
Records of Palm Beach County, Florida.
Containing 14.76 acres more or less.
and the same is hereby rezoned from County Agriculatural
ntial to City PCD (Planned Commercial Development).
Section 2: That the aforesaid Revised Zoning Map of
the City shall be amended accordingly.
Section 3: All ordinances or parts of ordinances in
=onflict herewith are hereby repealed.
Section 4: Should any section or provision of this
~nce or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall
not affect the remainder of this Ordinance.
Section 5: This Ordinance shall become effective
immediately upon passage.
