O90-72ORDINANCE NO.~90-~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REGARDING THE BOYNTON BEACH BLVD. PCD (SOUTH SIDE OF BOYNTON BEACH BLVD. APPROX. 950 FEET WEST OF CONGRESS AVENUE) AMENDING ORDINANCE 89-38 OF SAID CITY BY AMENDING THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY BY ADOPTING THE PROPER LAND USE OF CERTAIN PROPERTY, MORE PARTICULARLY DESCRIBED HEREINAFTER; SAID LAND DESIGNATION IS BEING CHANGED FROM COUNTY CH/8 (AGRICULTURAL RESIDENTIAL) TO COMMERCIAL LOCAL RETAIL; PROVIDING A SAVINGS CLAUSE; PROVIDING REPEALING PROVISIONS; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Wq~EREA$, the City Commission of the City of Boynton ~each, Florida has adopted a Comprehensive Land Use Plan and ms part of said Plan a Land Use Element by Ordinance No. 89-38 in accordance with the Local Government Comprehensive Planning Act; and W~EREAS, a certain parcel of land more particularly described hereinafter is being annexed in accordance with the application by Kieran J. Kilday/Kilday & Associates, Inc., agent for Michael A. Schroeder, Trustee the owner of the following property, into the City by Ordinance being adopted simultaneously herewith; and WHEREAS, the procedure for amendment of a Land Use Element of a Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed; and WHEREAS, after public hearing and study, the City Zommission deems it in the best interest of the inhabitants of said City to amend the aforesaid Land Use Element of the 2omprehensive Plan as adopted by the City herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION DF THE CITY OF BOYNTON BEACH, FLORIDA, Section 1: Ordinance No. 89-38 amended to reflect the following: TMAT: of the City is hereby That the Land Use of the following described land shall be designated as Commercial Local Retail. Said land is more )articularly described as follows: Lots C thru E, Less State Road right-of-way, Block 4; Lots C thru E, less State Road right-of-way, Block 5, Lots A thru E, Block 28 and Lots A thru E, Block 29, as recorded in Palm Beach Farms Company Plat No. 8 in Plat Book 5, Page 73 of the Public Records of Palm Beach County, Florida. Together with that part of the 30' road right-of-way as shown on above said plat, bounded on the north by the south right-of-way line of Boynton Beach Blvd, and bounded on the east by Lots C, D.E. Block 4, and Lots A, B, C., D., E. Block 29 of above said plat and bounded on the west by Lots C, D, E, Block 5, and Lots A, B. C.D.E. Block 28 of above said Palm Beach Farms Company Plat No. 8, and bounded on the south by the Easterly extension of the north line of Tract "G" as recorded in Stonehaven Plat No. 1, Plat Book 48, pages 1-5, of the Public Records of Palm Beach County, Florida. Containing 14.76 acres more or less. Section 2: That any maps adopted in accordance with ~he Land Use Element of said Comprehensive Plan shall be amended accordingly. Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Should any section or provision of this Drdinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance.
