AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING THE TEXT OF THE SUPPORT
DOCUMENTS OF THE FUTURE LAND USE IN
CONNECTION WITH THE KNUTH ROAD PCD
PROPOSAL; SAID TEXT AMENDMENT WILL ALLOW
ONE LAND USE DESIGNATION ON THE ENTIRE
PARCEL; PROVIDING FOR A CONFLICTS
CLAUSE; PROVIDING FOR SEVERABILITY;
PROVIDING AUTHORITY FOR CODIFICATION;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
leach, Florida has adopted a Comprehensive Plan and as part
Df said Plan a Future Land Use Element by Ordinance No.
39-35 in accordance with the Local Government Comprehensive
?lanning Act; and
WHEREAS, Kilday and Associates, agent for Bill R.
~inchester have applied to amend a portion of the Support
)ocuments of the Future Land Use Element entitled Land Use
?roblems and Opportunities, Planning Area, Area 7.j.; and
WHERES, the procedure for amendment of the
Comprehensive Plan as set forth in Chapter 163, Florida
Statutes, has been followed; and
WHEREAS, after public hearing and study, the City
Commission deems it in the best interest of the inhabitants
of said City to amend the text of the aforesaid Support
of the
Documents of the
Comprehensive Plan as
NOW, THEREFORE,
Future Land USe ELement
adopted by the City herein;
BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1.
The portion of the Support Documents of
the Future Land Use Element entitled Land Use Problems and
Dpportunities, Planning Area 7, Area 7.j. is hereby amended
Dy deleting the words and figures in the struck-through type
~s follows:
This is a 14 acre parcel which is
currently approved in the unincorporated
County as a golf and tennis facility.
If developed as such, a Recreational
Land Use and Zoning designation would be
appropriate. It is likely however that
teh property will be developed for more
intensive uses. Regardless of how the
property is developed, the applicant
should be required to submit an
application for annexation. The City
should permit Local Retail Commercial on

property should be limited, however, to

residences lie in close proximity to the
south and southeast.
Section 2. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 3. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
this ordinance.
Section 4. Authority is hereby granted to codify said
ordinance.
Section 5. This ordinance shall become effective
immediately upon passage.
