O90-63AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REGARDING THE WINCHESTER BLVD. RESTAURANT (NE CORNER OF THE INTERSECTION OF BOYNTON BEACH BLVD. AND WINCHESTER BLVD.) ANNEXING A CERTAIN UNINCORPORATED TRACT OF LAND THAT IS CONTIGUOUS TO THE CITY LIMITS WITHIN PALM BEACH COUNTY AND THAT WILL, UPON ITS ANNEXATION, CONSTITUTE A REASONABLY COMPACT ADDITION TO THE CITY TERRITORY, PURSUANT TO A PETITION OF THE OWNER OF SAID TRACT OF LAND, REQUESTING ANNEXATION PURSUANT TO ARTICLE I, SECTION 7 (32) OF THE CHARTER OF THE CITY OF BOYNTON BEACH, FLORIDA, AND SECTIONS 171.044, AND 171.062(2), FLORIDA STATUTES; PROVIDING THE PROPER LAND USE DESIGNATION AND PROPER ZONING OF THE PROPERTY SHALL BE REFLECTED IN SEPARATE ORDINANCES TO BE PASSED SIMULTANEOUSLY HEREWITH; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR ADVERTISING; PROVIDING AN EFFECTIVE DATE; PROVIDING AUTHORITY TO CODIFY; PROVIDING THAT THIS ORDINANCE SHALL BE FILED WITH THE CLERK OF THE CIRCUIT COURT OF PALM BEACH COUNTY, FLORIDA, UPON ADOPTION; AND FOR OTHER PURPOSES. WHEREAS, Kieran J. Kilday/Kilday & Associates, Inc., gents for Winchester, Winchester, Zieher & Schroeder, A Florida General Partnership c/o Michael A. Schroeder, collectively referred to as the owners of the following tract of land as hereinafter described, have filed a Petition for Annexation to the City of Boynton Beach, Florida, directed to the City of Boynton Beach, Florida, directed to the City Commission pursuant to Article I, Section 7 (32) of the Charter of the City and Section 171.044, and 171.062(2), Florida Statutes; and WHEREAS, said tract of land lying and being within Palm Beach County is contiguous to the existing City limits of the City of Boynton Beach, Florida and will, upon its annexation, constitute a reasonably comPact addition to the City territory; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO~4ISSION OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: Pursuant to Article I, Section 7(32) of ~he Charter of the City of Boynton Beach, Florida, Sections ~71.044 and 171.062(2), Florida Statutes, the following described unincorporated and contiguous tract of land ~ituated and lying and being in the County of Palm Beach, Florida, to wit: A parcel of land lying in Section 30, Township 45 South, Range 43 East, Palm Beach County, Florida. Said parcel being a portion of Tracts A & B Block 3 of Palm Beach Farms Company Plat No. 8 of Section 30, Township 45 South Range 43 East, Plat Book 5, Page 73, Public Records of Palm Beach County, Florida. Said land being more described as follows: particularly Commencing at the Northeast corner of Section 30, Township 45 South, Range 43 East; Thence with a bearing of South 87° 32' 47" West along the North line of Section 30, a distance of 60.00 feet to a point on the West right-of-way line of Congress Avenue; Thence continue along the aforementioned course extended a distance of 733.74 feet to a point; Thence with a bearing of South 01° 18' 43" East along a line lying 120.00 feet West of and parallel to the East line of Lots A & B, Block 3, of the above described plat of Palm Beach Farms Company Plat No. 8, a distance of 25.00 feet to a point. Said point being the point of beginning.
