Two or three weeks after the letters have been delivered a meeting will be set up (probably at the Wilson Center) to get comments from the people affected by the sidewalk installation. It was noted that at this time there is no funding established for the sidewalk installation. The residents would be questioned as to whether or not they want the sidewalks if money could be made available. One color stake would show where the back of the curb would be, one would show the back of the sidewalk, and one would show the existing right-of-way. H. Storage Tank Problems 1. The 1,000,000 gallon storage tank City Manager Cheney stated that this tank located west of Congress and Woolbright, which has been there about five years, has a major setting and a crack in it. The tank is empty, and emergency test borings have been done by a local engineering firm. The City will have to do some chem- ical drilling and some grouting of the tank itself according to information from the Utilities Director. City Manager Cheney proposed that next Monday at the noon meeting regarding the General Obligation Bond Issue, this be added to the agenda. He hoped to have more information at that time as to a solution to the problem. Past records have been checked and revealed that testing was done, but the pressure of the tank over these years has caused some soil to be pushed up. He felt the cost to repair would be between $7,000 or $8,000. 2. The 3,000,000 gallon storage tank This is being constructed west of Congress Avenue at the end of Miner Road. It appears the developer of land adjacent to the tank has not followed his site plan. The developer has dug his lake deeper than it should be and closer to the edge of his property. As a result land which should have been undisturbed has been disturbed. The land can be put back, but some kind of below surface grouting or wall will be required. Post, Buckley, Schuh and Jernigan, Inc. is doing a report which should be received by the Monday meeting. The cost for this could be between $15,000 and $17,000. Mayor Marchese stated that he felt sure legal action would be taken against the developer in order for the City to be repaid the expenses incurred. The invocation was given by vice Mayor Hester who also led the Pledge of Allegiance to the Flag which followed the invocation. AGENDA APPROVAL Commissioner Weiner wished to add a new item to follow the CITY MANAGER'S REPORT which related to an idea which had originated from the Tree Memorial Committee. City Manager Cheney wished to add an item under LEGAL which would be C. 3. Resolution 88-ZZZ Re: Mangroves- He also wished to add under ADMINISTRATIVE, Item F. Annual .Boynton-Delray Beach Holiday Boat Parade. Commissioner Olenik wished to ask a couple of questions of the City Manager after the CITY MANAGER'S REPORT. City Attorney Rea wished to add an item under LEGAL, D. Other Discussion regarding county Adult Entertainment ordinance- Vice Mayor Hester moved to accept the agenda as corrected. Motion was seconded and carried 5-0. ANNOUNCEMENTS None. CITY MANAGER'S REPORT A. Recycling Report - Boynton BeaCh Pilot Areas: Harbour and Silverlake Golf View City Manager Cheney stated that he had included information in the Agenda packet which was self-explanatory- He had driven through some of the area on the east side and noticed there were many containers placed by the road (perhaps 80 percent). -1- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 Commissioner Olenik asked if the original plan had been to include Silverlake. City Manager Cheney stated that the Solid Waste Authority had been given the option of including Golf View Harbour and/or Silverlake. The two are very dif- ferent areas, and apparently the Solid Waste Authority (SWA) decided to use both areas. City Manager Cheney was not sure if data from both areas would be studied. Caroline Mixon, Recycling Coordinator, SWA, came forward to answer questions. She stated that data was being kept on both areas, but when she submits her reports they are included as one report. She added that Silverlake is pulling the percentage down as far as participation is con- cerned. Silverlake is approximately 40 percent and Golfview Harbor is approximately 70 percent. When averaged this gives a 60 percent participation rate. There was further discussion as to whether it was typical for higher income areas to show a lower participation rate, and Ms. Mixon did not feel this was usually the case. She noted that Silverlake residents had made more calls asking for infor- mation regarding the project. She felt this showed they did not have a good understanding of how the project would work. With more information being provided, the participation rate had increased. Mayor Marchese noted that the percentage of participation had gone from 45 percent to 60 percent in just two weeks. B. Thanksgiving Day Holiday for City Employees City Manager Cheney stated that City Hall will be closed on Thanksgiving Day (November 24, 1988) and Friday, November 25, 1988. He stated that the changes in garbage pickup necessitated by the holiday are always carried in the newspaper, but there is always confusion associated with the changes. This year the City Newsletter is also carrying information about the schedule for garbage collection. C. Golf Permits Issued for Fiscal Year 1988/1989 City Manager Cheney stated that 800 golf permits have been issued to date. This is about the average number which were issued in prior years. D. Special Monthly Workshop Meetings for City Commission City Manager Cheney noted that when he realized there were five Tuesdays in November, the Workshop meeting had been -2- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 placed on the schedule for the fifth Tuesday. Commissioner Weiner had expected it to be held on the fourth Tuesday as previously discussed and had made plans to be out of town on the fifth Tuesday. City Manager Cheney suggested the workshop meeting be held on the fourth Tuesday (November 22, 1988). He felt this might be a good time to discuss goals for the City Commission and the City. There had been some previous discussion regarding setting goals by priority and all had felt this was a good idea. It made sense to him to move ahead with this endeavor before too much time had lapsed. Commissioner Olenik stated that he was concerned about the Joint City Commission/Chamber of Commerce Workshop and suggested this workshop meeting in November might be a good time to hold that workshop meeting. City Manager Cheney said he would check with the Chamber to see if their repre- sentatives were available to attend the workshop on that date. It was felt that the workshop could be used to discuss and possibly set some goals as well as meet with the Chamber. E. Palm Beach County Municipal League Meeting City Manager Cheney thought the next meeting of the Palm Beach County Municipal League would be held on November 23, 1988. There would be more discussion regarding this item under LEGAL, Other. F. Morgan Trucking and Florida East Coast Railroad City Manager Cheney stated that the truck has been moved from this property and placed in an area with a fence enclo- sure. The Building Official will check to be sure this new location is within the City's codes. City Manager Cheney noted that Morgan Trucking has a continuing problem with vehicles being parking on their land, and they always cooperate in getting them moved. Their use is grandfathered in so there is not much the City can do about it at this time. He noted that the City has made an offer to purchase the land, but so far has not received a favorable response. G. N.E. 13th Avenue Sidewalks City Manager Cheney noted that the Commissioners had looked at this area when they took their tour on November 12th. It was agreed that the Engineering Department would go out and stake out the sidewalks with colored stakes so the impact of the sidewalks could be seen. Final Budget Commissioner Olenik asked when the final budget would be ready. City Manager Cheney stated that he hoped to have this ready by the end of November. J. Tree Memorial Committee Suggestion Commissioner Weiner had attended a Tree Memorial Committee meeting where Lowell Powell had come up with a new idea that the Committee was in favor of. Commissioner Weiner read information she had brought from the Committee meeting: "In Austin, Texas there is a new holiday tradition - trading in your Christmas tree. Residents who drop off their trees at any designated collection site receive a free Pine or Live Oak tree. The used Christmas trees are turned into mulch which is used by the city for landscaping projects. Everyone benefits from the new tradition. The city saves money on trash collection as well as the cost of mulch. The newly planted trees will add millions to Austin's property values as they mature, and hundreds of volunteers who help with the project know the satisfaction of civic pride." Commissioner Weiner continued that the Tree Memorial Committee thought that with the designation of a couple of collection sites for the used Christmas trees, this project might work for Boynton Beach. She asked that the City Commission consider undertaking this project. Mayor Marchese felt this was a good idea. He asked the City Manager if it was possible for the trees to be collected on a specific day. City Manager Cheney will look into this matter. The City Manager's Report was accepted as presented. CONSENT AGENDA A. Minutes 1. Regular City Commission Meeting Minutes of November 1, 1988 Bids - Recommend Approval - Ail expenditures are approved in the 1988-89 Adopted Budget 1. Commissioner Olenik noted that at the last meeting he asked a question about trade-ins on a mower, and was told that under State Contract there are no trade-ins allowed. Joe Sciortino, Golf Course Manager, noted that the item from the last meeting was a generic item and no other company made that item. In this case there are two major competitors. The bids were based on the GSA bid. The equipment was dif- ferent in the two cases. 2. Annual Usage of Bagged Pertilizer - Golf Course The Tabulation Committee recommended awarding the bid to Howard Fertilizer, Orlando, Florida in the amounts of 17-1-10 ($2,400.00) and 8-1-8 ($4,725.00). 3. 30 Tons of Bulk Fertilizer for Municipal Golf Course The Tabulation Committee recommended awarding the bid to Glades Chemical Company, Lake Harbor, Florida in the amount of $282.00 X 30 tons = $8,460.00. 4. Replacement valves at the Wastewater Pump Stations and the Water Treatment Plant - Utilities The Tabulation Committee recommended awarding the bid to the lowest responsive bidder, John A. Dacy and Associates, Inc. of Coral Gables, Florida, in the amount of $16,927.00 (includes one of each valve). There was some confusion regarding whether the lowest bidder had been selected in this case. It was decided that this item should remain on the table until the next Regular City Commission Meeting. 5. Commissioner Olenik asked if Quantum Park was contributing funds for the station. City Manager Cheney stated that they are contributing land for access. The County and State had put up money over time for the project. City Manager Cheney felt that if more study had been done, there might not be a Tri-County Commuter Rail Station. He felt that if the need arises more parking might be provided. 6. Consider approval of Master Plan Modification - Boynton Lakes Plat No. 6 Mr. Golden explained that Mr. DeSanti, Lennar Homes, was requesting a modification to eliminate 46 previously platted townhouse units and to replat for 33 zero lot line units. This results in a reduction of 13 units from 70 to 57. The property is 9.38 acres and contiguous to the corporate limits along its entire eastern boundary (approximately 334 feet). If the City Commission agrees with the annexation request, this will go to the P&Z Board for the proper public hearings, etc. Vice Mayor Hester moved to approve transmitting this request for annexation (Jonathan's Grove) to the Planning and Zoning Board. Mr. Golden stated that the applicant is requesting that com- ments contained in the September 7, 1988 memorandum from Lt. Hammack to the Planning Department which include a recommen- dation for construction of a southbound right turn into the site on Old Boynton Road and a westbound right turn lane on Boynton Beach Boulevard into the site. The appli- cant requests that the comments be deleted as he claims he was unaware of the comments at the time of site plan appro- val in September. At the P&Z Board meeting the applicant's request was approved with a 5-2 vote. The applicant stated that the cost of the turn lane improvements was not as much of an issue as redesign of the site due to design of the water management tract which would not meet the requirements of the South Florida Water Management District. Mr. Golden pointed out the turns into the development from Old Boynton Road and Boynton Beach Boulevard indicating the suggested turn lanes. City Manager Cheney stated that staff recommendations included the recommendation that both turn lanes be put in, but the developer is requesting that he not be required to provide either turn lane. There was further discussion about the comments from Lt. Hammack and whether or not they were in the packet of information provided for the developer. Commissioner Olenik asked about access, and City Manager Cheney stated that the access was shown into the property but no turn lanes. Vice Mayor Hester was concerned about the memorandum which was missing from the developer's packet of information. He felt this could have happened, but it seemed unusual that it was missing from his packet only. There was discussion regarding the TRB meetings and whether the comments from the Police Department were discussed at those meetings. The developer was present at the first TRB meeting but had not attended the second TRB meeting where the comments were discussed. -13- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 Attorney Wilson Atkinson, Atkinson and Jenny, Hollywood, Florida, was present to speak for the developer. He pointed out that he has been working with the developer on another project for the past six months. He finds the develper to be a person who is truthful. Post, Buckley, Schuh & Jernigan, Inc. had done a traffic study prior to the TRB meetings to ensure that the developer would meet all City codes and safety issues. Attorney Atkinson stated that the Florida Statutes say that when established criteria is pres- ent as far as safety issues are concerned, the City must stay with that established criteria. He felt this was the case in this issue. Andy Carlino, Vice President, Post, Buckley, Schuh & Jernigan, Inc., was present to explain the traffic study his firm had conducted. He noted there are three tests which determine if a turn lane is needed: 1) Traffic generated by the project, 2) traffic on the arterial network, and 3) geometry or sight distance issues which may impact the traf- fic circulation. He pointed out that during the morning peak hour the right turn on Old Boynton Road into the site would generate only 5 vehicles. In the evening this would be 24. On Boynton Beach Boulevard in the morning it would be 4 and in the evening peak hour it would be 19. Overall the traffic on Old Boynton Road, right and left turn lanes into the project at peak hour operate at a level of service "A" or the lowest level of service possible on any roadway. Palm Beach County's Traffic Performance Standard states that the level should not be below level "C." Left turns out on Old Boynton Road are level of service "C." In the evening left turns out on this road are level of service "B." Mr. Carlino stated that Boynton Beach Boulevard is different due to the six lane section and an intersection with a six lane section without a traffic light. Staff has suggested, and the developer is willing, to bond the traffic light if it is warranted in the future. They performed a critical gap analysis on Boynton Beach Boulevard. This analysis showed that at no time except potentially at that left turn movement across three lanes of traffic coming out of the site will it function below the level of service "C." It functions at level "B" at that particular area. There are no unusual geometry or sight distance concerns on either road. The traffic light has been bonded and will be installed when needed. There is a traffic control measure at Old Boynton Road and Boynton Beach Boulevard now which mitigates speed on Old Boynton Beach Road as well and the impact of the turn on Old Boynton Road. In addition, Mr. Carlino had checked with Palm Beach County to see at what -14- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 point they would require a turn lane on these two roads. Palm Beach County would require a turn lane when the traffic count reached 150 trips usually on a six lane section. Mr. Carlino also pointed out that there are no other right turn lanes on Boynton Beach Boulevard for other projects which generate even greater traffic than this project. Commissioner Olenik referred to the problem of obstruction of visibility. He asked what the configuration of Old Boynton Road was when the study was done. Mr. Carlino stated that they used the realigned road. Commissioner Olenik asked Lt. Hammack if there was a visibility problem due to the curve in the road on Old Boynton Road. Chief Hillery came forwarded and asked when the study was conducted and the bridge was closed for a long time. He felt that the main reason for the problem was cars coming east on Boynton Beach Boulevard around a turn and suddenly coming upon cars trying to make a turn. He did not feel it was the number of vehicles, but the blind corner they would be approaching. Mr. Carlino stated that this meets all requirements as to sight distance and geometry according to all engineering criteria. He referred to some of the driveways in the area which are probably more of a problem than turns into this property. Commissioner Mann stated that the TRB had required that the turn lanes be put in. Mr. Carlino stated that the TRB did not require them, but Lt. Hammack felt this would be a good idea. In the first TRB meeting, Post, Buckley objected and suggested that Lt. Hammack review the traffic report which he had not had an opportunity to review. Commissioner Mann read information which stated that the TRB recommended that the turn lanes not be deleted. Mr. Carlino stated that they did not attend the second TRB meeting so they did not address that issue. Vice Mayor Hester asked if the turn lanes had ever been shown on the drawings, and Mr. Carlino stated that they had not. Vice Mayor Hester then asked if the TRB approved the plans with the turn lanes included. Mr. Annunziato stated that there was discussion at the TRB meeting. There was concurrence among several TRB members that the lanes were necessary. Mr. Annunziato continued that at the TRB meetings not every single issue is voted upon. At the second TRB meeting when this was finally approved, the turn lane requirements were included in the recommendation. -15- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 Commissioner Weiner stated that it was her understanding that on safety issues, the City Commission can impose addi- tional requirements. She wondered what would happen when traffic increases in the future. Mr. Carlino stated that when traffic increases, the City would probably enforce the bond for the traffic light. A light is the best control at an intersection. Commissioner Weiner did not feel that just because the City wanted a light that it would be done by the County. She was concerned that even though the light was needed, it might not be approved by the County. Commissioner Olenik was more concerned about the turn off Old Boynton Road due to the sight problem. He feared traf- fic would become heavier as time goes by. He also was con- cerned that the light might not be provided on Boynton Beach Boulevard even when the City felt it was needed. Mr. Carlino stated that on Old Boynton Road, a turn lane would be eliminated when the road is eventually four-laned. It was felt that the road would not be four-laned for some time. Mayor Marchese stated that the City Commission has a duty to evaluate the safety of the City. He went up to the new road, and found that there is an absolutely blind area com- pounded by some driveways. He felt the Police Department had done a good job. Mayor Marchese was not as concerned about the turn on Boynton Beach Boulevard, as the traffic light will ultimately take care of that problem. Mayor Marchese requested that the turn lane on Old Boynton Road be installed, but the one on Boynton Beach Boulevard would not have to be required as he saw it. Attorney Atkinson talked with his client and they were con- cerned about having to delay the project in order to come back to the Commission for further approvals if changes were required. The property is under contract and they are anxious to close on it. Attorney Atkinson wondered if the staff could be directed to take care of the redesign (if needed) administratively so they would not have to come back Before the Commission for approval of any changes. Mr. Carlino stated that on Old Boynton Road no major changes would be required for the turn lane, unless it was required to be there after the road is made into a four-lane road. This would cause a problem as there is not enough frontage on Old Boynton Road to construct the turn lane and the four lanes. The County would probably give permission for that storage lane and taper to be placed within the County's right-of-way which would go beyond the driveways for the homes. -16- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 City Manager Cheney felt that this could be approved subject to the addition of the right turn lane. There .was further discussion regarding how to give this project approval so that they can begin work and not have to come back to the Commission. City Attorney Rea felt that if something major develops which is unforeseen, it can be handled administratively. Commissioner Olenik moved to amend the site plan to delete the staff comments pertaining to a right turn movement on Boynton Beach Boulevard. Motion was seconded by Vice Mayor Hester and carried 5-0. This would create additional hazardous turn movements and make the traffic conditions worse in the vicinity. Mr. Golden combined the remaining three requests as they were all related. He gave a description of the basic site plan. The applicant is proposing to build a 2,357 square foot restaurant with 50 seats and with a drive through window. He proposed a 25' wide greenbelt along Boynton Beach Boulevard which is con- -18- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 sistent with the proposed Urban Design Plan for the Boulevard. Access would be limited to a driveway on N.E. 1st Street across from the Main Street Car Wash. Parking is to the sides and rear of the building. At the northwest corner of the site, there is an opening in the wall to allow access to the remaining part of the alley. The design and architecture is as follows: a one story buiding with a maximum height of 24'. The material is beveled cedar and wood shingles and the color is gray with white trim. Elevation drawings were then shown. The abandonment request is for a 14' wide unimproved service alley which runs east to west on the north side of the main property. The alley is used for service vehicles including the City garbage service and is occupied by utilities. The applicant proposes to use the alley for a portion of the parking lot driveway and required buffer wall adjacent to the two homes to the north. If abandonded the City Engineer recommended that the easements be dedicated and/or the utilities be relocated. The Public Works Director (Acting) has objected to the abandonment, but has indicated that dedication of an appropriate easement through the site to serve his purposes will be acceptable. The P&Z Board voted 5-2 in favor of the abandonment. It appears that incor- poration of the additional property would enhance the com- mercial developability of the main site. The P&Z Board voted unanimously to accept the TRB recommen- dation and the Planning Department's recommentation that the drive-thru facility be denied based on staff comments in the conditional use report. These comments focused on traffic hazards, traffic congestion, impact to surrounding proper- ties and inconsistency to the Urban Design for Boynton Beach Boulevard. The P&Z Board voted unanimously to approve the land use ele- ment and rezoning request. The basis appears to be that the incorporation of the property where the alley now lies would increase the developability of the main site for some com- mercial use in the future. Commissioner Weiner remembered that when this issue first came forward, the developer suggested a different traffic pattern for entering the property. She pointed this out on the drawings, noting that cars would block the street if four or more had to stack and wait in line. She had seen a different traffic circulation proposal at the Community Appearance Board meeting the previous evening. Commissioner Olenik felt that Commissioner Weiner had gotten the wrong impression of the traffic pattern. -19- MINUTES - REGULAR CITY COMMISSION MEETING BOYI~TON BEACH, FLORIDA NOVEMBER 15, 1988 Mr. Golden pointed out the new traffic flow on the drawing before the Commission. There is one two-way driveway on ist Street. You enter from 1st Street, go through the drive- thru, circle back around, and come back out 1st Street (either right or left). City Manager Cheney wanted to know what happened on the sanitation access. Mr. Golden stated that there is an opening in the northwest corner to provide access to the main part of the alley. He was not sure how the dumpster would be approached. The dumpster is adjacent to the alley opening. The approach would have to be from east to west on this plan. An easement will be dedicated to allow entry into the alley. Mr. Golden stated that without the abandon- ment the applicant would have to utilize the alley as is and construct a buffer wall on the south side of the alley which is only 14' and would only allow for one-way flow. Mr. Annunziato noted that the applicant has worked out a plan with the property owner to the north to purchase his part of the alley once abandoned. The north half would be used for landscaping and the buffer wall. Mayor Marchese pointed out there could be two traffic patterns. Mr. Annunziato stated that the alley could be used but it is not paved. Mr. Golden noted that there are two dumpsters which further obstruct the alley. Craig Livingston, Architect, 1301 Congress Avenue, repre- sented Mr. Juan Gavilan who proposed to build the Kentucky Fried Chicken. He explained the alley to be abandoned as well as the rezoning request. The conditional use is requested for a drive-thru lane. He addressed the issue of the possibility of noise from the speaker box and the increased traffic which could be caused by a drive-thru lane. He stated that the average customer had to wait 1½ minutes. A customer who parks would remain on site longer than the 1~ minutes at the window. The window should help move customers through the property much faster. They had located a private hand-held telephone to be enclosed in an old world style Spanish enclosure to eliminate all outdoor sound and enclose the unit. They incorporated the 25' green- belt area according to the Urban Design Plan. They have designed a pleasing style of architecture and color scheme according to the business district guidelines. The exterior is gray with white French windows. All air conditioning units will be completely screened. He noted that 90 percent of the businesses in Boynton are small and locally owned. In order to get redevelopment started, Mr. Livingston felt that the City must look to these small businesses. Mr. Gavilan and his wife own and operate a business in Delray Beach. They will own and operate this business in Boynton Beach as well. -20- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 Juan Gavilan, prospective owner of the Kentucky Fried Chicken (KFC) restaurant, 2145 N.W. 14th Street, Delray Beach, was present to ask the City for help. He came to the United States 15 years ago to be part of the "American Dream." He bought the KFC in Delray Beach 8 years ago and had made great improvements and increased his employees from 4 to 30. He has worked his way up from washing trays to being Area Manager. He bought his own KFC. Mr. Gavilan showed pictures of the KFC as he bought it 8 years ago, and ones showing the improvements he had made. Mr. Gavilan stated that his employees usually stay with him for two or three years and he has a plan to assist them with their college tuition when they graduate from high school. His employees are like family to him according to Mr. Gavilan. He had several of his employees present with him. He also pays his employees more than other similar fast food restaurants. He wanted to be an asset to Boynton Beach as this was his way of saying "thank you" to this Country. Mayor Marchese stated that it was a pleasure and honor to meet Mr. Gavilan. He felt there would be much less crime there were more businessmen like him. if Rose Augustine, Lake Worth High School student who has an "A" grade point average stated that she has worked for Mr. Gavilan since she was 15. She is now a senior in high school, and Mr. Gavilan has been like a father to her and is a very nice person. Mr. Livingston summed up by saying that they had tried as best they could in the site available to them to sum up all the ideas Boynton Beach Boulevard requires for the redevel- opment. Mr. Gavilan is a model businessman and Mr. Livingston requested that the project be approved so that he could stay in the City. As this was a public hearing, Mayor Marchese asked if anyone wished to speak IN FAVOR of the project. Ronald West, Assistant Manager, KFC, Delray Beach, came for- ward to request that Mr. Gavilan be granted his wish to bring KFC into Boynton Beach. He felt that Mr. Gavilan would be a challenge to other business people in Boynton. He felt that the drug and crime rates would go down as a result. He started working at $4.00 an hour and he has continued to work for Mr. Gavilan. He did not wish to have any other job. -21- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 Elda, 640 N.E. 7th Avenue, had worked for Mr. Gavilan for almost two years. She felt it was a good idea to allow Mr. Gavilan to open a KFC in Boynton Beach to allow him to reach his goal. He does a good job but needs the City's support. His employees trust him. He is always there when the employees need him. As no one else wished to speak IN FAVOR of the request and no one wished to speak AGAINST the project, THE PUBLIC HEARING WAS CLOSED. Commissioner Olenik stated that since this project went before the P&Z Board and this meeting, they had seen a very responsive developer. They had met the concerns, and he was pleased with their solutions. He felt that even though this was not in the desired uses of the Boulevard, it did meet the overall scheme of the Plan. He pointed out this Plan is still in concept form. Commissioner Olenik noted that the sign is shown on one drawing as red and on another as a peach color. Commissioner Olenik preferred the peach color, but he did not know what the CAB had approved. He also noted that Palm Trees along Boynton Beach Boulevard are shown on one schematic and not on the other. The Plan calls for Washingtonian Palms along the Boulevard, and Commissioner Olenik asked if the developer would be willing to provide them for their project. Mr. Livingston stated that their wish was to be the model for the area, and they would provide the Palm Trees as requested. He would have to check with the Corporate office regarding the sign. He felt a compromise might be a white sign with red letters. Commissioner Olenik clarified that signs were not approved by the CAB at their meeting. Mr. Livingston stated they could come back with signage. Vice Mayor Hester felt that a comment had been made about the mansard roof at the CAB meeting. Mr. Livingston explained the design of the mansard roof and noted that the air conditioning units are concealed by the roof. Commissioner Weiner stated that she had some problems with the project, but not with Mr. Gavilan. She noted that on the abandonment request, the Planning Director stated that it was not desirable. Mr. Annunziato stated that the recom- mendation from the P&Z Board was that the abandonment be approved 5-2. Mr. Annunziato stated there were three com- ments from the Planning staff. One concern was that there was no land assemblage with the KFC project and staff was concerned about the use of the alley by public services. There are some problems with the project. -22- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 Commissioner Weiner stated that the P&Z approved the LUA and Rezoning 7-0, but it was stated that it would exacerbate traffic conditions in the vicinity. It was not consistent with the Comprehensive Plan policy and the Planning Department recommended denial. Mr. Annunziato agreed those things were correct. Commissioner Weiner stated that on the conditional use issue, the TRB denied the request. Mr. Annunziato stated this was correct. Commissioner Weiner felt that the Planning Department made a statement that the whole package had a problem at each turn. City Manager Cheney stated that the TRB did not have the benefit of tonight's presentation. He felt there must be something good about chicken. He noted that another chicken establishment also sends their employees to college. He also referred to the Plantec presentation which talked about abandoning an alley which brings about assemblage. One suggestion was that the City should think about abandoning the frontage on Boynton Beach Boulevard to 3rd Avenue in order to get the necessary depth to bring about development. This project is a very good looking one, and should be very well operated. It is much better than most of the businesses on the Boulevard at this time. This would be a continuation Of the narrow frontage on Boynton Beach Boulevard but the opportunity to have a new, good looking facility existed. He felt that the change of expanding to 3rd Avenue would still exist if the business expands. This is a step toward developing Boynton Beach Boulevard. City Manager Cheney felt this was a very difficult decision to make. Mayor Marchese was very pleased with the progress Mr. Livingston had made on this project in cutting out the traf- fic problem and making a very attractive building. He felt this could be a catalyst for the redevelopment. Mayor Marchese wanted to know if Anthony Mannino owned the prop- erty, and Mr. Livingston stated that it is presently under contract and Mr. Gavilan will be purchasing the property. Commissioner Olenik asked if the design plan for Boynton Beach Boulevard called for the lots east of Seacrest to go to 1st Avenue, and Mr. Annunziato stated that it did. It was Mr. Annunziato's recollection that it provides for the expansion northward, basically to 3rd Avenue and the con- solidation of the frontage. The back lots were to be con- solidated with the lots along Boynton Beach Boulevard to provide for continuous frontage of structures along the highway with parking behind. West of Seacrest would be a mixed use development of residential/commercial. -23- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 Commissioner Olenik noted that the vacant lot is not worth very much at this point, but when the applicant finishes his construction it will be worth much more. He also pointed out the parking is not in the front of the building, but behind in a fairly heavily landscaped area. Mayor Marchese asked if Mr. Gavilan's contract to buy was pretty airtight. Mr. Livingston stated that it was con- tingent upon getting approval for the restaurant with the drive-thru window. City Manager Cheney explained that this resolution will tell the legislative body if they tell the counties and municipa- lities to do something, they should provide the funds or the revenue sources to accomplish the task. Commissioner Olenik stated that he has accepted a seat as of this date on the Florida League of Cities, State Finance and Taxation Committee. One of their major goals throughout the year is to work with the State Legislature to eliminate the unfunded mandates. Mayor Marchese stated that the Florida League of Cities has begun quite a program to get some relief for the counties and municipalities as far as the unfunded mandates are concerned. 3. Palm Beach Post Article regarding Adult Entertainment City Attorney Rea referred to an article in the Palm Beach Post dated October 15, 1988 (copy attached to the original copy of these minutes in the Office of the City Clerk) which deals with the County proposed action to restrict adult entertainment facilities. He understood that at the County Commission Meeting the ordinance was adopted on 2nd reading. He felt it was one of the most comprehensive pieces of law which deals with adult entertainment as well as facilities which serve alcohol. City Attorney Rea had not heard whether the County had made a decision as to whether the municipalities could opt into the application of the ordi- nance or if they made it to opt out. The ordinance could be applied County wide to include municipalities if the munici- palities remained silent or if the municipalities were required to implement this ordinance to get into the system of regulation. City Attorney Rea suggested that if the County adopted an opt out provision requiring the Cities to take an affirmative act to no longer come under the require- ments and operation of this ordinance, the City Commission should consider whether or not they wished to remain in the process. If the County decided on an opt in provision, some direction was needed from the Commission. City Attorney Rea wanted direction from the City Commission within a couple of weeks as to whether or not the City wishes to have these types of restrictions apply to the City. City Attorney Rea noted that the County staff was worried that if the County passed the ordinance, many of the establishments would try to move into the municipalities before the municipalities could pass their own ordinances. City Manager Cheney was concerned that the County had passed an ordinance which affected the municipalities without letting the municipalities know what was happening. -32- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 Mayor Marchese asked what could be done to protect the City if the County does not opt to have the cities in. City Attorney Rea felt that the facilities would do their best to attack the city ordinances so they would be permitted in the municipalities if the County does not use the opt in for municipalities. City Attorney Rea felt that the ordinance would take effect in 60 days. Mayor Marchese felt that the City was pretty well covered, but did not want these types of facilities coming into Boynton Beach. PUBLIC AUDIENCE Signs, Sign Code, Conditional Requests Nick Cassandra, Former Mayor, Boynton Beach, stated that it was his understanding that after the sign code was adopted there was a second step which the business community had been told the City would do. This included making a list of signs not in compliance and getting back to the community to let them know if variances, etc. were required. City Manager Cheney stated that the City had taken pictures of signs throughout the City. They had the information, but had not had a chance to review those as yet. Mr. Cassandra asked if the sign by Veterans' Park which had been knocked down was going to be replaced by the City. City Manager Cheney was not aware the sign was down, but he would check into the matter. Mr. Cassandra stated that it was his understanding that the Community Appearance Board would review signs as to size, placement and color before an approval of a site plan is given. He was at the CAB on 11/14/88 and two or three proj- ects did not present their signs. The CAB made the state- ment that the applicant should come back to them when they have their signs. The City Commission had just approved two of the applicants on the Consent Agenda without comment about whether or not their signs were approved. Mr. Cassandra wondered if, for example, the applicant (KFC) would have to go back to the CAB or come to the City Commission for approval of the color of their sign. Commissioner Olenik felt that if signs are a part of the project, the CAB would have looked at them and approved them prior to sending them to the Commission. City Manager Cheney felt that he would have to look at the ordinances again, but was sure they had been reviewed as to their con- formity to the codes. City Manager Cheney would review and provide a memorandum for the Commission. -33- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 Mr. Cassandra was concerned with requests for conditional use and the fact that the applicant goes through the entire process and finally gets to the City Commission where it can be approved or denied. He wondered if the Commission might consider for conditional use only some pre-presentation to the Commission be done first. If the Commission looks favorably on the request, the request can go forward to the other boards. Mayor Marchese felt this might be a good idea. City Manager Cheney felt that perhaps the applicant could be given the option. ADMINISTRATIVE A. Consider City Manager, City Attorney and City Attorney Secretary Compensation Adjustments Mayor Marchese stated that at the November 1st City Commission meeting information had been provided for the Commissioners regarding salaries for City Managers in cities in the area. Mayor Marchese recommended that if adjustments are made for the City Manager's salary and the City Attorney's salary that they be retroactive to October 1, 1988. Vice Mayor Hester had compared the salaries from the various cities and noted that the City Manager of Boca Raton receives the highest salary ($87,000 including car and 13 percent for pension), West Palm Beach was second highest ($82,900 including car and 5 percent pension), and Boynton Beach is next ($81,840 including $400 month car allowance and 7 percent pension). City Manager's Salary Adjustment Commissioner Mann wished to see the salary remain the same as last year ($72,000 plus $400 car allowance and 7 percent pension). Commissioner Olenik stated that all City employees had been given a 3.5 percent increase this year and he proposed that the City Manager receive the same increase. This would bring his salary to $74,500 plus $400 car allowance and 7 percent pension. Vice Mayor Hester agreed with Commissioner Olenik that it was fair to give the City Manager the 3.5 percent increase other employees had received ($74,500 plus other benefits he is already receiving). Commissioner Weiner stated that other City employees received a 3.5 percent increase and another 5 percent -34- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 increase on their anniversary date which would bring their salary increase to 8.5 percent for the year. She suggested that the City Manager receive a 6.5 percent increase. This would be $76,680 plus his other benefits already being received. She felt that since City Manager Cheney had been with the City for some time, his continuity should carry some merit and should be considered in giving his salary adjustment. Mayor Marchese agreed with Commissioner Weiner and went along with the $76,680 plus benefits. Commissioner Olenik referred to the employee step-in-grade system and noted that an employees may be one, two, or three years in getting the 5 percent increase on his anniversary. Vice Mayor Hester stated that he had heard that City Manager Cheney started at a lower rate than other city managers are starting out today. He knows that experience is important and one must pay to get a good city manager. He felt that the City had increased City Manager Cheney's salary just about every year to make it comparable with the other cities. Vice Mayor Hester was concerned about a large increase in a year when the City had tightened the budget. He was still in favor of a 3.5 percent increase for the City Manager. Commissioner Mann was concerned about the City Manager's salary and felt that in a few years it might reach $100,000. He felt this was much too high. He wanted to see some general guidance for all salaries. Commissioner Olenik felt that in order to keep up with inflation, the 3.5 percent was in line. He did not feel that the City Manager was being overpaid. Vice Mayor Hester moved that the salary for the City Manager be increased by 3.5 percent ($74,500 plus $400 car allowance and 7 percent for ICMA). Motion was seconded by Commissioner Olenik. A vote was taken and the vote was 2-3 against the motion. (Commissioner Olenik and Vice Mayor Hester voted for the motion). Commissioner Weiner moved that the salary for the City Manager be set at $75,500 plus the other benefits he is receiving at this time. Mayor Marchese felt this was in order, and he felt that longevity should be considered. He was willing to go along with the $75,500 as he felt the City Manager does a good job. -35- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 Vice Mayor Hester recognized that the City Manager does do a good job, but this was not the issue. He wanted to see an evaluation tool which could be used to judge the City Manager's job performance on a yearly basis. Mayor Marchese felt that the City Manager was evaluated from day to day. He has found him to be very cooperative. He felt that a yearly progress report could be arranged. Commissioner Olenik agreed with Mayor Marchese. This was not an indication of City Manager Cheney's competence as he feels that the City Manager does a very good job. He felt that a signal must be sent that the Commission is sensitive to the wishes of the people and be more conservative with pay increases. Employees should receive some reward, but they should be a little more conservative this year. Mayor Marchese wished to see the Commission in harmony and asked if Commissioner Weiner would reconsider her compromise number. Commissioner Weiner did not feel that she could do this. Commissioner Weiner's motion died for lack of a second. City Attorney Rea stated that if the Commission wished to make a motion on one that had already failed, a motion would have to be made to reconsider. Then a motion could be made. Commissioner Olenik moved to reconsider the motion of a 3.5 percent salary adjustment for the City Manager. Vice Mayor Hester seconded the motion. A vote was taken and the motion carried 4-1. (Commissioner Weiner voted against the motion). Commissioner Olenik moved to adopt a 3.5 percent salary adjustment to the City Manager's current salary of $72,000 to $74,500 retaining the $400 a month automobile allowance and the 7 percent ICMA. Motion was seconded by Vice Mayor Hester and carried 4-1. (Commissioner Mann voted against the motion). City Attorney's Salary Adjustment Vice Mayor Hester felt that the salary adjustment for the City Attorney should be 3.5 percent and he should retain the $10,000 from the CRA budget. The present salary is $62,500 + $10,000 with no benefits. This would bring his salary to $64,700 + $10,000. Commissioner Weiner agreed with this figure and that no car allowance should be made. Commissioner Olenik agreed with the 3.5 percent increase but questioned the $10,000 from CRA. He noted that the City Attorney is a staff person and on call 24 hours a day. He felt that his salary was too high when compared with that of the City Manager. Mayor Marchese stated that at the time the CRA was a separate agency, the service of a private attorney was used. His salary was much more than $10,000. The City Commission decided to give the City Attorney $10,000 to handle the CRA portion of the business. The amount being paid for an out- side attorney who was only on call was considered, and it was felt that the $10,000 was fair. Commissioner Olenik felt that the opportunity existed to save more money than that by using the City Attorney. There was discussion regarding what the increase was for the City Attorney last year, but no one remembered. Commissioner Olenik was in favor of the 3.5 percent increase, but he was not sure the $10,000 should be included. There was some discussion regarding an auto allowance. City Attorney Rea stated that he had never requested expenses for travel unless he went a long distance out of town. Commissioner Mann was for the City Attorney, currently. not interested in a salary increase and recommended it stay as it is Vice Mayor Hester stated that he would agree with 3.5 per- cent and no car allowance. Commissioner Weiner felt that it was wrong that the City Attorney was making more money than the City Manager as far as take home money was concerned. Vice Mayor Hester stated that when the City Commission took over the CRA, it decided to give the City Attorney the $10,000 to take care of CRA. He did not feel that the City Attorney had time to perform both functions, and felt that the City must now pay him for doing so. Commissioner Weiner referred to the bills to be paid and noted that there are many expenses for outside attorneys. She did not understand why all this money was going out, as she felt the City Attorney was handling all the City's busi- ness. Commissioner Olenik felt that there are certain matters that must be handled as the City Attorney does not have the expertise in all areas concerning legal matters. City Attorney's Secretary Salary Adjustment There was discussion regarding why the City Attorney's Secretary is not included in with the other City employees. City Attorney Rea explained that at the time she was hired there was no job classification within the City for a Legal Secretary. As one was needed quickly, a Legal Secretary was hired outside Civil Service. This allowed the Legal Secretary to be hired quickly. She receives medical and dental benefits as well as vacation time, but does not have retirement benefits. Vice Mayor Hester felt this should be tabled until further information could be obtained regarding the present salary of the Legal Secretary. Commissioner Olenik felt that if she were under Civil Service she would be getting an increase and he saw no need to wait to approve an adjustment for the City Attorney's Secretary. Commissioner Olenik felt that consideration should be given to moving this position under Civil Service. Commissioner Weiner moved to approve an 3.5 percent increase for the City Attorney's Secretary. Motion was seconded by Vice Mayor Hester and carried 4-1. Commissioner Mann voted against the motion. Commissioner Olenik suggested that the City Manager cheek to see what other cities are paying their legal secretaries, and also check into putting this position under Civil Service. B. Boat Parade City Manager Cheney stated that for the past two years the cities of Boynton Beach and Delray Beach have each contrib- uted $3,000 for the purchase of fireworks to be used for the Holiday Boat Parade. He had intended to include it in the budget this year, but due to an oversight had not done so. Commissioner Weiner moved to authorize the payment of $3,000 for fireworks for the Holiday Boat Parade. Vice Mayor Kester moved to accept the resignation of Mrs. Trauger from the Recreation and Parks Board. Commissioner Olenik seconded the motion which carried 5-0. 1o Consider replacement to fill vacant position on Recreation and Parks Board Mayor Marchese moved to appoint Nathaniel Weinshel as a Regular Member of the Parks and Recreation Board. Mr. Weinshel has previously served on this Board. Motion was seconded by Commissioner Olenik and carried 5-0. Accept resignation from Walter "Marry" Trauger, Planning and Zoning Board, Regular Member, Term Expires 4/91 - Appointment to be made by Commissioner Robert Olenik, Jr. A letter from "Marty" Trauger dated November 3, 1988 ten- dered his resignation as he had moved out of the City of Boynton Beach. Vice Mayor Hester moved to accept the resignation of Walter "Marty" Trauger from the Planning and Zoning Board. Motion was seconded by Commissioner Olenik and carried 5-0. 1. Consider replacement to fill vacant position on Planning and Zoning Board Commissioner Olenik moved that Gary Lehnertz, Alternate on the Planning and Zoning Board be moved up as a Regular member of the Board. Transmittal of Comprehensive Plan Schedule City Manager Cheney stated that the meetings which involve the City Commission are shown on the calendar dated November 10, 1988. Mr. Cannon explained that Florida Statute requires that the public be allowed to participate in completing this plan. Motion was seconded by Commissioner Olenik and carried 5-0. F. Consider approval of schematic design of recreation area of North Seacrest Boulevard City Manager Cheney presented some schematics of the pro- posed design for the recreation area. Charlie Frederick, Director of Recreation and Parks was not present due to illness. City Manager Cheney explained that when originally presented there were 8.7 acres of native vegetation. There was now a total reserve area of 10.7 acres due to the fact that it includes all the plantings which go along the 1-95 right-of-way. The project is the same. They propose to do all the clearing, relocation of materials to be replanted, fence off the entire area, some temporary fencing and proceed with the building. The proposed building is shown as well as some planned future space. Some items will be bid as alternates due to the fact the City is not really sure where the money is coming from. City Manager Cheney did not bring schematics for Rolling Green as there were no changes since it was last presented. This project will also have some alternates. If the architect is given approval to proceed, City Manager Cheney would have a revised schedule for the Commissioners. Vice Mayor Hester moved to approve giving the City Manager authority to tell the architect to proceed. Motion was seconded by Commissioner Mann and carried 5-0. G. Child Abuse Center The Child Abuse Center has found a place to rent temporarily until the City finds a permanent location for the adminis- trative offices. It is at 323 North Federal on the west side. They have requested to have a grand opening in celebration of the program on Sunday, December llth, from 3:00 - 5:00 P. M. They are requesting permission to place a small tent (20 X 6) in Bicentennial Park and hold the opening there. They plan to invite some people who will bring some notoriety for the organization. City Manager Cheney was requesting approval of the use of Bicentennial Park for the purpose and permission to put the tent up. Marvin Greenhut was present to represent the organization and stated that there would be no cost involved to the City. Commissioner Olenik asked if this was in the CBD as he was concerned that this use might not be permitted in the CBD. Mr. Greenhut stated that no children would be housed there as this was strictly a business office. City Manager Cheney -40- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA NOVEMBER 15, 1988 suggested that this is a very temporary activity because the City is committed to a permanent location. He felt this might make some difference in the thinking of the Commissioners in this respect. City Manager Cheney saw no problem in approving this temporary request. Commissioner Olenik pointed out that there were volunteers from the Kiwanis who were willing to help with doing renovation. Mr. Greenhut stated that this was being done at this time. Commissioner Mann moved to approve the use of Bicentennial Park on December 11, 1988 from 3:00 - 5:00 P. M. by the Child Abuse Center representatives for the grand opening celebration and the use of a small tent. Motion was seconded by Commissioner Olenik and carried 5-0. OTHER None.
