Minutes 09-21-88MINUTES OF THE REGULAR CITY COMMISSION MEETING HELD AT PRIME BANK PLAZA, BOYNTON BEACH, FLORIDA, WEDNESDAY, SEPTEMBER 21, 1988 AT 7:30 P. M. PRESENT Ralph Marchese, Mayor Ezell Hester, Jr., Vice Mayor Leonard Mann, Commissioner Robert Olenik, Jr. Commissioner Arline Weiner, Commissioner Peter L. Cheney, City Manager Betty S. Boroni, City Clerk Raymond A. Rea, City Attorney Mayor Marchese called the meeting to order at 7:30 P. M. The Invocation was given by Vice Mayor Hester, followed by the Pledge of Allegiance to the Flag led by City Attorney Raymond Rea. AGENDA APPROVAL Commissioner Mann stated he would like to make an announce- ment on the subject of medical services. Commissioner Olenik stated he would like to recommend if possible that Item B under New Business, a variance request for signs for Quantum Park, be considered immediately following their presentation on the signs under Development Plans. Vice Mayor Hester stated that he has one announcement to make after Commissioner Mann. Mr. Cheney suggested deleting the development plans for Cross Creek Centre under the Consent Agenda, since they were not present at the Community Appearance Board meeting last night. Mr. Cheney requested that the development plans for Boynton Lakes Plaza under the Consent Agenda be tabled because they were tabled last night by the Community Appearance Board. Commissioner Weiner clarified that the preliminary plat was not tabled by the Community Appearance Board, but it was the site plan. She suggested that Item B under Development Plans be tabled. Mr. Cheney explained if the preliminary plat was approved, it could possibly give some direction that may not be desired. Mayor Marchese agreed with the City Manager and suggested waiting until the Planning & Zoning Board gives approval of Boynton Lakes Plaza. Vice Mayor Hester clarified that the preliminary plat was approved by the Planning & Zoning Board, but explained that the site plan was not approved mainly because of the out -1- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 parcels. Mr. Rea suggested removing the preliminary plat from the Consent Agenda and handling before site plan appro- val under Development Plans. After further discussion, Commissioner Weiner moved to follow the City Attorney's recommendation. The motion was seconded and carried 5-0. Mr. Cheney requested the addition of the Supplemental Agenda submitted. Vice Mayor Hester moved to approve the agenda with the corrections, seconded by Commissioner Mann. Motion carried 5-0. ANNOUNCEMENTS Mayor Marchese announced that a Budget Public Hearing would be held on September 22, 1988, at 7:30 P.M. in the Commission Chambers. This hearing will be held purely for the budget only. Brief Presentation on Health Care Taxing District Issue Mr. Cheney introduced Mr. Glen Torcivia, Assistant County Attorney, to make the presentation and added that he has answers and history. He added that this is of ~articular interest to us because we have been supporting Bethesda Memorial Hospital, while a good part of the county does not pay taxes to support a health district. Mr. Torcivia told about this tax being defeated in March with the residents of Boynton Beach voting in favor, but north county voting against. The bill was then amended to address the concern of the citizens and reduced the amount of taxes which can be set for this district. Mr. Torcivia explained how the county has three hospital taxing districts with Boynton Beach being in one of them. The point of the legislation was to correct the unfairness with all people in Palm Beach County paying for the health care. Since it was defeated, they felt 3 mills was too high and went back to the legislature and reduced the millage cap from 3 to 2 mills and not more than 1~ mill in the first year. The State Legislature has adopted this change. Mr. Torcivia explained the composition of the board with five people from this area to represent the city. The deci- sions made by this Health Care Board will be reviewed by the County Commission and Legislative Delegation. -2- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 Mr. Torcivia requested the City Commission to continue sup- port and adopt a resolution supporting this. Commissioner Olenik stated at the South County Council of Government meeting last week, he learned currently that the tax millage is .699 for Bethesda Memorial Hospital and the county has .6 mills allocated for health care services. Roughly, Boynton Beach is paying 1.3 mills for health care. The current mill cap is at 10 and if we remain in the same plan, we could pay as high as 10. He thinks we will benefit from this plan. Vice Mayor Hester stated that he needs to have more infor- mation about this. Commissioner Weiner commented that it seemed to her that it was defeated because the electorate did not know about it. She still does not know anything about it and would like to have the chance to go into it more thoroughly. Mr. Torcivia replied that he would be happy to spend as much time as needed. Mayor Marchese stated he is in favor of it from what he has read and thinks it will be a plus for the entire community. However, the Commissioners do need time to look over, study and make a decision. With the approval of this Commission, he would suggest that the City Manager put this on the agenda for the next meeting for consideration and a vote. Medical Services Commissioner Mann announced that Congress has recognized the third week in October as Emergency Medical Services Recognition week. With Boynton Beach's EMS Team having won first place in the International Life Support Competition sponsored by the American College of Emergency Physicians, he believes it is proper that we, as the City's governing board designate this week as Emergency Medical Services Recognition Week, in appreciation of the excellent life saving skills attained by the members of the Boynton Beach Fire Department. Mayor Marchese referred to this particular team going to Canada and Mr. Cheney agreed there will be some attempts to send our team and two others from Palm Beach County. Attendance at Public Hearing Vice Mayor Hester stated he wanted to let the Commission know that tomorrow night he might be late for the budget -3- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 hearing. His job requires him to be present at the open house held at school, but if he can get here before 8:30, he will be here. He will cast his vote when the final budget is approved next week. CITY MANAGER'S REPORT Police Recruitment Poster Mr. Cheney distributed police recruitment posters and told how these would be distributed at various places with three city representatives trying to recruit for the Police Department. Stop, Walk & Talk Program Mr. Cheney reported that the Stop, Walk & Talk Program, with the police officers walking in the area of Martin Luther King, Jr. Boulevard in Cherry Hills started Friday. A report was given by the three officers on Monday and the result was more positive than we hoped for. He will have reports for the Commission. The community is interested and the acceptance was great. Completion of N.W. 22nd Avenue Mr. Cheney reported that he met with the developers of Quantum Park and N. W. 22nd Avenue will be open by November 15 and Publix will be open December 17. Meeting Dates Mr. Cheney announced that the next City Commission meeting will be Wednesday, October 5, because Tuesday, October 4, is election day. The City Manager stated the budget public hearing will be held tomorrow night as scheduled and a continuation meeting is scheduled for next Wednesday, at which time all budgets will be adopted. He explained that he suggested continuing this meeting based on having time to review suggestions made tomorrow night and figure the calculations. Mr. Cheney continued that he is asking the Mayor to join him and Johnnetta Broomfield on a trip to Tallahassee and any other Commissioners who would like to go. He referred to the presentation made for land acquisition in the mangrove area to Tallahassee about a year ago which was turned down and stated he found out yesterday that is back on the agenda -4- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 for review again next Wednesday morning. He received a memo asking and suggesting that we be there. This will mean that the meeting scheduled for Tuesday with Plantec will obviously have to be postponed until early in October. Demolition Program Commissioner Weiner referred to Lottie Pierce asking about the demolition of a house at the last meeting and Mr. Cheney responded that he has been discussing the demolition program with HUD and CD. One demolition project is on the schedule to be torn down this month, but all others are being held up until the new fiscal year beginning October 1. He thinks within the next three to four months, we will be in very good shape on a lot of the pending demolitions. Mr. Cheney told about the three police officers who have been walking in the area noticing houses in need of work and advised these were also being addressed. Mayor Marchese added that he has been following the demoli- tion program and told about the involvement of our city representatives with the county. He told about Bud Howell and Johnnetta Broomfield doing their best to move the demo- lition process along. Police Recruitment Poster Mayor Marchese asked if this poster would be placed in other buildings in the city and Mr. Cheney informed him that 3,000 posters have been made and they will be posted everywhere and sent to other places. CONSENT AGENDA Vice Mayor Hester moved to approve the Consent Agenda with the corrections of deleting D-l, moving D-2 to Development Plans, plus the Supplemental Agenda. Commissioner Olenik questioned who is going to maintain the property owned by Treasure Isle that is on the other side of the canal adjacent to this property and Mr. Jim McManus, W. O. Brisben Companies, replied that they presently have no obligation to do any maintenance on that property, but they are asking the owners of that property to give them a main- tenance easement, so they can go in and maintain the pro- perty. Commissioner Olenik referred to this being tabled by the Community Appearance Board and Mr. McManus disagreed. Approve Emergency Repair on the "Variable Frequency Drive for High Service Pump ~2" - Water Treatment Plant Mr. Sullivan, Purchasing Director, outlined the emergency repair in his memo dated September 14, 1988, and recommended payment of these repairs parts from Robicon Corporation, Pittsburgh, Pennsylvania, in the amount of $1,126. F. Approve purchase of Headsets for Hazmat - Fire Dept. Mr. Sullivan referred in his memo dated September 13, 1988, to the Purchasing Department conducting research on headsets and the Fire Department testing equipment in the field and concurred with the Fire Department's decision to purchase the David Clark equipment for the Hazmat team. G. Approve purchase of "Spalding Super Range Ball" - Golf Course In accordance with Mr. Sciortino's memo, the Purchasing Department recommends the purchase of 800 dozen "Spalding Super Range Balls' from Spalding using account ~411-725-572-60.42 covering the budgeted amount of $5,000 in the 1988/89 budget. If paid by November 15, the cost for this order would be $4,464. Approve "Biomedical Equipment Full Service Agreement" - Fire Department -12- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 After researching the agreements submitted as noted in the memo dated September 13, 1988, the Purchasing Department recommends going with Physio Control, Southern District Office, Atlanta, GA, at a one time cost of $2,892. I. List of Payments - Month of August, 1988 See list attached. J. Approve Authorization for Disposal of Records - Personnel and City Clerk's Office Forms Nos. 166 and 167 were approved by the state and appro- val for microfilming and destruction is requested. K. Approve purchase of five (5) radios for Sanitation budgeted vehicles In his memo dated September 14, 1988, Mr. Sullivan advises that five new vehicles were ordered and radios not included. Approval is requested for the purchase of five 15W Privacy Plus Traxar (2-CH) Radios at a total cost of $5,383.75. L. Approve Change Order No. 1 - Raw Water Main Wells 3W to 5W The Utility Department recommends approval and acceptance of the proposal from Solo Construction Corp. at a cost of $7,900 per the memo dated September 6, 1988. Consider request submitted by Mr. Gill Hyatt, Secretary Treasurer of Jens S. Rask, Inc., General Contractors, for approval to place a construction and office trailer on site, due to the construction of McDonalds Restaurant in the Catalina Plaza The Building Department recommends approval of these trailers for one year. Commissioner Olenik asked if construction trailers had been approved for Herman's Plaza and Mr. Cheney replied that he would check. Commissioner Olenik referred to trailers being placed at construction sites without approval and Mr. Cheney informed him that when trailers are parked without approval, they are asked to get a permit. He added that the main reason for a permit is that we can take it away and the trailer will not remain there forever. He referred to No. 22 and asked if the housing program design had been approved by this Commission and Mr. Cheney replied affirmatively and explained how this was part of the contract with Plantec. SUPPLEMENTAL AGENDA III-A. Ratification of South Central Regional Wastewater Treatment and Disposal Board action of September 8, 1988: 1. Approve the Capital Expenditures portion of the Operating Budget for Fiscal Year 1988/1989 Ratification of approval of the Capital Expenditures portion of the operating budget for the fiscal year 1988/89 in the amount of $19,600. 2. Approve Operating Budget for Fiscal Year 1988/89 Ratification of approval of the Operating Budget for the fiscal year 1988/89 in the amount of $2,450,550. III-B. Approve amended Agreement between Palm Beach County and the City of Boynton Beach - Community Develop- ment Block Grant Funds This covers an amendment to Part III - Compensation, Time of Performance, Method and Conditions of Payment with changing the date to March 30, 1989 from September 30, 1988. III-C. Bids: 1. Golf Course Cart Path Resurfacing & New Cart Path Construction The Tabulation Committee recommends awarding the bid to the lowest bidder, Charles Whiteside, Inc., Lake Worth, Florida, in the amount of $22,981. Commissioner Olenik questioned how old the current cart path is that it needs to be resurfaced and Mr. Sciortino explained that approximately 500 feet of resurfacing is needed because of Australian Pine roots and the paths are about five years old. Also, about 2,900 lin. feet is being added to extend where the golf carts are going and he explained. Commissioner Olenik asked if this is being paid out of the golf course fund and Mr. Sciortino replied affir- matively. -14- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 2. 8,400 Pounds of Grass Seed for Boynton Beach Municipal Golf Course The Tabulation Committee recommends awarding the bid to the low bidder meeting specifications, Woodbury Chemical, in the amount of $7,560. 3. Two (2) Golf Utility Vehicles The Tabulation Committee recommends awarding the bid to the lowest bidder meeting specifications, Hector Turf, Inc., Deerfield Beach, FL, in the amount of $11,256, less $1,656 for trade-ins for a total of $9,600. The applicant is requesting that additional criteria be provided on the master plan to specifically allow swimming pools and spas with a 6 ft. rear setback and a 5 ft. side setback and additional criteria for screen enclosures as outlined in the letter of submittal. He then explained the procedure for approving master plan modifications in planned unit developments as outlined in the memo dated September 14, 1988. Mr. Golden stated the TRB met on September 6 and reviewed the plans and the applicant's request and offer that this request is not substantial and should be forwarded to the Planning & Zoning Board for final approval subject to staff comments. Mayor Marchese referred to the letter written and expressed his concern about an individual draining his property onto another property. Commissioner Olenik clarified that if the makeup of the property changed, it is possible the preliminary plat would have to be modified and Mr. Annunziato agreed if there are changes to the prelimi- nary plat resulting in substantial changes to the site plan, they would have to come back. -17- MINUTES - REGULAR CITY COMMISSION MEETING BOTfNTON BEACH, FLORIDA SEPTEMBER 21, 1988 Mayor Marchese referred to his concern being the outparcels and Mr. Annunziato clarified that the preliminary plat as proposed does not crea~ tracts of land for outparcel construction, but explained how it was the applicant's intent to lease the outparcels. Mayor Marchese referred to just approving the preliminary plat and Mr. Annunziato suggested that it may be cleaner to act on both applications at once and added that it is likely there may be some minor changes to the preliminary plat depending on what the applicant does if he changes the site plan. Vice Mayor Hester asked if the preliminary plat has anything to do with the outparcels and Mr. Annunziato explained that the preliminary plat does provide utilities to serve the outparcels. Attorney Ray Royce, 450 Royal Palm Way, Palm Beach, repre- senting the applicant came forward. He referred to not getting a sense of direction from the city and explained how they have been resubmitting for months trying to come up with a shopping center development in accordance with requirements. After examining the ordinances, he believes they have met the requirements, but there seems to be two questions that are outstanding. He told about changing the landscaping to meet requests of the Community Appearance Board. He then told about there being a question of the color preference and they would like to know what colors the Board prefers. He stressed that it was not their desire to create any problem and they are anxious to cooperate and go forward. Mr. Royce continued that in examining the code and ordinan- ces, there does not seem to be any criteria pertaining to outparcels with regard to site plan approval. They do not own the corner of the intersection, but have to work with what they have. They have provided for three outparcels with two facing on Hypoluxo Road and one facing on Congress Avenue. He referred to the setbacks and road widenings and pointed out that they were not trying to push parcels of land onto the edge of the right-of-way. This is a major intersection and he thinks the size of the site can justify outparcels if they are set back and controlled. Mr. Royce concluded that they were agreeable to having con- ditional approval subject to the Community Appearance Board chosing the final color, but they need to. go forward. -18- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 Commissioner Olenik referred to the Community Appearance Board tabling this application and stated with not having their approval, he was hesitant to approve. Mr. Annunziato agreed it was tabled by the Community Appearance Board and he presumes it would come off the table at their next meeting. Commissioner Olenik referred to having four outparcels on this corner and stated he has strong concern of four outpar- cels on this busy corner. Personally, he thinks an outpar- cel can detract from the beauty of a site. Mr. Royce stated that the outparcels would have to come back before the Commission for approval. Commissioner Olenik asked if a shared parking study had been done and Mr. Annunziato replied affirmatively. Commissioner Olenik asked if the number of outparcels could be controlled and Mr. Annunziato replied affirmatively and added that the applicant could add to the square footage of the main buildings. He continued that outparcels add to the congestion of a site and detract from the appearance of a shopping center. Commissioner Mann referred to Mr. Royce's statement that he thought he had approval of this plan and Mr. Royce clarified that his understanding was the landscaping plan was approved by the Community Appearance Board and according to the code, it does not require Community Appearance Board approval. They would be happy to obtain color approval from the Community Appearance Board. He thinks they have complied with the technical requirements of the code. He requests this be judged on its merits as this is a good project and he asks for favorable consideration. They have complied with the criteria. He thinks, if necessary, the Commission's approval could be conditional and it could be delegated back to the Community Appearance Board for a final decision on color selection. Vice Mayor Hester referred to the usage being changed and Mr. Annunziato clarified that the Commission has the authority to regulate the number of outparcels because of congestion, aesthetics, and harmony. He thinks it is help- ful for the applicant to understand what the consensus of the Commission is. Vice Mayor Hester clarified that all outparcels would have to come back before the various boards for approval and Mr. Annunziato agreed this was correct. Vice Mayor Hester suggested waiting until the plans are brought back for the outparcels and then making a decision whether they should be built. -19- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 Commissioner Weiner stated she has a good understanding of the corner problem. She understands the economics of out- parcels, but does not like the aesthetics of outparcels. This is an entrance to our city and we want that entrance to look as wonderful as possible. If there is a way to increase the intensity of square footage without using out- parcels and decrease the number, she would be more in favor of it. Mayor Marchese agreed and stressed that this is an entrance to the city and explained how he felt a dangerous vehicle situation would be created at this corner. Mr. Cheney clarified that outparcels will be reviewed again by the City Commission, but once created, he doesn't think they can be uncreated. Commissioner Weiner made a motion that the development plans of Boynton Lakes Plaza be denied, seconded by Mayor Marchese after turning the gavel over to the Vice Mayor. Under discussion, Vice Mayor Hester asked if we could legally deny this project if the applicant has met all the requirements of the code and Mr. Rea stated that the comments from the TRB and Planning & Zoning Board must be given consideration and to legally deny the site plan, it must be indicated that the site plan, buildings and structures are not in harmony with the commprehensive plan, that the proposed use and structure is in the most part not compatible with the uses of nearby properties, and that the proposed use is not in conformance with the intent of the codes and ordinances. From the TRB evaluation, it did meet the standards of the code. Commissioner Olenik referred to giving the Community Appearance Board their right to make recommendations and suggested possibly tabling this since comments have been made for the developer's consideration. Mayor Marchese clarified that his comments were relative to the outparcels and he thinks a safety trap would be created. He would have no objection to tabling this so they can get their forces together and go before the Community Appearance Board with the necessary adjustments. Commissioner Weiner withdrew her motion and moved to table both the site plan and preliminary plat. Commissioner Mann seconded and the motion carried 5-0. At this time, Mayor Marchese declared a five minute recess and then reconvened the meeting at 9:10 P. M. -20- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 Ce Project Name: Agent: Owner: Location: Description: Quantum Park George W. Zimmerman, Vice President of Development Quantum Associates West of Interstate 95, between Miner Road extended and the Boynton C-16 Canal Site Plan - Request for approval of project signage. Mr. Annunziato announced this is the first major presen- tation being submitted for a sign package in connection with the new sign code. Miss Heyden referred to the intent of the new sign code and showed renderings of the signs pro- posed. She advised that all these signs conform to the Technical Review Board's recommendation for size with the exception of the land use section sign, which the applicant has agreed to reduce. The Planning & Zoning Board recom- mends approval subject to staff comments with the exception of signs B1, Bll and the number of free standing signs, all of which require variances to the provisions of the sign ordinance. In addition, the Board unanimously recommended approval, in concept, of signs B1, Bll and the requested number of free standing signs. Miss Heyden stated there are four variances involved. The B1 sign which will be located along the railroad tracks and the purpose is to have visibility from 1-95. The Bll sign was a directional sign which the code restricts to 12 square feet and the applicant desires 18 square feet and the Building Department makes the recommendation that is accep- table due to the large amount of information in an industrial park of this size. She pointed out the locations of the free standing signs along Congress Avenue and advised the variance requested is for setbacks and the Building Department has recommended the setbacks be allowed for signs B6, B4 and B2 only. Mr. Michael Tolle, Development Manager for Quantum Corporate Park, referred to the ordinance being written to address a parcel of land and the signs which pertain to that parcel of land and stated that they have a conglomeration of land par- cels and explained how their signs pertain to a district, parcels within the park, and to the park overall. He gave the example of the B2 sign and explained how it was located along an internal property line set back from 22nd Avenue. He advised for the particular cases where the sign does not apply to a specific parcel within the park, they have asked for consideration on granting a variance from the individual parcel lines. He further explained that the traffic signs were requested to be located within the right-of-way and not conform to setback requirements because of the necessity to -21- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 be adjacent to the roadway. He showed how the signs had been colored to blend into the landscaping. They have asked for additional free standing signs because of the districts being separate and needing identification and he pointed out how they have two districts with one facing Congress Avenue and one facing 1-95. He showed the proposed directional signs and explained how these were needed to cover the area they have along 22nd Avenue. After further comments, Vice Mayor Hester moved to approve the Quantum Park site plan subject to all staff comments, seconded by Commissioner Mann. Motion carried 5-0. Variance Request for two (2) Free-Standing Signs and Numerous Directory Signs Commissioner Olenik requested the staff to go over the exact variances and Miss Heyden stated the variances would be for sign B1; Bll, the number of free-standing signs; and the free standing sign setback reduced to zero for B6, B4 and B2o The B1 and Bll variances are for size. Mr. Tolle added they would also like to have the setback variance on sign B1 because of where it runs on the adjacent properties along the roadway and he pointed out the location to fit in with the overhead power lines. Commissioner Olenik moved to grant the variances for the Quantum Park signage, specifically for signs B1 related to size, Bll relating to size, number of free standing signs and for reduction of setback for signs B6, B4, B2 and B1. Motion carried 4-1 with Commissioner Olenik dissenting. LEGAL A. Ordinances - 2nd Reading - Public Hearing 1. Proposed Ordinance No. 88-32 - Re: Amendment to Fire Sprinkler requirements in residential units over one story (Continued from August 2, 1988 meeting) / Mr. Cheney stated this ordinance had not been acted on because a workshop has been scheduled to discuss it; however, he just received a memo from the City Attorney regarding a new state law. Mr. Rea added that an amendment was passed during the 1988 Legislative Session requiring every local governing body to meet new requirements when adopting regulations which are more stringent than the State Minimum Building Code and this is such an ordinance. Under the 1988 law, we would be required to make a determination based upon a review of local conditions which specifically demonstrate that local conditions are such that more stringent requirements to the State Minimum Building Code are required to be implemented. Since it is his understanding that within the municipal city limits, no spe- cific local conditions are sufficiently unique to require the adoption of more stringent requirements, he believes that this city cannot implement the ordinance as proposed. He also understands that our conditions are similar to those throughout the county and we cannot find a specific and uni- que need for the sprinkler requirements which would justify the passage of this proposed ordinance. He regommends this ordinance be removed from any workshop agenda and defeated on second reading or simply deleted from any future agenda. He suggests we recommend this back to staff to see if there is justification for the passage of this ordinance and pending that result, then go to a workshop. He suggests that the staff review the conditions. He believes this ordinance would have to be amended substantially and rewrit- ten to go through first reading again. -23- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 Mayor Marchese clarified that from the City Attorney's legal research, he indicates this ordinance is premature in the sense that we have not established a need for this kind of protection. He referred to this being considered in order to prevent a disaster. Mr. Cheney agreed this was another case where the legislature through special interest groups have a minimum standard which we cannot increase. He feels it may be hard to prove that protection of a unit in Boynton Beach is different in comparison to other parts of the state. Commissioner Olenik asked if we would be left just under the Southern Building Code and Mr. Cheney replied affirmatively and explained that code covers kinds of construction and addresses the fire spread between units, but not the fire within a unit. Vice Mayor Hester suggested going ahead with the City Attorney's suggestion to remove from the agenda and send back to the staff to see if they can justify more stringent requirements and bring back and go to workshops for approval or disapproval. He moved to delete this from the agenda until the staff has an opportunity to research whether we need more stringent requirements, seconded by Commissioner Mann. Under discussion, Commissioner Weiner commented that she was sorry we had to do this. Motion carried 5-0. Commissioner Olenik clarified that the workshop scheduled on September 29 would be for impact fees only, but added that it was mentioned earlier about discussing the hospital taxing district further and we might want to discuss that. Mr. Craig Livingston came before the Commission and thanked them for their support and added he would be more than willing to submit a quarterly report and will meet with Mr. Cheney to develop a format which would be acceptable. Commissioner Olenik moved adoption of this contract between the City of Boynton Beach and the Greater Boynton Beach Chamber of Commerce, with the addition of a quarterly report covering economic development in our city. PUBLIC AUDIENCE Compliment given for Satisfactory Response to Utility Condition Mr. Wilbur Lynch, 1912 S.W. 16th Avenue, President of Boynton Leisureville Community Association, stated he wanted to thank personnel in the City Manager's office, Building Department and Utility Department and told about a serious utility condition in Boynton Leisureville and how it was satisfactorily handled. Request for Sidewalks Mrs. Wilda Searcy, 402 N.E. 13th Avenue, requested the Commissioners to come to her neighborhood and just look at it. She told about the conditions encountered by the children walking to school with having no sidewalks, no guard rail at the canal, drugs being sold on corners, etc. She would hope that her community would be improved as she sits at these meetings and hears how beautiful other areas are being made. The money is available from CD. Mayor Marchese replied that he would like to visit her area and added that he doesn't have sidewalks where he lives. He would also like to know about the money being available as every time he checks, the money has not come. Mr. Cheney clarified that there is no money available for sidewalks on N.E. 13th Avenue and he has asked Mrs. Searcy to bring in -27- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 the letter where this is stated. It was included in the request from Community Development this year, but was not approved. Go-Cart Races Mr. Lloyd Powell, 1112 N. Federal Highway, stated he was present on behalf of the State Lodge FOP District 4 and told about plans for the third annual go-cart races for October 15 and 16 at South Tech. With the concurrence of the City Commission, he trusts the City of Boynton Beach will help out once again with utilization of the Police Department, Parks & Recreation Department, and Department of Public Works to make this event successful. Mayor Marchese com- mented that this sounds like a worthy project. Mr. Cheney advised the major cost is some police overtime, but a lot of police get involved through the FOP and there is no problem. Mayor Marchese requested him to go ahead. Lantana Correctional Institute Mrs. Dee Zibelli, 440 Ocean Parkway, referred to a very good friend of hers being shot who was a member of the West Palm Beach Police Department and told about the man who did it having escaped from the Lantana Correctional Institute. She would like this Commission, as a sister city to Lantana and since it is closely related to our city, to send a resolu- tion to the Lantana Commission saying we do agree with them that we should not have those types of criminals in our area and it also should not be a women's institution either. That facility should be used for drug rehabilitation and not a prison. Mayor Marchese agreed that it has been proven without a doubt that this particular institute is not run properly and has caused lives. With the consent of this Commission, he would like a resolution to go out whereby that facility will not house any criminals. He would like to see the prisoners moved out. Commissioner Olenik agreed there have been problems with Lantana Correctional Institute in the past, but by closing it down, it only moves the problem elsewhere. The other prisons are overcrowded. He is not sure it is the best thing to close down a prison or house of correction. The management has not been what it should be, but he thinks we should work with the state to insure the safety of our resi- dents in the area by providing better management and better controls and limiting those types of criminals housed there. -28- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 He does not see how closing down will solve the overall crime. Mayor Marchese replied that in the broad sense, he agreed, but he thinks it is about time the legislature of this state does some homework where to house these people. He gave examples of prisons having fulltime television, all kinds of recreation, etc. and stated he was under the impression when in prison, those rights are given up and the result is that better facilities are built than some people live in. He explained how he did not think it was workable to keep pri- soners inside the walls at Lantana. Commissioner Mann stated that he didn't see anything wrong in sending a resolution to Lantana. Commissioner Weiner commented that it is a very complicated problem and she didn't think we were prepared tonight to begin to resolve it. She is terribly upset that the West Palm Beach officer was killed. She would be amenable to sending a resolution expressing our condolences to the police and hopefully getting the management of that facility made stronger. Mayor Marchese suggested sending a resolution supporting Lantana as well as to the lawmakers in Tallahassee also. Mr. Cheney suggested that he meet with the Lantana officials and report back to the Commission what position they are taking. The Commissioners expressed approval. Impact Fee for BPOE 2676 Mr. Carl Williams, 4175 - 88th Place South, told about the Boynton Beach Elks Organization and how funds collected are spent for charitable purposes only. He stated they have recently applied for a building permit to move into new quarters and have been assessed $5,000 for a water fee and they are requesting dismissal of that fee. Mayor Marchese questioned whether the Commission has that latitude and whether it would be legal. Mr. Cheney clarified that the Elks Lodge wants to move into a facility on South Federal Highway and explained the developer has paid the minimum of the water and sewer, but when a specific use comes into a unit, there are sometimes additional faci- lity charges relating to a particular use and he gave examples. He referred to this fee being the responsibility of the building owner, but advised that it is usually passed onto the tenant. He explained further how the fee is based -29- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 on the code adopted. Also, these facility fees are paid into the utility funds because of the payback for utility bonds. Commissioner Weiner asked if the city could make a contribu- tion to this facility and Mr. Cheney replied that they pro- bably could, but it must be considered that all taxpayers would then be paying for the benefit of the Elks. Commissioner Olenik referred to paying for the VFW Post on 17th Avenue and Mr. Cheney agreed this was done for this veterans organization. Mr. Rea clarified that as far as charges are concerned, the ordinance provides for no waiver of that fee. There is the obligation of bonding. Commissioner Weiner referred to the reason for the move and Mr. Williams told about the lodge being out of business on North 4th Avenue and this was the only location they could afford, but were unaware of the water fee. Commissioner Olenik questioned how the fee was calculated and Mr. Cheney explained how the basic fee is for water con- sumed in a single family home and explained how the fees are calculated. Mr. Williams referred to the fee being based on an 80 person occupancy and told how the likelihood of having 80 people there was very remote. Further discussion ensued regarding how the cost was related to the occupancy usage. Further comments were made regarding the waiver of fees and what organizations should be covered. It was agreed Mr. Cheney would check back into this and also the various cate- gories and how the rates apply. OLD BUSINESS aJ Review Cemetery Board Recommendation concerning repair of Mausoleum roof Mr. Joe Delaney, 350 Main Boulevard, stated he was present as Chairman of the Cemetery Board and stated it was brought to the Board's attention about six months ago that the mausoleum was still leaking. He told about asking city inspectors to check the roof and receiving three answers and then asking for estimates from roofing contractors and again receiving three different proposals. Considering the building is only about five years old and the roof should last ten years, it was the unanimous vote of the Cemetery -30- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 Board to have it repaired. He would like his friend, Mr. Dick Duncan, a retired roofer, to give the Commission further information, so they don't vote for $6,000 to make the repairs if it is not necessary. Mr. Dick Duncan, 137 East Woolbright Road, stated he has been a roofing contractor in this city for over 20 years. He guarantees the mausoleum roof can be repaired and $6,000 is too much. Mayor Marchese asked if he had seen the roof and Mr. Duncan replied that he could guarantee what it was and explained how roofs tended to wear at certain points. Commissioner Olenik referred to the roof being guaranteed and Mr. Duncan agreed that it should be for a minimum of ten years. Mr. Cheney clarified that he put this on the agenda because the Cemetery Board recommended repairing this roof. The mausoleum is owned by the city and he was uncomfortable going ahead with a $900 job instead of a $6,000 job. He thinks there has been some damage and it is not just a leak situation. There is no warranty. He intends to obtain all the backup information and requests that it be tabled. NEW BUSINESS Consider request submitted by Thomas T. McMurrain of Walboyn Development Corporation, for approval for a variance on the Boynton Beach Sign Ordinance for the placement of a flat sign advertising "Catalina Court - A Professional Plaza" (Tabled) Vice Mayor Hester moved to take off the table, seconded by Commissioner Olenik. Motion carried 5-0. Mr. Tom McMurrain explained how they have an area which is a courtyard sitting behind the retail center with no signage on Congress Avenue. He showed a plan and explained how they were proposing to put a sign on top of one of the archways. Vice Mayor Hester moved to approve this request submitted by Tom McMurrain for Walboyn Development Corporation, seconded by Commissioner Mann. No discussion. Motion carried 5-0. Mr. Cheney added that in reference to Catalina Center and the request for a wall in the middle of the Gerulaitis Tennis Resort, the code was reviewed and an interpretation made that as long as that area is one use, there will be a wall at the south end where the parking lot is adjacent to residential structures, but there will be no wall where the -31- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 tennis courts face tennis courts or the lake faces tennis courts. The stipulation is if the Gerulaitis Center breaks up and the tennis courts in the residential side have no connection with Gerulaitis, then the wall has to go up. That ruling has been made. It is an administrative interpretation. Mayor Marchese added that legal documents will be prepared. ADMINISTRATIVE ae Consider formalizing Board nomination and appointment prooedures - requested by Mayor Ralph Marchese Mayor Marchese proposed a new talent bank form and pointed out that he had added the question of ever having been con- victed of a crime. He thinks the procedure should be set in concrete for making appointments. He suggests that the City Manager maintain a list and the names rotate. He explained that each Commissioner should have two meetings in which to nominate a board member and if a majority vote is not received at the second nomination, then the appointment moves onto the next Commissioner. Commissioner Olenik clarified that he was saying that a Commissioner is given two meetings in which to nominate somebody and receive a majority of approval of this Commission. If not successful in getting a majority, then the nomination goes to the next person in line. Mayor Marchese agreed the appointment would go for two meetings and that is all. Vice Mayor Hester disagreed with this procedure. He explained that he didn't think a nomination should be taken away from a Commissioner after two meetings because a nomi- nation had not been made and told about having difficulty finding someone wanting to serve on the Cemetery Board. He does not think another Commissioner should take that right away from him. Vice Mayor Hester continued that he also had problems putting on the talent bank form the question about ever having been convicted of a crime. He knows why this came about, but he has problems with it being on the form. Mayor Marchese replied that he thinks it is incumbent upon this Commission to be sure we have top rate people. Discussion ensued about how this question would be checked and whether people would be inclined to tell the truth. Commissioner Weiner stated she had no problem with asking this question, -32- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 but asked if it was unconstitutional and Mr. Rea replied negatively. Commissioner Weiner continued that with reference to the time limit, she feels if she were having difficulty finding a particular appointment and could not do it within a month, she thinks she would be glad to have her turn passed onto someone who could fill it. Vice Mayor Hester replied that he wanted somebody who was going to represent him, no matter how long it takes. His right to appoint somebody to these boards should not be taken away. Mayor Marchese clarified that it was not his intent to take away from any Commissioner the right to make an appointment, but the appointment should be made as soon as possible. Further comments were made about the talent bank form being a request to serve on a board. Commissioner Mann stated it is a big problem to take away the right to appoint somebody if it does not get approved. The right to appoint would be removed. He does not understand what is behind the reason to put a time limit on it. Mayor Marchese stated that we have been following this pro- cedure and he is suggesting that it be written so it is in the administrative code. Commissioner Mann disagreed and stated that this would take away an appointment if not made in two meetings or receive two seconds to the nomination. Commissioner Olenik stated he didn't think the question was an unreasonable request on the form, but suggested to assure that true statements are made that a disclaimer be added to certify that true information is being given. Mayor Marchese agreed this would be very worthwhile. Commissioner Olenik continued that as far as the two chan- ces, he agrees from a standpoint of expedience and of doing a disservice to the board by delaying an appointment and from a political standpoint, it could be conceivable if a Commission has a nomination and it is not desirable by the majority, it could go on indefinitely with no appointment being made. Mayor Marchese passed the gavel to the Vice Mayor and made a motion that we pass administratively a method of appointing people to the various boards. Specifically that each Commissioner will have two opportunities when his turn comes -33- MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA SEPTEMBER 21, 1988 to appoint somebody to a city board, he may table once if he so desires, but the next time he must come up with a name, so within two meetings the position will be fulfilled and in order to fill a position, he must get three votes or majority of the votes. In the event he fails, the next Commissioner would take that assignment and make that appointment. Also, the form shall include a disclaimer, so the city is protected as much as humanly possible. Commissioner Weiner seconded the motion. Under discussion, Vice Mayor Hester stated he doesn't know why this came up because we have been making the appointments in the allotted time and he hopes it is not anything which will cause problems as far as appointments to the boards, since we have not had any trouble with the method that was used. If he made a nomination and did not get a second and then made a second nomination and did not get a second, this would be taking away his right. Commissioner Mann agreed that this method would be totally wrong. Motion carried 3-2 with Commissioner Mann and Vice Mayor Hester dissenting. Mayor Marchese requested the City Manager to have the form changed appropriately. Be Consider replacement to fill alternate position on Cemetery Board. Term expires April, 1989 - Appointment to be made by Vice Mayor Ezell Hester, Jr. (Tabled) Vice Mayor Hester requested this to remain on the table as nobody was available after he checked the talent banks. Commissioner Olenik clarified that Vice Mayor Hester would have another meeting in which to make this nomination and Vice Mayor Hester questioned why the rules would be changed now and suggested they not take effect until new board appointments are made in March. Mayor Marchese replied that was not his intent. Consider replacement to fill alternate position on Planning & Zoning Board. Term expires April, 1989 - Appointment to be made by Commissioner Leonard Mann (Tabled) Commissioner Mann made a motion to remove this from the table, seconded by Commissioner Olenik. Motion carried 5-0. Commissioner Mann referred to analyzing copies of all the talent bank forms from people who were interested in the Planning & Zoning Board and then nominated Jose Aguila. Appointment of City Representative to Metropolitan Planning Organization Mayor Marchese asked if anyone would like to volunteer for this position and Commissioner Weiner replied that she would like to volunteer her services and she would like to be a functioning member of this Commission. Vice Mayor Hester moved to appoint Commissioner Weiner, seconded by Commissioner Mann. Motion carried 5-0. Commissioner Olenik referred to former Mayor Nick Cassandra still sitting as the Chairman of the Fire and Police Pension Boards and Mr. Cheney informed him the legislature has said the Mayor is not automatically a member, so Nick Cassandra was appointed as a member and not as the mayor. He then explained how the city could lose some control. Commissioner Weiner asked if possibly the current mayor should always be a member and Mr. Cheney replied that was previously the law, but explained that the Commission now makes the appointment. Further discussion ensued regarding whether the mayor should be a member of these boards, but how appointments were only made every two years. E. Veteran's Memorial for Boynton Beach Cemetery Mayor Marchese announced that a number of veterans have been working together to put a memorial plaque in the cemetery. He showed the plaque. He added that Mr. Cheney has found a way to get this plaque installed in the cemetery. Mr. Cheney clarified that this plaque is dedicated to the veterans, but the plaque does not say the whole cemetery is dedicated to the veterans. A stand is going to be built and he suggests that the Commission accept this to be put in the cemetery. Commissioner Mann so moved, seconded by Commissioner Olenik. Under discussion, Commissioner Olenik asked if it would be completed by November 11 and Mayor Marchese replied it would be completed by October 1. Motion carried 5-0. F. Request for Funds - South Florida Science Museum Commissioner Weiner stated according to the information she has been given, the request is for $250. Everything we can do to promote interest in science among our children deserves support.
