Mayor Hester called the meeting to order at 6:00 P. M. The
Invocation was given by Reverend Joseph Dye, Boynton Beach
Congregational Church, followed by the Pledge of Allegiance
to the Flag led by Commissioner Robert Olenik, Jr. Mayor
Hester mentioned that there were numerous people in the
audience who were past Commission members, as well as pre-
sent and past board members.
AGENDA APPROVAL
City Manager Cheney deleted under "CONSENT AGENDA" Item D. 3
"Cross Creek Centre" as the applicant failed to appear at
the Community Appearance Board meeting held on August 15,
1988. Under "DEVELOPMENT PLANS" he deleted B. "Consider
approval of Master Plan Modification - Meadow Lake." He
added three bills under item L, "CONSENT AGENDA" -
$110,392.06 to the Solid Waste Authority, $111,819.65 to the
Regional Sewer Board, and $2,629.20 for the architect, Oscar
Vagi. At the end of "ADMINISTRATION" he added "Discussion
of the Proposed Contract with Spillis Candela & Partners,
Inc., regarding the Multipurpose Building.
Mayor Hester stated that two people wished to speak early in
the meeting as they had to leave.
Commissioner Olenik wished to pull Item D.5 "N/D Auto" from
the "CONSENT AGENDA" for discussion. He also had an item he
wished to add after the "CITY MANAGER'S REPORT."
Commissioner Mann wished to add "Appointment of City
Commissioner" after "CITY MANAGER'S REPORT."
City Attorney Rea added item D.3 Under "LEGAL", "Settlement
of Code Enforcement Case No. 87-214."
Commissioner Olenik moved to approve the AGENDA as
corrected. Motion was seconded by Commissioner Mann and
carried 3-0.

1. City Hall will be closed Monday,

Mayor Hester stated that City Hall will be closed Monday,
September 5, 1988 in observance of Labor Day.
Next City Commission Meeting will be held on
Wednesday, September 7, 1988, due to Election Day,

Mayor Hester noted that the next City Commission Meeting
will be held on Wednesday, September 7, 1988, due to
Election Day on Tuesday, September 6, 1988.
Public Hearings on 88/89 City Budget and Proposed
Millage will be held on September 12, 1988 and
September 22, 1988 at 7:30 P. M. in the Commission
Chambers
Mayor Hester stated that public hearings on the 88/89 City
Budget and proposed millage will be held on September 12 and
22, 1988 at 7:30 P. M. in the Commission Chambers.
Exchange Club
Nick Cassandra, former Mayor of Boynton Beach requested that
he be allowed to make a presentation regarding a Prevention
of Child Abuse Center. He stated that effective August 27,
1988 he would become a full member of the Exchange Club
which hopes to sponsor this Center. He noted that he had
always been interested in providing for the children of our
area. He had worked with Little League, interested in the
Day Care Center and other programs. The City has also con-
sidered providing space for the Ministerial Association. He
had two requests to make as he knew Boynton Beach is a City
that cares:
1. Possible temporary space for the Prevention of Child
Abuse Center. The Exchange Club would fund the staffing,
but the space is needed. He suggested that space in the
back of the Civic Center might be considered. The optimum
would be 1800 square feet of space to be used for coun-
selors, the director and storage space. If any other orga-
nization in the City has space the Club would appreciate it.
They are ready to start the program in October. They have
the staff and are ready to go.
2. With the new construction going on, he requested
that the Center be kept in mind along with the Ministerial

Association, and if permanent space could be made available
for them, it would be greatly appreciated. He suggested
that space might be available in the multipurpose
recreational facility or perhaps at the Madsen Center. He
wanted to see a Center in Boynton Beach. He suggested that
the Chamber of Commerce might want to get involved with
trying to locate space for the Center. The City could
publish their concerns for the abused children and their
plans to estabish a Center in their newsletter. He asked
for full cooperation from the Commission for his temporary
request as well as the permanent request.
Mayor Hester requested that these matters be taken into con-
sideration and requested the City Manager check into the
requests to see what could possibly be worked out.
Robert Walshak
Mr. Walshak came before the Commission as a citizen of
Boynton Beach and stated that he wished to make a statement
of fact. He continued by saying that in 1976 he was hired
by Bill's Trucking, Inc. of Pittsburg, PA as a Truck Fore-
man. He worked in that capacity for four years and resigned
in 1980 to go into business for himself. In March, 1985
(five years after he left the company) he was called before
the Grand Jury in Harrisburg, PA in reference to an
investigation of the Municipal Industrial Disposal Company
which was owned by Bill Fiore who also owned Bill's Trucking
Company in Pittsburgh. His appearance before the Grand Jury
lasted five or ten minutes. He stated that he was not a
principal, not a stock holder, nor was he a key employee at
that time. On June 6, 1985 he was indicted by the Grand
Jury in Pennsylvania. Fourteen days later the dismissal
process of the indictment process started, and on August 6,
1985 all indictments were dropped against him and dismissed.
He was adjudicated "NOT GUILTY." He was 42 years old at the
time. He continued by saying that up until that date and up
until this date (he is now 46 years old) he stood before the
audience as "Not Guilty." He stated that no records anywhere
say he is guilty of any criminal activity. He believes in
the American justice system. He fought to protect the
system with honor and pride. He is a Vietnam Veteran
decorated. He believes in democracy with all his heart and
he intends to be a part of the democratic process in govern-
ment. He stated that he and his family had been smeared by
a newspaper. The reasons for doing so remain to be seen.
He quoted from the Palm Beach Post dated Friday, April 22,
1988 by Mr. Ed Sears (Editor of the Post) which said: "We
have not broken any laws nor have we ever encouraged any
reporter to break any laws." Mr. Walshak stated that the

statement was an out and out lie, and he felt that it would
be proven by the democratic process in the court of law
where it belongs. He then thanked the Commission and the
citizens for their attention.
CITY MANAGER'S REPORT
Population of Boynton Beach
City Manager Cheney stated that the estimate of the City's
population as listed by the University of Florida is 46,310.
This is an increase of 2254 over the past 12 months (5%).
It is a 30% increase (10,686) since 1980.
Boynton Beach Playhouse
City Manager Cheney had attended the presentation of "Annie"
which was a half hour of entertainment by approximately 30
children. He was surprised at the interest by the children
in this type activity. This was something that had not been
in Boynton Beach and he was encouraged by the turnout of
approximately 200 people.
Rental Law
City Manager Cheney stated that the Rental Law requires that
the owner obtain an occupational license. The City had sent
out 473 mailouts. Of those, 43 were returned undelivered.
95 replies have been received back to date and the City is
in the process of beginning their inspections. If the units
are found satisfactory, they will be licensed. The mailouts
were sent on July 14th and in a one month period there has
been a 20% return. The next group of mailouts will be sent
just as soon as the first group stops coming back in.
Opening of 22nd Avenue
City Manager Cheney noted the concern over the opening of
22nd Avenue. He had been corresponding with Deutch/Ireland
and they are aware of the City's concern. Mr. Deutch has
assured City Manager Cheney that the road would be open by
the middle of November. It will not be properly landscaped,
but it will be open for traffic.
Traffic Light at Catalina Centre
Funds for the traffic light at Catalina Centre and Motorola
are available by both Catalina Centre and Motorola. The
County has been notified and should authorize their contrac-
tor to install the light.

There is still some discussion regarding the left turn north
bound over the bridge. Apparently the County first approved
it, then disapproved it. With Commission approval, the
Catalina Centre has been given a temporary Certificate of
Occupancy pending the resolution of the left turn at the
bridge. The County feels that the engineering work should
be done to determine the costs to make that possible. The
engineering work (approximately $5,400) could be done by an
engineer the County has on retainer for bridge analysis. It
is now up to Catalina to agree to pay the County contrac-
tor to determine if that bridge can be modified and the left
turn made and what the costs would be. Once the costs have
been determined, a comparison can be made as to the costs
for that versus a "U" turn at this intersection. Unless the
Commission changes its mind, the City will continue with a
temporary C.O. and expect that Ocean Properties will move in
that direction.
Recycling
City Manager Cheney stated that in the next year or two
recycling will a key issue for all cities in Palm Beach
County. The Solid Waste Authority is in the process of con-
ducting four small, self-contained pilot projects for
recycling. They are preparing detailed reports on how
things are going for these volunteer projects, what the
costs will be. They will start five more projects in
October and they have asked Boynton Beach to be one of them.
This would be done at no cost to the City. They provide a
truck and a man as well as a basket for recycling materials
(cans, bottles, plastic, and papers). City Manager Cheney
would provide more details as things progress. He stated
that the City would continue if the Commission had no objec-
tions. He would propose the Golfview Harbor area as it is a
self-contained area with a mixed development of families,
some elderly, children and also some quadraplexes and con-
dominiums. Garbage is picked up at the curbs. This is the
type area that the Solid Waste Authority is interested in
for the projects. City Manager Cheney would prepare a reso-
lution for the next meeting so the Commission could decide
if they wanted to proceed with this type project. The City
would provide the mailing list, but the mailing would be
done by the Solid Waste Authority. This would give the City
information it needs for further guidance in this area.
Update on Newspaper Ordinance
Commissioner Olenik requested an update on where the City is
regarding the Newspaper Ordinance.

The City Manager's Report was accepted as presented.
APPOINTMENT OF CITY COMMISSIONER
Mayor Hester stated the Commission had narrowed the list
down to three names at the meeting on August 15th. He
called for nominations for this vacancy and noted that they
did not need seconds.
Commissioner Olenik nominated Arline Weiner to fill the
Commission seat vacated by Mr. Marchese.
Commissioner Mann nominated Walter "Marty" Trauger to fill
the Commission seat vacated by Mr. Marchese.
There were no other nominations and Mayor Hester stated that
his only concern was that Mr. Trauger would be moving out of
the City at a date uncertain. Mayor Hester asked if there
were any other nominations. There being no further nomina-
tions, Commissioner Mann moved to close the nominations.
Mayor Hester called for a vote for Arline Weiner and she
received one vote from Commissioner Olenik. Mayor Hester
called for a vote on Walter "Marty" Trauger and Commissioner
Mann voted for Mr. Trauger. Mayor Hester stated that he
could not vote for Mr. Trauger knowing that he would be
leaving the area. He did not want the City to have to go
through the process of making another nomination. Mayor
Hester voted for Arline Weiner. The vote was 2-1 for Arline
Weiner. Mayor Hester stated that this person would give the
Commission another voice from another part of the City (west
of Congress).

The Tabulation Committee recommended awarding the bid to the
lowest and best bidder Heintzelman's Truck Center, Orlando,

Mr. Annunziato stated that as a condition of approval of the
lift station, Quantum agreed to purchase the 3/4 ton truck.
City Manager Cheney stated that Quantum made that choice.

Building Official.
Commissioner Olenik wished to know where the dirt was being
d~mped. Tom Clark, City Engineer, did not know at this
time, but it would have to be approved by the City at the
time a permit was issued.
K. Approve Congress Avenue Park Design Contract with
Wallace, Roberts and Todd
The lump sum amount of the contract is $89,000.00 with the
compensation to be made on the basis of a multiplier of 2.75
times direct personal expense with payment to be made 30
days from the date of the Architect's invoice.
L. Approval of Bills
List attached. City Manager Cheney added three bills -
$110,392.06 to the Solid Waste Authority, $111,819.65 to the
Regional Sewer Board, and $2,629.20 for the architect, Oscar
Vagi.
Commissioner Olenik asked to know what Bill No. 15 was
City Manager Cheney felt it was for union matters, but
agreed to look that up for Commissioner Olenik.

Mr. Golden stated that this request was for an amended site
plan for a parking lot. The P&Z Board requested that the
Public Works Director clarify his position in regard to the
elimination of the dumpster. This memo had been received
and the Public Works Director states that the dumpster can
be deleted and the site can have can pickup. Commissioner
Olenik questioned this and wanted to know if they were
deviating from what is normally done. Mr. Golden stated
that with smaller projects this is sometimes allowed.
The applicant or a representative was not present at the
City Commission Meeting so that the Commissioners could ask
questions. Mr. Annunziato stated that Mr. Beril Kruger was
planning to be present, but that he had a 4:30 P.M. meeting
and was apparently running late.
Commissioner Olenik moved to table this request until later
in the meeting. Commissioner Mann seconded the motion which
carried 3-0.

A. Consider Capital Professional Center's Request for
Extension of Zoning
Mr. Annunziato stated that he had forwarded a memo which
should be self-explanatory. He noted that the applicant is
working with the County and City to realign Knuth Road.
This has not progressed as quickly as had been expected.
The applicant was asking that the timing of development be
tied to the formal adoption of the Knuth Road alignment by
the County Commission; however, the Planning Department
recommended that a one year extension be granted.
Commissioner Olenik moved to approve a one year extension
of zoning for Capital Professional Center.

Mr. Golden stated that this request was to amend the rear
yard setback from 15' to 8' to allow construction of
screened enclosures with solid roofs. The City Commission
made a finding of No Substantial Change on July 19th, based
on the recommendation that this apply only to those lots
that abut lake areas. There has been further discussion and
the applicant has asked that this be reconsidered. The
Technical Review Board recommended that a finding of No
Substantial Change be found and that the request be allowed
for all lots except those along Boynton Beach Boulevard
where there is a 10' landscape easement (Lots 1-12), those
lots which abut a Public Usage district (Lots 94-105), and
Lots 17 and 18 abutting Knuth Road. The applicant was at
the TRB meeting and was agreeable to these conditions.
Commissioner Olenik moved to find No Substantial Change for
Stonehaven subject to the staff comments. Commissioner Mann
seconded the motion which carried 3-0.

Mr. Annunziato stated that this was a request to expand the
maintenance facility on the golf course. Questions had ari-
sen concerning the proximity of the building to the L.W.D.D.
canal and also relative to the authority the Board of
Directors has to allow such a construction project without
the direct approval of the residents. The Planning
Department recommended that this not be put on. the Consent
Agenda. The P&Z Board unanimously recommended approval sub-
ject to: 1) the applicant's attorney render a legal opinion
to the City advising that the Board of Directors had the
authority to go forth with the improvement, and 2) that if
they are permitted to build, that the canal right-of-way be
reflected on their survey when they come for a building per-
mit. This would show whether or not the building would
encroach into the L.W.D.D. right-of-way.
After further discussion, Commissioner Olenik moved to table
the request until the information from the attorney has been
received. Commissioner Mann seconded the motion which
carried 3-0.
Consider request submitted by J & J Ventures of Florida
(Waters Edge) for a six month extension of site plan
approval.
City Manager Cheney stated that the applicant was present
and could make his position clear for the Commissioners.
Craig Livingston, Architect representing J & J Ventures of
Florida for Waters Edge Marina. He stated that 6 months ago
they had requested an extension for the site plan approval
for the project. They have had problems securing permits
and financing for the project. They were granted the 6
month extension and they were now requesting an additional 6

months' extension. They were having trouble with the per-
mitting process along the north side. They had anticipated
the bridge along Boynton Beach Boulevard proceeding a
little faster. The right-of-way along the north edge of
the property line has caused some delays for J & J Ventures.
The financing institutions are concerned about whether or
not the bridge will go through Boynton Beach Bouleard or
Ocean Avenue. They need clear direction from the Department
of Transportation before they can get financing for the
hotel portion of the project. This affects the entire site
plan. The marina store and the gas lines along the north
edge of the property have been relocated to the south side
of the property and will require some shifting in the site
plan drawings themselves. They anticipate coming in with
revised engineering drawings within 90 days showing this
shift of gas lines and marina store. They requested a 6
month extension to make the modifications and allow City
staff to review the changes.
Commissioner Olenik asked what Mr. Livingston felt the time
frame was for Stage 2 (restaurant and specialty shops) and
Stage 3 (shops along the western edge of the water).
Mr. Livingston stated that due to soil conditions there was
an extensive amount of muck on the site. The sea wall is an
integral structural part of the retail shops and the foun-
dation for it. Portions of the sea wall would be tied back
to the foundation of the retail shops. Essentially the
structural foundation for the retail shops would be done the
same time as the marina. Once the money is expended on the
foundation portion, they would proceed immediately with the
retail shops.
Mr. Livingston found that the financing for the hotel could
be obtained easier if it was found that Boynton Beach
Boulevard would be a through street with a bridge to Ocean
Ridge. It was not a good site for a hotel if the road dead
ended. The hotel and parking garage would be on hold until
there is direction regarding the bridge.
Mayor Hester had no problem with extending this for 6
months. He was hopeful that the project would get going at
some point.
City Manager Cheney stated that he had no objection to the 6
months, but was concerned that the letter said the first
stage would be the gas facility and marine slips, and reno-
vation of the exisitng store. He feared that the gas would
be relocated, the existing marine store would be rebuilt,
and then they would be in a position of nothing else hap-

pening. He did not feel this was consistent with what the
Community Redevelopment Agency plan was for the downtown
area. He suggested that stage one and two be one. He
thought that any committments for construction would reflect
bringing those two stages together. He hoped the developer
would plan the gasoline pumping facilities other than bet-
Ween the restaurant and the waterfront as he tentatively
plans to do. He did not want to be in the restaurant and
have to look down on gasoline pumps. He noted that this
project is a key development for what happens next.
Commissioner Olenik stated that this was his concern as
well. Commissioner Mann stated that he was very disap-
pointed in the project. He did not like to see a 6 month
extension granted and nothing done. He also could not see
why this was placed on the agenda when staff had not yet
reviewed it. He wished to have the benefit of staff com-
ments. He also felt that City Manager Cheney's comments
were true as to what the City felt it was getting. He also
felt that if the hotel is out, he would not be in favor of
letting this project go. He wanted to see a more definite
plan.
City Manager Cheney stated that if this had not been on the
agenda at this time, the approval would be lost on the 17th.
The City Commission must vote on whether or not to extend.
The Commission could table to wait for staff comments. City
Manager Cheney was concerned about the legality of extending
the date without coming to Commission.
Mr. Livingston stated that the site plan they were asking to
be extended had alrady gone through staff.
Tom Miller, 1059 Coral Drive, speaking on behalf of the
Boynton Beach Chamber of Commerce, stated that the Chamber
supports the request by J & J Ventures for the 6 month
extension. The Chamber wants the program as presented and
did not feel that anything would be lost by granting the
extension. He requested that the Commission vote in favor
of granting the extension.
Commissioner Olenik moved to grant the 6 month extension
requested by J & J Ventures of Florida (Waters Edge).
Commissioner Mann took the gavel and Mayor Hester seconded
the motion. Motion carried 2-1 with Commissioner Mann
voting against approval of the extension.

Mr. Golden explained the request and the location of the
proposed McDonald's restaurant. He noted that the Planning
staff recommended denial based upon the following: 1) the
problems with ingress and egress, 2) lack of a reserved
parking area adjacent to the drive-through window, 3) lack
of room to pull out of the drive-through lane on the south
side of the building, 4) pedestrian safety concerns, 5) par-
cel too small to accommodate a drive-through facility, and
6) the City Commission's concern not to allow drive-through
facilities in a manner whereby they are highly visible from
a public thoroughfare. There was also some concern about
the location of the dumpster and the fact that employees
would have to go across a parking area to get to the
dumpster. There was a conflict regarding the location of
the 16" water main. He suggested that a hold harmless
agreement might be needed to protect the City in case of a
break in the water main.
The Public Works Director felt that the dumpster location
was a serious problem.
James R. Brindell, Gunster, Yoakley, Criser and Stewart,
P.A., 777 South Flagler Drive, West Palm Beach, presented
the request. He noted that the restaurant is an upgrade
over other McDonald's of approximately $150,000. He showed
pictures of a similar restaurant located in Boca Raton. He
described the proeject using the elevation drawings he had
with him. He notea that neither McDonald's or Mr. McMurrain

would be interested in having a project which would not make
money for them. To be a good project, it would have to be
convenient for the people who would use it. He felt that
this project would work well. Mr. Brindell explained that
trash would go to the dumpster first thing in the morning
and in the evening. The dumpster would be enclosed behind a
high wall on three sides and metal doors painted to match on
the other side. Landscaping would also be placed along the
wall.
Mr. Brindell explained that the radius of the turnout lane
had been increased to make the turn to the right smoother.
He explained that customers for special orders would wait at
the second window and those getting regular orders would
order at the menu box, pay at window one, pick up their
order at that same window and drive around the one waiting
at the second window for a special order. As far as not
being able to get out of the line once a person had decided
to order, he felt it was not likely that person would want
to leave the line. If he did wish to do so the longest he
would have to wait would be 2~ minutes.
Mr. Annunziato stated that it was approximately 30' from the
building to the dumpster. Mr. Brindell stated that trash is
kept in a storage room and carried to the dumpster twice a
day - morning and evening.
Steve Godfrey, Kimley Horne was present to address the traf-
fic movement. He stated that stacking would be no problem
due to the two window concept. McDonald's has done exten-
sive studies regarding stacking of automobiles. It is felt
that 180' of stacking is appropriate for this type opera-
tion. This site provides 156' One parking space could be
blocked but it was felt that this would happen no more than
three times a day. Mr. Godfrey stated that a vehicle would
have to get in line by choice. It was unlikely he would
want to get out of line, but if he did, he would not have to
wait longer than 2½ minutes to be able to pull around. The
two window concept is working well and there is no need for
additional parking for special order customers. He further
explained that exit to the right was made smoother
by increasing the radius of the turn. He saw no problem
with the entry or exit from the restaurant.
Mr. Brindell stated that they had been mistaken regarding
the utility line. It is 8' away and not 12' as they had
thought.
Mayor Hester pointed out that the Commission was concerned
that the drive-through windows face Congress Avenue. A

request has not been previously granted which would allow
this. He suggested that extra landscaping might improve the
situation. There was further discussion regarding the
landscaping and the height requirement for the hedge. It
was decided the hedge along Congress must be at least 36".
Commissioner Olenik asked if the applicant would be willing
to go 46" or 48". Mr. Brindell stated that he felt the
landscaping was already beautiful as it is. Commissioner
Olenik felt that the building was beautiful, but he had some
reservations about the stacking which takes away from the
beauty of the building.
Mayor Hester felt that 36" hedge was in keeping with the
rest of the hedging along Congress in that area.
As no one wished to speak IN FAVOR OF or AGAINST the
request, THE PUBLIC HEARING WAS CLOSED.
Commissioner Olenik stated that this is a beautiful
building, but he was still concerned as no other building
has a drive-through window on the side facing the main
thoroughfare.
Commissioner Mann had no problem with the landscaping, but
he was concerned about the location of the dumpster.
Mayor Hester stated that he was under the impression that
the dumpster would only be used twice a day.
Mr. Annunziato stated that there had been some discussion
regarding the dumpster and it was felt that this could
possibly be a substantial problem. He was also concerned
about the proximity to the main utility mains. The Utility
Director has stated that lines should not be located within
8' of the building. Mr. Annunziato stated that this had not
been allowed in the past. City Manager Cheney stated that
at least 10' should be required for the water main. City
Attorney Rea was asked about the liability for the City.
City Attorney Rea felt that a hold harmless agreement would
be necessary. The City would be delinquent if it was not
required. There was further requirements regarding setback
requirements. Mr. Brindell stated that he felt they meet
the setback requirements.
Mr. Guidry, Utilities Director, stated that he had a conver-
sation with the surveyor. The surveyor had provided a memo
regarding this but Mr. Guidry had not had a chance to review
the information provided.
Commissioner Mann noted that the applicant was asking the
Commission to approve their request without being subject to

staff comments. Mr. Brindell agreed, and stated that if
they agreed to the staff comments, it would be the same as
not getting approval at all.
Mr. Brindell then went over the points where they had made
changes since the last presentation:

Mr. Annunziato stated that the applicant felt these actions
had addressed the staff comments. Mr. Annunziato stated
that staff had recommended the request be denied. The P&Z
Board had recommended approval.
Commissioner Olenik asked about the lighting. Mr. Brindell
stated that the lighting would be conformed with the Centre.
Commissioner Olenik did not feel comfortable voting on the
issue not knowing which staff comments the applicant was
agreeing with. Mr. Brindell stated that he could not agree
to move the dumpster to the location proposed by the Acting
Public Works Director. He could not agree to the traffic
issues as presented by the Planning Department. Mr.

Brindell felt he had addressed the problem of parking for
special orders with the dual window concept. The pass-by
lane had been addressed although the solution might not be
what Planning would have liked it to be. The storage at the
menu board and behind had been addressed by Mr. Godfrey. He
noted that the City does not actually have a code require-
ment on stacking. Mayor Hester was still confused about
which staff comments they were talking about. Mr. Brindell
stated that they were the comments at the back of the August
10 memorandum. The only one he had a problem with was the
recommendation regarding the dumpster. The other problems
dealing with ingress/egress had been addressed by Mr.
Brindell. He noted that staff was not in agreement with the
solution that Mr. Brindell proposed.
City Manager Cheney asked if the Commission felt that the
problems had been adequately addressed.
Commissioner Olenik moved to approve the request from
McDonald's for a conditional use and site plan approval sub-
ject to the hold harmless agreement relating to the water
main, Congress Avenue hedges to be 45" in height, dumpster
located in the parking lot area as applicant presented, and
the traffic presentation as proposed by the applicant plus
all other staff comments previously agreed to. Commissioner
Mann took the gavel and Mayor Hester seconded the motion.
Motion carried 2-1 with Commissioner Mann against approving
the request.

Discussion regarding N/D Auto
As the applicant had arrived, Commissioner Mann moved to
remove this item from the table. Motion was seconded by
Commissioner Olenik and carried 3-0.
Beril Kruger, representing the applicant, stated that the
owner had worked for a company but had decided to go into
business for himself. He was in the process of purchasing
the old Party Liner Boat Sales building which has been
vacant for some time. The CAB had reviewed the request and
asked that the doors to the building be changed to a gray
color so that they would match the building better. The CAB
was also concerned about the large gravel area on the pro-
perty. The applicant agreed to install a hedge along the
entire length of the curbing which separates the gravel area
from the parking area. It was felt that the hedge would
conceal the gravel area from the street to make the area
look better. The CAB accepted this due to the expense to
sod the entire area. The hedge would be maintained and the
gravel area would be weeded and maintained. The outside of
the building would be finished with stucco.
Commissioner Olenik questioned allowing the use of the gra-
vel and felt that the area should be sodded. Mr. Kruger
stated that the owner had limited resources and felt that to
require him to sod the area might preclude his ability to
purchase the building. There was discussion regarding the
landscape code and whether the gravel area is allowed. Mr.
Annunziato stated that this issue is not addressed in the
code. The code only says that some type of material must
be used to keep down dust and this has been done.
Commissioner Olenik was not happy with the gravel. He also
questioned the dumpster and whether it was necessary. Mr.
Eichorst had stated that he did not have to have a dumpster
but could have c~n pickup. The dumpster would not fit on
the site plan as the truck could not come in and out without
turning around. There was discussion regarding the fact
that the business could be sold to someone who might need
a dumpster and it was feared that trash might be left out in
boxes and be scattered around the area.

City Manager Cheney stated that these small pieces of land
have a problem in providing space for a dumpster. He noted
that the City has been lenient in allowing them curb pickup.
It was the feeling that it was better to allow a business to
operate at the site than have the vacant land just sitting.
He noted that the codes enforcement department would become
involved if trash was allowed to accumulate. Mr. Kruger
stated that the fence would remain for security purposes.
Commissioner Mann moved to approve the request subject to
staff comments. Commissioner Olenik took the gavel and
Mayor Hester seconded the motion which carried 2-1 with
Commissioner Olenik voting against the motion.

ABkNDONMENT - Request for the abandonment
of a ten (10) foot wide alley right-of-way
This item was discussed along with items D and E from the
DEVELOPMENT PLANS section of the agenda.
Mr. Annunziato stated that the Boynton Beach Boulevard
Redevelopment Plan had been approved in concept and Urban
Design Studios had come back with a draft. Staff had made
comments. One of the key elements was to combine properties
into larger tracts for development. Another issue was to

bring the parking to the rear of the building and align uses
of the land so that the buildings front Boynton Beach
Boulevard. The architecture would be Coastal Village. He
felt that the applicant had conformed to the architectural
design. The color of buildings would be brown or gray. It
was also desireable to provide an area amicable to
pedestrian traffic.
The two existing buildings would be demolished and new ones
built. A convenience store was proposed with laundromat and
fuel pump island. The second building would be an automo-
bile repair building. He explained where the two buildings
would be located on the property. The 10' wide service
alley was proposed to be abandonded. This is to be main-
tained as a utility easement.
The applicant also requested a parking lot variance. A 32'
driveway is proposed. An exit onto Boynton Beach Boulevard
is essential to the success of the business. TRB recom-
mended the request for parking lot variance be denied due to
the close proximity to the intersection. The P&Z Board
voted to approve the variance by a vote of 4-1.
Staff felt that the layout of the site and parking area was
not consistent with the Urban Design Plan. They suggested
that the building be turned around and the parking relocated
to the rear. The site plans were found to be consistent
with the code and approval was recommended. P&Z Board voted
4-1 to approve the site plan subject to staff comments.
Robert Bentz, Land Design South, 1280 N. Congress Avenue,
West Palm Beach, was present to represent the applicants.
He felt that this was the first project in the downtown area
which would greatly improve the area and provide impetus to
others to improve their businesses. He pointed out that
these were local business people who had been in the area
and wanted to stay in this area. They were willing to put
their money into the business for the betterment of the City
as well as increasing the tax base. Kevin Clancy and Fred
Violette are the owners of what is presently Fred and Joe's
Fina Station.
Richard Wensing is the architect and had tried to stick with
the Coastal Village theme. He noted that Buds was also
designed by Mr. Wensing. Mr. Bentz had met with Mr.
Annunziato to get some idea of what they must do to conform
with the Urban Design Plan. They had offered the best plan
that they could offer. They had considered turning the
building, etc. but could not find another plan which worked
as well as the one they were presenting. He pointed out

that the curb cut was being reduced to 32' on Boynton Beach
Boulevard. The curb cut onto 3rd Street was also being
reduced. They were improving the traffic circulation on
site. The garage doors would be installed on the building
to the rear of the site. The old buildings were being demo-
lished and new ones built by the same owners.
Richard Wensing, Architect, 1280 N. Congress Avenue, West
Palm Beach, stated that they had met with staff and had
received a copy of the Urban Design Plan draft. He felt the
plan had many good points, but requested that the City not
be too rigid in adhering to every guideline. Lighting would
be low scale type lighting as recommended. They had
included an arcade on two sides of the building. The
building actually has two fronts according to Mr. Wensing.
An arbor had been planned to make the front of the building
appear longer. The curb cut was essential. The applicant
would agree that only a right turn would be permitted. He
hoped to have the first new 1930 building on the block.
Kevin Clancy, 319 East Boynton Beach Boulevard, one of the
owners of the property, stated that they have had their
business for nine years at this location. It has become a
successful business when most of the growth has been away
from the downtown area and to the west. The Urban Design
Plan attempts to upgrade the downtown area and he felt that
this was a good start to get the ball rolling. He and his
partner must either invest in this area or move their busi-
ness. They were willing to risk their resources in the
development of downtown. They had purchased additional pro-
perty, would increase the tax base for the City and at the
same time hoped to increase their profits.
Mr. Bentz asked that the Commission consider what was
existing presently and what was being proposed for the site.
They proposed to install 19 trees and 400 shrubs and ground
cover.
Commissioner Olenik had attended the P&Z Board meeting and
spoke with the developers after the meeting. He was con-
cerned about the deviation from the design plan for Boynton
Beach Boulevard. He was afraid that this would set an
example for others to deviate from the plan. He asked the
applicants to study the situation to see what they could do.
The applicant was concerned that the business might not be
visible. The landscaping was the key. They have attempted
to hide the parking from Boynton Beach Boulevard as well as
the gas pump island. Commissioner Olenik supported the
Design Plan in concept; he did not feel they should be so
firm they could not work with projects as well as maintain

the major part of the intent. He wished to see 45" hedges
in front of the gas pump island.
Mr. Annunziato stated that 36" hedges are all that is
allowed at the intersection.
Mayor Hester felt that some deviation from the plan might be
necessary and worthwhile to get the downtown project
started. He felt that this project might motivate others
to get started.
Abandonment Request
As this was a PUBLIC HEARING, Mayor Hester asked if anyone
wished to speak.
Michael Cain, 632 Las Palmas Park, requested that this
request be approved. These were people who had worked in
the community and paid taxes. They ask for an exception
which should start the process. He felt that something
should be done by people who are in the City and will stay
here. If an exception is made, he felt it should be for
people who are Boynton Beach citizens.
Lucy Gratton, 10437 Prestwick Road, stated that she has a
business on South Federal. She was speaking as a represen-
tative of the business community. The applicants are new
clients of hers and she has found them to be nice people.
She felt that approval of the request would encourage others
to develop in the downtown area. She feared the land could
become an eyesore if the request were not approved. She
felt that small businesses must be given some encouragement
if they want to improve their businesses.
Billie Gaglio stated that she was a customer of the gas sta-
tion. She stated that the City must decide if it wants
honest, reliable, independent family owned businesses to
remain here as well as encourage that type business to come
here. She felt the presentations for a marina on the water
were nice, but noted that they were still waiting for that
to happen. She felt the design was nice and would be an
improvement. She suggested that hedges should not be
required to be so tall that they caused security problems.
Tall hedges also prevent a person from being able to enter
and exit safely. She felt that successful businesses would
not stay in Boynton if they were not encouraged to do so.
She also felt that a place to walk was important, but she
would probably continue to drive her car. Parking in the
rear would make it too inconvenient.

Mike Greenhouse, 618 N.E. 20th Lane, stated that he had been
listening to the City Commissioners for some time now
discussing the Urban Design Plan for Boynton Beach
Boulevard. The City has an idea now as to where it wants to
go. He felt that Bud's had done a beautiful job and they
had provided for parking off the street. They did a good
job and built a boardwalk. He also felt that the Philips 66
station had done a good job with their landscaping. This is
the first project which has requested a variance. He felt
that the City needed to stay with the guidelines they had
approved. He pointed out that redevelopment takes time. He
felt that if a variance is granted, the next project will
also request a variance.
Mayor Hester pointed out that even with the guidelines, the
Commission could decide to make changes. Things do change
from time to time. The applicant is trying to improve his
property.
Mr. Greenhouse stated that he recognized that this is a
great improvement. He felt that money was spent for a
Design Plan concept. He did not want to see a partial
Commission and Acting Mayor making changes to the plan.
Mayor Hester stated that it did not matter whether the Mayor
is elected or not. It is what the Commission wants to do.
They are elected by the people, and they will either approve
the request or not. They have a majority.
Mr. Greenhouse stated that he was not saying they did not
have that right. He was requesting that they stay with the
plans. He wanted to keep this business, but did not want to
deviate from the concept.
Commissioner Olenik felt that the problem with being too
rigid was that if they do not have people who are interested
in conforming with the plan, the Boulevard will remain as it
is now. This request is not to the letter as the Plan calls
for, but the guideline is just that. Some things may not be
feasible.
Mr. Greenhouse was interested in working with the applicant
to get them to conform with the guidelines.

City Manager Cheney introduced Bill Burson Regional Manager
for Southern Bell who was available to answer questions for
the Commissioners.
Commissioner Olenik asked if the City lost the 10% and got a

regarding the matter. He noted that a couple of years ago
the State Legislature passed a bill on the basis that the
municipalities had taken a beating to some extent after
divesture and when the cap of 1% was put on the franchise
fees. With this type of tax setup, the municipalities can
go up to 7% on recurring charges and also on intrastate
tolls. The other type is 10% just on recurring charges just
for the telephone service.

1. Water Service Agreement - Santiago and Leonor Rega

City Manager Cheney stated that this was a building on
Lawrence Road. The applicant must come in with a site plan
for approval. Commissioner Olenik asked about Joe Swan's
memo regarding proof of ownership and questioned if this had
been done. City Manager Cheney did not know, but stated
that this would have to be done before they sign the
agreement.
Commissioner Mann moved to approve the Water Service
Agreement subject to the guarantee that the Rega's are the
owners. Commissioner Olenik seconded the motion which
carried 3-0.
2. Palm Beach County vs City of Boynton Beach - Beal
Condemnation Proceedings
City Attorney Rea stated that Palm Beach County is con-
demning some right-of-way along Hypoluxo on which the City
has an easement with water facilities. They have the right
to condemn the property. They have an agreement with the
City that if anything is required to be moved or modified,
the City will be reimbursed for those expenses. This would
authorize the City to enter into the agreement.

3. Foreclosure - Code Enforcement Case No. 87-214
City Attorney Rea stated that the Code Enforcement Board had
voted to foreclose on Case No. 87-214 which is a lot. The
assessed fine was $5,300. The owner offered to pay over a 4
month schedule a total of just over 80% of the entire pro-
perty. This saves litigation and the City gets paid off.
The only stipulation is that if they miss one of the
payments, the City will foreclose.
Commissioner Mann moved that the settlement be approved.
Motion was seconded by Commissioner Olenik and carried 3-0.

City Manager Cheney stated that the issue was that the indi-
vidual lot owners must sign an agreement to be annexed.
They would not be able to sign up for water service unless
they agree to be annexed into the City. The County is in
agreement with the process.
Commissioner Mann moved to approve the request by Palm Beach
County to provide water service only to Tropical Terrace
Subdivision. Motion was seconded by Commissioner Olenik and
carried 3-0.

Commissioner Olenik moved to appoint Gus Hart as a regular
member of the Cemetery Board with term to expire April 1989.
Motion was seconded by Commissioner Mann and carried 3-0.
B. Contract with Spillis Candela & Partners, Inc. for the
Multipurpose Building
City Manager Cheney stated that the City had been working
with the architects on the issue of hiring an additional
contractor for acoustics, staging, artificial electronic
speaker system, and intercoms. A variety of discussions
have been held with the consultants and the costs have been
way above what the City wants or needs. Proposals have been
up to $60-$70 thousand. They are continuing to work to get
the costs down. The City is recommending that the following
be emphasized: acoustics, limited staging (can always add
more as the space is there), lighting, intercom system,
dimmer system for the stage, and speakers. The City now has
a consultant to do this for $20,000. He felt that this was
needed and the City's architects as well as the Recreation
Director are happy with the contract, and he recommended
approval. He felt that this was a good contract.
Commissioner Olenik asked if they would be working for
Spillis Candela & Partners, Inc. and City Manager Cheney
replied this was correct, but the City will be very much
involved in the project.
Commissioner Mann moved to approve the contract with Spillis
Candela & Partners, Inc. for the contractor to perform the
functions as listed for $20,000. Commissioner Olenik
seconded the motion which carried 3-0.
