65-JJRESOLUTION NO. 65-JJ WHEREAS, the owner of all lands abutting certain dedicated areas located within the City of Boynton Beach, Florida, to-wit: That portion of S. E. 2nd Avenue lying East of the northerly extension of the westerly boundary line of Lot 34 THE LAWNS Sub- division to the City of Boynton Beach, Florida. Plat Book 9. page 69; and That portion of a certain 15 foot alleyway lying adjacent to and south of Lots 34 through 42, inclusive, THE LAWNS Subdivision, Plat Book 9, page 69; has heretofore requested the City Council of the City of Boynton Beach for the enactment of a Resolution vacating and abandoning said dedicated areas; and WHEREAS, said owner ha s , in addition, requested the vacation of that portion of the Plat of the said LAWNS Subdivision described as follows: Lots 34 through 53, inclusive and Lots 76 through 85, inclusive; and WHEREAS, notice of the consideration of said application has heretofore been properly published by the Planning and Zoning Board of the City. and by the City Council; and WHEREAS, public hearings have been held on said application by the Planning and Zoning Board and the City Council at which no objection was voiced by any affected property owner or other interested party; and ! WHEREAS, the abandonment of subject dedicated areas and the] vacation of the above-described portion of subject plat is deemed to be in the t public interest inasmuch as such action will augment the development of subject area, enhance the neighborhood, add valuable improvements upon the City tax roll and eliminate an otherwise low and blighted area within the City; and --l- WHEREAS, no valid reason exists why subject application should not be approved; NOW, THEREFORE, City of Boynton Beach, Florida: be it resolved by the City Council of the (a) That portion of S. E. 2nd Avenue, lying east of the north- erly exlension of the Westerly boundary of Lot 34 THE LAWNS Subdivision, Plat Book 9, page 69, is hereby vacated and abandoned and aubject area is hereby returned to acreage for the purposes of taxation. (b) That portion of a certain 15-foot dedicated alleyway lying adjacent to and South of Lots 34 through 42, inclusive, THE LAWNS Sub- division, Plat Book 9, page 69, is hereby vacated and abandoned and subject area is hereby returned to acreage for purposes of taxation. (c) That portion of THE LAWNS Subdivision, Plat Book 9, pag~ 69, public records of Palm Beach County, Florida, consisting of Lots 34 through 53, inclusive, and Lots 76 through 85, inclusive, is hereby vacated and subject area is hereby returned to acreage for purposes of taxation; subject;however, to a 10-foot easement for public utilities purposes across the North 10 feet of Lots 76 through 85, inclusive, THE LAWNS Subdivision, which easement is hereby specifically established and reserved by the City.
