65-O Resolution No. 65- © WHEREAS, the owners of lands abutting two certain thirty foot dedicated rights-of-way lying within the City limits of the ~ity of Boynton Beach, Florida, more particularly described hereinafter, have heretofore · petitioned the City Council of the City of Boynton Beach, Florida, for the adoption of a resolut ion vacating and abandoning subject rights-of-way; and WHEREAS, it appears that subject roadways have never been laid out, improved or used by the general public; and WHEREAS, after thorough investigation, including a public hearing before the municipal planning board, which has favorably recommended subjec abandonment, there appears to be no valid reason why subject roadways shou not be vacated and abandoned; and WHEREAS, in consideration of subject abandonment, the owners of the abutting property have agreed to dedicate certain needed rights-of-way for the installation and construction of Congress Avenue, NOW THEREFORE, be it resolved by the City Council of the CITY BOYNTON BEACH, FLORIDA: That the thirty foot dedicated roadway lying North of and along Lot 93, and that certain dedicated thirty foot roadway lying north of and along Lot 86 of the Subdivision of Sections 29 and according to the Plat thereof on file in the office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, recorded in Plat Book 7, Page 20 public records of Palm Beach County~ Florida, are hereby vacated, nullified, closed and abandoned, and subject areas are hereby returned to acreage for purposes of taxation.
