63-MMRESOLUTION NO,63 - MM WHEREAS, the City Council of the CITY OF BOYNTON BEACH, FLORIDA, pursuant to the Charier of said City, deems it necessary for the public interest that the public street of said City, more particularly des- cribed hereinafter, be improved by being built, repaired, resurfaced, and/or rebuilt; and WHEREAS the City Council of said City has heretofore, by Resolution, according to law, required the Superintendent of Public Works to prepare an estimated cost of such improvement and to prepare plans and specifications covering the construction of same; and WHEREAS, the said Superintendent of Public Works has completed such requirements, and said plans and specifications are now on file in his office, now therefore, BE IT RESOLVED by the City Council of the CITY OF BOYNTON BEACH, FLORIDA, as follows: 1. That the following public street hereinafter described shall be constructed and/or rebuilt over the public dedicated right-of-way thereof, in accordance with plans and specifications as required by the laws of the CITY OF BOYNTON BEACH, FLORIDA, and now on file in the office of the Superintendent of Public Works, said street being more particularly described as follows: That portion of S. W. 4th Street between Ocean Avenue and S. W. 1st Avenue. Estimated Number of Feet Amount of project to be borne by abutting 258 property owners through special assessment Amount of project to be borne by City 27 TOTAL .... 285 Estimated Cost $ 12'31.. 06 128.j 94 $ 1, 360.,00 2. The City Council will sit for the purpose of hearing objections, any, to the above proposed improvements on the A. D. 1963, at the hour of City Hall, Boynton Beach, 8:00 o'clock p.M., at the Boynton Beach Florida. if 3. Each abutting property owner along the above proposed improve- ment shall be assessed on a front footage basis, charging said owner his proportionate share as divided by the total improvement cost. Any such assessment may be paid within 90 days from the date of confirmation thereof, without interest. Thereafter all assessments shall be payable in equal annual installments with interest at 8 % per annum from the expiration of said 90 days in each of the succeeding years at the time or times in each year at which general municipal taxes are payable, provided that any assess- rnent may be paid at any time before due, together with interest accrued thereon to the date of payment.
