62-IIRESOLUTION NO. 62-II WHEREAS, the CITY OF BOYNTON BEACH, FLORIDA, did, by resolution dated June 19, 1961, vacate and abandon that portion of the Plat of WILMS WAY, Boynton Beach, Florida, described as follows: Lots i through 8 inclusive and Lots 19 through 26 inclusive, together with thai portion of Maryland Avenue (N. E. 12th Avenue), lying east of the southerly extension of the west line of Lot 8 of said subdivision, and return- ed said area to acreage for purposes of taxation; and WHEREAS, certain five foot public utility easements were estab- lished along the north side of said Lots 1 through 8 inclusive and along Lots 19 through 26 inclusive, as per said Plat of WILMS WAY; and WHEREAS, by enactment of the above Resolution the City Council intended only to eliminate the lot designations and abandon the roadway established in the area of the plat above described and did not intend to relinguish the public's interest in and to the above public utilities~ ~,~ ~,~.~' NOW, THEREFORE, be it resolved by the City Council of the CITY OF BOYNTON BEACH, FLORIDA: That in connection with the vacation of the above described portion of the Plat of WILMS WAY, Boynton Beach, Florida, the City Council of the City of Boynton Beach, Florida, reasserts its intention that the above described five foot public utility easements shall remain in full force and effect and that they shall continue to be available for the use of the general public for the purposes intended.
