62-WRESOLUTION No. 62-W WHEREAS, the CITY OF BOYNTON BEACH, is a municipal corporation existing under the laws of the State of Florida, in Palm Be ach County, Florida; and loc ate d WHEREAS, said municipality is the upland owner of a cert tract of land situate anztlying on the westerly shore of Lake Worth, a navigabl body of water located in Palm Beach County, Florida, said tract of land being more particularly described as follows: The East 400 feet of Lot 13 of SAM BROWN JR. 's Subdivision of a part of the South Half of fractional Section 15, Township 45 South, Range 43 East, according to the plat thereof on file in the office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, recorded in Plat Book 1, Page 8, and being the same land oth~r~L~, described upon the Map of W. S. SHEPARD,S PLAT of the Subdivision of Lots 13, 14 and 15 of SAM BROWN JR. 'S Sub- division as aforesaid, as "Homesite" on Plat of W. S. SHEPARD,S Subdivision, being recorded in Plat Book 8, Page 8, public records of Palm Beach County, Florida, together with all riparian rights appurtaining thereto; and WHEREAS, the title to the submerged lands lying under the waters of Lake Worth and abutting the above described property, is vested in the Trustees of the Internal Improvement Fund of the State of Florida, pur- suant to the laws of said State; and WHEREAS, in connection with the widening and reconstructiol of State Road No. 5 (U. S. Highway No. 1) through the City of Boynton Beach, the Florida State Road Department and its contractors are confronted with the problem of disposing of the excavated fill connected with subject project; and WHEREAS, the above described land owned by the City is in close proximity to subject road project, and the fill involved could be feasibly disposed of by extending the above described tract of land into the waters of Lake Worth to the established buIk~ead line, thereby relieving the State Road Department of a serious problem, as well as enhancing the municipal real estate holdings of the City of Boynton Beach, at a considerable savings to the taxpayers of said municipality; Now, therefore, be it resolved by the City Council of the City of Boynton Beach, Florida: Thai a request be made to the Trustees of the Internal Improvement Fund of the State of Florida, for the dedication and conveyance of the submerged lands abutting the property hereinabove described to the established bulkhead line to the City of Boynton Beach for municipal purposes, and thai upon receipt of such conveyance the City proceed with the filling of said land~. Thai the legal description of the submerged land involved is as follows: The submerged lake bottom land of Lake Worth, lying west of the City bulkhead line of the City of Boynton Beach, Florida, September 1956 and East of Lot 13 SAM BROWN JR. 'S S/D in Section 15, Township 45 South, Range 43 East,as recorded in Plat Book l, Page 8, and as shown on W. S. SHEPARD'S Plat of the S/D of Lots 13, 14 and 15 of said SAM BROWN JR. 'S, being recorded in Plat Book 8, Page 8, Palm Beach County, Florida; being specifically described as follows: From the Northwest corner of the SW 1/4 of said Section 15, bear South 89 degrees 13 minutes 55 seconds East along lhe north line of said SW 1/4, a distance of 785.0 feet to the East right-of-way line of the Florida East Coast Railway; thence South 8 degrees 12 00 seconds West a distance of 1622.4 feel to the north line of said lot 13, thence South 89 degrees 22 minutes 00 seconds E along the north line of said Lot 13, a distance of 1117.7 feet to the shore of Lake Worth and the point of beginning; thence continue South 89 degrees 22 minutes 00 seconds E, a distance of 290.6 feet to said City bulkhead line, thence South 3 degrees 21 minutes 41 'secondsWest, along said bulkhead line a distance of 151.97 feet to the south line of "Homesite" of Lot 13, thence North 89 degrees 22 miracles 00 seconds West along said lot line a distance of 283.5 feet to a point south of the point of beginning, thence north along the former "Shoreline!' to the point of beginning.
