62-URESOLUTION NO. 62-U
WHEREAS, the City Council of the CITY OF BOYNTON BEACH
FLORIDA, has in the past received numerous requests for the relinguish-
ment of the municipality,s interest in and to various publicly dedicated
streets, alleys and plats within the City; and
WHEREAS, such requests are deemed to be of a private nature
with resulting benefit to the applicant only; and
WHEREAS, it is felt that the administrative costs involved in
the processing of subject applications should be borne by the applicant
rather than by the general public through the expenditure of general taunt-
cipal funds; and
WHEREAS, it is felt that all such applications should be con-
sidered by the City Planning Board to enable the Council to receive the
recommendations of said Board as to what effect, if any, the granting of
same would have on the general development plan of the City,
NOW, THEREFORE, be it resolved by the City Council of the
CITY OF BOYNTON BEACH, FLORIDA:
1. That henceforth all individuals or corporations applying
to the City Council of the City of Boynton Beach, Florida,
for the vacation of any plat or abandonment of any street,
alley or other publicly dedicated area within the City limits
of the City of Boynton Beach, Florida, shall be required to
pay all administrative or other costs incurred by the City
in connection with the processing of such applications;
that all such applicants shall be required to deposit with
the City Clerk at the time of the filing of their application,
the sum of $50. 00 which shall be applied toward such adminis-
trative costs. Upon completion of the processing of such
application, the City Clerk shall either bill the applicant
for the balance of any costs incurred, or, in the alternative,
refund the balance of the above deposit not expended.
2. That prior to the City Council taking any action on any
such applications referred to hereinabove, same shall be
submitted to the City Planning Board for their consideration
and recommendations relative thereto.

In connection with the City Planning Board's
consideration of such applications, a public hearing
shall be held thereon after due notice thereof has been
published once each week for two consecutive weeks in
a newspaper of general circulation in the City.
