R99-129RESOLUTION R99-/~,~ ~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE A LETTER OF UNDERSTANDING BETWEEN THE CITY OF BOYNTON BEACH AND THE FRATERNAL ORDER OF POLICE - SERGEANT'S UNION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Boynton Beach and the Fraternal Order of ~olice - Sergeant's Union have previously entered into a 1998 - 2000 Collective Bargaining Agreement; and WHEREAS, it has been determined that Exhibit "A" attached to said document contained an incorrect base wage figure for one of the 3argaining unit members; and WHEREAS, the parties are in agreement that Exhibit "A" should 3e amended to correctly reflect the base wage figure in effect at the :late of ratification of said Agreement; and WHEREAS, the parties are in Agreement that bargaining unit "nembers employed by the City for over 20 years should receive 200 ~ours of vacation annually. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The City Commission of the City of Boynton Beach, Florida does hereby authorize and direct the Mayor and City Clerk to ~xecute a Letter of Understanding between the City of Boynton Beach 1 and the Fraternal Order of Police - Sergeant's Union, a copy of which is attached hereto as Exhibit "A". Section 2. This Resolution will become effective immediately upon passage. PASSED AND ADOPTED this c~/day of September, 1999. ~f~ce Mayor Mayor Pro Tern Commissioner LETTER OF UNDERSTANDING THIS LETTER OF UNDERSTANDING is entered into between the City of Boynton Beach-a~d the Fraternal Order of Police, Sergeant's Union subject to ratification by the City Commission and the members of the bargaining unit. WHEREAS, pursuant to the 1998 - 2000 Collective Bargaining Agreement entered into by the City of Boynton Beach and the Police Sergeant's Fraternal Order of Police, Article 12, Rate of Pay, Section 2, states: SEE CHART ATTACHED HERETO AS APPENDIX "A" FOR YEAR ONE (1) OF THE AGREEMENT. and WHEREAS, the parties desire to amend Appendix "A", to correctly reflect the base wage for Sgt. Eric Jensen, which was .in effect on the date of ratification of said Agreement; and WHEREAS, Article 19, Vacation should be amended to reflect th'at for ever 20 years of service the bargaining unit member shall earn 200 hours of vacation leave per year; NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: li. Article 12 Rate of Pay Appendix "A" is hereby amended to correctly reflect the base wage for Sgt. Eric Jensen, which was in effect on the date of ratification of said Agreement. Article 19, Vacation is hereby amended to reflect that for over 20 years of service the ~argaining unit member shall earn 200 hours of vacation leave per year; This Agreement shall not be effective unless ratified by the members of the bargaining unit and the City Commission of the City of Boynton Beach. Rose Marie Lamanna via thx: 561-742~6054 '['he Fraternal Order of Police hereby agrees to allow the City of Boynton Beach to use the Exhibit which was ratified at the 8/17 City Commission meeting to proceed with disbursement of the checks to the bargaining unit according to the Exhibit which was ratified at that meeting SinCe the date ol'ratification, a discrepancy was noted in Sgt.
