62-AAARESOLUTION NO. 62- AAA WHEREAS, the City Council, at City of BOYNTON BEACH, FLORIDA, deems it essential that rules of conduct be established for all officers and employees of the municipality who are not members of the municipal classified service. (~cluding members of the City Council. ) NOW, THEREFORE, be it Resolved by the City Council of the CITY OF BOYNTON, BEACH, FLORIDA: 1. That the following enumerated acts shall be considered caus~ for removal from the municipal service for all officers and employees of the CITY OF BOYNTON BEACH, FLORIDA, who are not members of the classified service, although removal may be made for causes other than those enumerated: That such perso~el: (a) Has been convicted for a criminal offense or misdemeanor involving moral turpitude; or has been guilty of an immoral or criminal act. (b) Has wilfully violated any of the provisions of the City Charter or of these rules; or has attempted to, or does commit, any act or acts intended to nulify or mitigate any of the provisions thereof. (c) Has violated any lawful and reasonable order or regulation, or failed to obey any lawful or reasonable direction made and given him by a superior where such violations or failure to obey has, or might have, resulted in loss or injury to the City of Boynton Beach, the public, or to persons or property in the custody of the City. (d) Has been guilty of conduct unbecoming an employee of the City of Bo~ Beach. (e) Has been on duty while under the influence of intoxicating beverages. (f) Has contracted some mental or physical ailment or defect which incapacitates him for usefulness in the City service. (g) Has been guilty of acts which amount to insubordination or of disgraceful conduct, whether such acts were committed while on or off duty. (h) Has been wantonly offensive in his conduct or language towards the public, towards city officers, or towards other employees. (i) Has been incompetent, negligent, or inefficient to such an extent that his merit ratings fall below a minimum standard prescribed in accordance with these rules. ~) Is careless or negligent of the property Df the City of Boynton Beach; or who steals, misplaces, or misuses equipment, materials, property, or other things of value belonging to the City. (k) Has failed to pay, or make reasonable provisions for future payment of, his just debts, thereby causing annoyance to his superior and discredit to the City Service. (1) Has used, or threatened to use, or attempted to use, political influence in securing promotion, leave of absence, transfer, classification change, pay change, or character of work. (rn) Has taken any fee, gift, or other valuable thing in the course of his work or in connection therewith for his personal use from any firm or cor oration when such fee~ gif~., .or other valuable thing is accepted with the understanding that the donor shall, or actually does, receive favors or receive service not customarily accorded to the general public. (n) Has intentionally falsified time records or failed to report absences from duty to his superior officer in accordance with the preseribed ~ (0) Has been absent from duty without proper leave of absence from his department head, or otherwise contrary to prescribed procedures; or has failed to report after such leave of absence has expired, or within a reason- able length of time after such leave of absence has been revoked. (p) Has been habitually tardy or absent from duty without sufficient cause, thus hindering the regular operation of the department or division. (q) Has participated in any local municipal political campaign in any way other than by exercising his rights as a citizen to express privately an o or cast a ballot. -2- (r) Is willfully antagonistic in his attitude toward his superiors or fellow employees, continually criticizing orders or rules issued and policies adopted by his superiors, or conducts himself so as to interfere with the proper coordination of the employees of the CITY OF BOYNTON BEACH to the detriment of efficient public service. 1962.
