09-18-61bRESOLUTION BEACH, FLORIDA, has determined that it is essential and to the best interest of the citizens of said city that the property hereinafter described be purchased as an additional municipal recreational facility site; and WHEREAS, the owners of said property have heretofore offered to sell same to the city for a total purchase price of $18,500. 00; NOW. THEREFORE, be it resolved by the City Council of the CITY OF BOYNTON BEACH. FLORIDA: 1. That the City proceed with the purchase of the following described property as an essential additional recrea- tional facility site: The East 400 feet of Lot 13 SAM BROWN JR'S subdivision of a part of the South Half of fractional Section 15, Township 45 South, Range 43 East, according to the plat thereof on file in the office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, recorded in Plat Book l, Page 8, and being the same land and other described upon the Map of W. S. SHEPARD'S PLAT of the subdivision of Lots 13, 14 and 15 SAM BROWN JR'S SUBDIVISION as aforesaid, as "Homesite" on Plat of W. S. SHEPARD'S SUBDIVISION, being recorded in Plat Book 8, Page 8 public records of Palm Beach County, Florida, in accordance with the following terms and conditions: (a). $5,365.00 cash at the time of closing; (b). The balance of $13,135.00 on or before five years from the date of closing, together with interest on the unpaid balance at the rate of 5 1/2%per annum with said deferred balance and interest thereon to be paid solely from revenues derived from utility service and tobacco excise taxes and in no wise obligating revenues derived from ad valorem taxes or other property be- longing to the city; that said deferred balance shall, in addition, be secured by a purchase money mortgage against the above described property. 2. That if the above and foregoing terms are acceptable to the owners of subject property, the mayor and the city clerk are hereby authorized to execute the promissory note, purchase money mortgage, and other necessary instruments connected with said transaction, and to proceed with the closing thereof.
