07-17-61c RESOLUTION WHEREAS, the City Council of the CITY OF BOYNTON BEACH, FLORIDA, deems it essential for the protection and safety of the inhabitants of said city that automatic train-approach warning signals with bells and short arm gates be installed at the intersections of Ocean Avenue and Northwest Second Avenue and the Seaboard Air Line Railroad's right-of-way; and WHEREAS, the estimated cost of constructing said installa- tions is $39,981. 00; and WHEREAS, the said Seaboard Air Line Railroad has agreed to bear the total costs for the initial installation of the above safety devices in return for the city's agreement to reimbul'se the company in an amount equal to fifty (50) per cent of the actual cost incident to such installation, with payments to be made annually in equal amounts over a five year period, without interest, with the first payment being due one year from the date of completion of said installations, NOW, THEREFORE, be it RESOLVED by the City Council of the CITY OF BOYNTON BEACH, FLORIDA, that the Mayor and City Clerk are hereby authorized to enter into a written agreement with the Seaboard Air Line Railroad Company carrying into effect the intent of this Resolution.
