04-03-61a RESOLUTION WHEREAS, the CITY OF BOYNTON BEACH has heretofore quit claimed its interest in and to a l~ortion of a certain street right-of-way, more particularly described hereinafter, located within the Plat of HARBOR ESTATES, Boynton Beach, Florida, by instrument recorded in Deed Book 953, Page 563 public records of Palm Beach County, Florida, to HENRY M. ET UX, as the original owners and subdividers of said subdivisio: and WHEREAS, the City has now been requested to abandon its interest in and to subject property by an appropriate Resolution to more adequately follow the proper procedure under law in matters of this nature; and WHEREAS, there appears to be no reason why that portion of the dedicated street in question should not be vacated; NOW, THEREFORE, BE IT RESOLVED by the City Council of the CITY OF BOYNTON BEACH, FLORIDA, as follows: That the following described portion of EAST DRIVE, a publicly dedicated street right-of-way located within the Plat of HARBOR ESTATES, in the City of Boynton Beach, Florida, is hereby vacated, nullifie closed and abandoned and subject property is hereby returned to acreage for purposes of taxation: PROPERTY DESCRIPTION: BEGINNING at the northwest corner of Lot 48 HARBOR ESTATES, according to the plat thereof on file in the office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, recorded in Plat Book 21, Page 98, thence run southerly along the westerly boundary of said Lot 48 and Lot 13 of said subdivision, 35.17 feet to a point; thence run westerly at an angle of 90° to the preceding course 21 feet more or less to the ~vesterly boundary of East Drive, said point being the southeast corner of Lot 47 of said subdivision; thence run northerly along the westerly boundary of East Drive 35.17 feet more or less to a point in the north boundary of said subdivision; thence run easterly along the north boundary of said subdivision a distance of 21 feet more or less to the point of beginning.
