R03-021RESOLUTION NO. R03- O ~ ~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING BY A SUPER MAJORITY VOTE THE PURCHASE OF FOUR PARCELS OF LAND FROM NICHOLAS J. ROSTANZO TO CONSTRUCT RETENTION PONDS ASSOCIATED WITH THE NE 7TH TO l0TH AVENUE STORMWATER IMPROVEMENT PROJECT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Utilities Department is attempting to acquire a total of 17 different parcels of land from 12 private property owners for the purpose of building stormwater retention areas in the N.E. 7th to 10th Avenues neighborhood; and WHEREAS, a Negotiations Summary has been prepared by the City Real Estate Administrator outlining the component monetary steps to the purchase of the four subject parcels, and an appraisal has been prepared for the subject parcels; and WHEREAS, the purchase price is 20% over the appraisal value, a super majority of the City Commission (4 out of 5 commissioners) is required to approve this purchase; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF i THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this resolution. Section 2. The City Commission does hereby authorize the purchase of 4 parcels of land from Nicholas J. Rostanzo in order to construct a series of retention ponds associated with the N.E. 7th to 10th Avenue Stormwater Improvement project in the amount of $216,000. Section 3. The City Administration is authorized to execute documents necessary to effectuate the intent of this Resolution. Section 4. That this Resolution shall become effective immediately upon passage.
