T~ Q~ALIFI£D ~LECTOR~ OF ~$AID CITY FOR THE PURPOS~ OF'RATiFYING OR REJECTI2G A THiRTY-_~EAR NATURAL GAS FRANCHISE TO FLORIDA PUBLIC UTILITIES COMPANY, AND AUTHORIZING THE MA~f0R OF SAID CITY TO GIVE NOTICE OF SAiD ELECTION, BY PROCLA~ATION. WHEREAS, on the 20th day of April 19~9, Ordinance No. of the City of Boynton Beach, Florida, was duly passed and adopt- ed in regular session assembled, and said Ordinance provides that it shall take effect upon its ratification at a referendum elec- tion to be called and held in accordance with the provision of the Charter of the City of Boynton Beach for holding bond elec- tion; now therefore BE IT RESOLVED by the City Council of the City of Boynton Beach, Palm Beach County, Florida, as follows: That the Mayor of the City of Boynton Beach shall give notice, by proclmmation, of a special election to be held at the Shuffle Board Pavilion, Corner of Ocean Avenue mhd $. E. 4th Street, in the City of Boynton Beach, Florida, on the 26th day of May 19~9, between the hours of 7:00 A.M. and 7:00 P.M., for the purpose of ratifying or rejecting this contemplated franchise Ordinance No. 320; that his said notice and proclmmation shall be published once each week for two consecutive weeks immediate- ly preceding the said election in the Boynton Beach News, a news- paper p~blished and printed in the City of Boynton Beach, County of Palm Beach, State of Florida, and having a general circulation in the City of Boynton Beach, Florida. P age 1 That the forth of ballot to be used at said election shall be substantially as follows, to-wit: OFFICIAL BALLOT SPECIAL REFERENDUM ELECTION CITY OF BOYNTON BEACH, FLORIDA 26TH DAY OF MAY 1959 Shall there be granted to the Florida Public Utilities Company a thirty-year franchise per- mitting said company to use the city streets for the installation and maintenance of a natural gas system as provided by Ordinance #320 passed and adopted by the City Council on the 20th day of April 1959 - entitled: ORDINANCE NO. 320 An Ordinance of the City Council of the City of Boynton Beach, in Palm Beach County, Florida, granting to Florida Public Utilities Company, its successors and assigns, a gas franchise and impos- ing provisions and conditions relating thereto. FOR THE ORDINANCE AGAINST THE ORDINANCE That at said election only those electors who are qualified electors in the said City of Boynton Beach, Florida, at the date of said election as now provided by law shall be permitted to vote in said election. If a majority of the voters in said elec- tion vote for the adoption of said ordinance, then such ordinance shall become effective or otherwise it shall not. There shall be one polling place, which place shall be the Shuffle Board Pavilion, at the Corner of Ocean Avenue and S. E. 4th Street, in the City of Boynton Beach, Florida.
