O90-50ORDINANCE NO. 90-,~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REPEALING ARTICLE I. CHAPTER 13. SECTION 13-8. HOW TAX CONSTRUED AS TO SPECIFIED PROFESSIONS. OF THE CODE OF ORDINANCES; PROVIDING THAT EACH AND EVERY OTHER SECTION OF ARTICLE I. CHAPTER 13 NOT SPECIFICALLY HEREIN REFERRED TO SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING FOR A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AUTHORITY TO CODIFY; AND AN EFFECTIVE DATE. WHEREAS, it is the desire of the City Commission of the lity of Boynton Beach to amend Article I. Chapter 13, Section 13-8 of the Code of Ordinances of said City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. Article I. Chapter 13. Chapter 13. not specifically herein referred to shall remain in full force and effect as previously enacted. Section 3. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this ordinance. WHEREAS, on September 18, 1990, the City Commission of the City of Boynton Beach, adopted Ordinance Number 90-37 regarding fire safety inspections; and WHEREAS, in the implementation process it was determined to place a cap on fees if certain fire safety protection devices had been installed; and WHEREAS, it is necessary to amend Ordinance No. 90-37. NOW THEREFORE, BE IT ORDAINED BY THE CITY CO}~4ISSlON OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. There is hereby established a fee structure for annual fire and safety inspection activity conducted by the Fire Department for commercial enterprises. The owner of each commercial enterprise or business operating from a business location within the City of Boynton Beach shall be charged an annual fire and safety inspection fee as set forth on Exhibit "A", which Exhibit has been amended by adding the words and~ figures in underlined type.
