O90-45 ORDINANCE NO. 90- Z AN ORDINANCE OF THE CITY COM14ISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE 89-37, CHAPTER 16 PARKS AND RECREATION, ARTICLE II CITY PARKS & BEACHES, SECTION 16-82 RAISING THE RESIDENT TEMPORARY PARKING PERMIT FEES OF RESIDENTS FROM $7.00 TO $10.00; RAISING THE FEE FOR REPLACEMENT DECALS FROM $5.00 TO $7.00; RAISING THE FEE FROM $5.00 TO $7.00 FOR GUESTS STAYING WITH RESIDENTS; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING AUTHORITY TO CODIFY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City is authorized to collect charges or fees in an amount necessary for the efficient conduct of municipal government and to offset regulatory activity; and WHEREAS, The City currently collects fees for beach decals, and the City wishes to increase its beach decal charges; and NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 16, Parks and Recreation, Article II, City Parks & Beaches, Section 16-82 Policy No. 1 is amended by adding the words and figures in underlined type and deleting the words and figures in struck-through type, as follows: Section 16-82. Rules, regulations controlling parking of vehicles at municipal beach property located within the Town of Ocean Ridge. The City Manager is hereby directed to implement subject procedures at the earliest possible date. (Said regulations are set out below.) POLICY NO. 1 PARKING PERMITS Parking permits will be issued on an annual basis (October 1 through September 30) with issuance beginning September 1 each year to residents (see "definitions") of the City of Boynton Beach, for a charge of Seven-Be~ars ~$~v88~ Ten and no/100 ($10.00) Dollars for the first decal issued to a resident vehicle, of appropriate application required to establish proof upon satisfactory completing forms. Applicants will be of residence in the City of Boynton Beach ( see "definitions" ) and to present his official state motor vehicle tag registration certificate. When application is made for more than one permit, each separate individual vehicle registration must be presented. Residents who are not property owners must establish residency by some suitable means, such as voter ' s registration, executed lease, utility bills or other legal lidocument. Permanent beach parking permit decals shall be issued i;{{at a charge of seven-do~ars-f$~veef Ten ($10.00) Dollars iiionly to residents owning, leasing, renting, occupying or iliresld~ng in real estate in the city for at least six (6) :!imonths of each year. Temporary parking permits shall be i:issued to residents owning, leasing, renting, occupying or ii,!residing in the city for less than six (6) months at a ii!charge of seven-do~ars-~$~vO8~ Ten ($10.00) Dollars. Proof ilof six (6) months' residency, ii!shall be established by lease !!iwrJ. tten lessor verification. Lost or mutilated if property is not owned, agreements, rent receipts or parking permits. In the event that the vehicle to which the permanent decal was issued has been sold or otherwise changed ownership and/or in the event a properly issued parking decal is mutilated and can be identified, such decal will be replaced for a charge of F~e Seven ($7.00) Dollars provided the holder can return an identifiable portion of the mutilated parking decal to the city. In the event the holder of a lost or ~mutilated parking permitI cannot provide an identifiable portion or part of such parking decal, the charge for a ireplacement decal will be the sum of seven-do~ars-f$~v88~ Ten ($10.00) Dollars. Lost decals will not be replaced until after a thirty-day waiting period from the date the decal is reported lost. Definitions: Resident: Anyone owning real estate and/or leasing, renting or occupying real estate or living accommodations within the City of Boynton Beach for a time period of at least six (6) consecutive months each calendar year, as well as members of their immediate family residing with them. Visitor: Paying guests at within Boynton Beach and guests with residents thereof. City employees: All nonclassified, and retired hotels and motels located staying in Boynton Beach city employees, classified and regardless of residency shall be eligible to receive one parking permit. Proof of employment shall be established through the personnel department of the city. Persons who terminate (not retired) their employment with the city and who are not city residents shall be required to scrape off their stickers and return remains to the issuing office. Section 2. That Chapter 16, Parks and Recreation, Article II, City Parks & Beaches, Section 16-82, the first two paragraphs of Policy No. 3 is amended by adding the words and figures in underlined type and deleting the words and figures in struck-through type, as follows: POLICY NO. 3. TEMPORARY PARKING PERMITS Temporary parking permits will be issued by the city in accordance with Policy Numbers 1 and 2.
