Minutes 08-01-94MINUTES OF THE CITY COMMISSION WORKSHOP MEETING HELD IN COMMISSION CHAMBERS, CITY HALL, BOYNTON BEACH, FLORIDA, ON MONDAY, AUGUST 1, 1994, AT 6:00 P. M. PRESENT Edward Harmening, Mayor Lynne Matson, Vice Mayor. Matthew Bradley, Mayor Pro Tem Jose Aguila, Commissioner David Katz, Commissioner Carrie Parker, City Manager James Cherof, City Attorney Sue Kruse, City Clerk CALL TO ORDER Mayor Harmening called the meeting to order at 6:00 P. M. REVIEW OF CHAPTER 2,5, ALARM SYSTEMS City Manager Parker distributed Fire Prevention Memorandum No. 94-260 and Fire Department Memorandum No. 94-158, which contain Fire Chief Floyd Jordan's suggestions for amending Chapter 2.5. The Commission agreed with the Code Enforcement Unit Supervisor's suggestion to delete the $50.00 penalty from Section 2.5-3 since all violations of this provi- sion are processed through the Code Enforcement Board. Commissioner Aguila won- dered if the penalty should also be deleted from Section 2.5-8(c). However, through discussions with Steve Campbell of the Fire Department, it was decided that this should not be a Code Enforcement issue. Commissioner Aguila referred to the following comment contained in Fire Prevention Memorandum No. 94-260: Sec. 2.5-11 - Failure to notify the communications division a minimum of one (1) hour prior to the alarm system test shall result in a fine of $25.00. He said 95 percent of. the people who have alarms do not know that this ordinance exists. Fewer of those people know that they need to contact communications or even how to contact communications. He was not in favor of charging someone $25 because they do not know the Code. Mayor Harmening agreed with him. As recommended in Fire Prevention Memorandum No. 94-260, the City Commission agreed to include the Fire Chief or his designees in Sec. 2.5-16. At this point in the meeting, Mayor Pro Tem Bradley arrived. Mr. Campbell referred to Sec. 2.512 which states that all new fire alarm systems shall be exempt from the application of this section for the first three (3) months from the date of initial installation. He explained that the Fire Department had responded to thirty false alarms at the Spring House due to ongoing construction. - 1- MINUTES - CITY COMMISSION WORKSHOP MEETIHG BOYNTON BEACH, FLORIDA AUGUST 1, 1994 Mayor Harmening suggested they be told to notify the Fire Department when they are working and that the Fire Department should ignore the alarm. He stated that this is customary operation. Mr. Campbell advised that they have been told to cover the dust and smoke detectors with plastic. Mayor Harmening stated that the owners, operators and/or contractors are not getting the message and that they need to be told that they will start to be charged $100 for false alarms. REVIEW OF CHAPTER 3, ALCOHOLIC BEVERAGES Mayor Harmening referred to Planning and Zoning Department Memorandum No. 94-239, in which Tambri Heyden comments that there has been confusion in the past regarding which department signs off license applications. It seemed to Mayor Harmening that the Building Department normally handles this. With regard to meeting the zoning, Mayor Harmening felt that is covered. Mayor Harmening did not know if it is necessary, but he wondered if the Police Department should perform an investigation to see whether or not a person has a criminal (felonious) record before a license is issued. City Attorney Cherof advised that the State does this type of investigation. Mayor Harmening said they do, but they want a certificate from the City stating that we have no objections and it meets all of our criteria. City Attorney Cherof pointed out that the City's criteria deals with zoning and hours of operation. SET MEETING DATE FOR SEPTEMBER Since September 5, 1994 is a holiday, the next meeting was scheduled for Monday, September 12, 1994. The City Manager is going to revisit the schedule to encompass more material at each meeting. The Commission will start to review the Land Development Regulations at the next meeting. ADJOURNMENT There being no further business to come before the City Commission, the meeting properly adjourned at 6:25 P. M.
