Minutes 03-29-94MINUTES OF THE SPECIAL CITY COMHISSIOH MEETING HELD IN COMMISSION CHANBERS, CITY HALL, BOYNTON BEACH, FLORIDA, ON TUESDAY, MARCH 29, 1994, AT 5:15 P, M, PRESENT Edward Harmening, Mayor Matt Bradley, Mayor Pro Tem Jose Aguila, Commissioner David Katz, Commissioner J. Scott Miller, City Manager Sue Kruse, City Clerk CALL TO ORDER Mayor Harmening called the meeting to order at 5:19 P. M. to consider supporting the Economic Development Administration (EDA) grant application by agreeing to lease real property for proposed parking garages from First Financial Plaza Condominium Association, Inc. and J & J Ventures of Florida reference infrastructure grant. Ann Ford, Downtown District Coordinator, displayed a diagram depicting the two parking structures, which would be five stories and approximately forty feet high. She advised that the First Financial Plaza Condominium Association, Inc. and J & J Ventures of Florida are willing to lease these structures for $1.00 per year for fifty years, with a twenty-five year option to renew under the same terms, if the EDA grant is funded. In turn, the City would have control and, therefore, be responsible for liability insurance if someone was hurt on the property and to indemnify the property owners beneath the structure if they were sued as well. For the record, Commissioner Aguila made it clear that the City will have complete control over the nonliability issues and what it does with those struc- tures as well. Ms. Ford advised that the City Attorney should be directed to prepare the leaSe in that fashion. Commissioner Katz asked why'the City is including the land owners as additional insureds under the liability coverage. Mayor Harmening advised him that this is because in the event something happens, they can be sued at the same time that the City is sued. Commissioner Aguila added that the City asks people to make the City an additional insured when they do work for the City for the same reason. Norton Commissioner Eatz moved to approve Proposed Resolution No. R94-52. Aguila seconded the motion, which carried 4-0.
