O90-40ORD~NANC~ NO. ~-~ AN ORDINANCE OF THE CITY CO~ISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE NO. 89-52 OF THE CITY OF BOYNTON BEACH, FLORIDA, BY AMENDING CHAPTER 5, BUILDING CODE SECTION 5-3, THE MODEL COUNTYWIDE ADMINISTRATIVE CODE SECTION 103.7 FEES, TO PROVIDE FOR AN INCREASE IN THE FEE AS LISTED AND THE ADDITION OF THE NEW SUBSECTIONS 103.7.4.7 EMERGENCY OR MISCELLANEOUS INSPECTION FEE; 103.7.4.8 REFUNDS AND 103.8.10.1 ADMINISTRATIVE FEE FOR SPECIAL INSPECTORS; PROVIDING A CONFLICTS CLAUSE; A SEVERABILITY CLAUSE; AUTHORITY TO CODIFY; AND AN EFFECTIVE DATE. WHEREAS, the City of Boynton Beach Commission, on January 2, 1990, duly adopted Ordinance No.89-52, established the Countywide Amendments to the 1988 code with the Model Countywide Administrative Code, with others as listed in said ordinance to be the Building Code of the City of Boynton Beach; and WHEREAS, this code set certain fees to be charged to cover the cost to administer the department's service to the users. WHEREAS, the City is empowered to increase iladministrative charges and there currently exists a need to do so; NOW THEREFORE, be it ordained by the City Commission of the City of Boynton Beach, Florida: Section 1: Section 103.7 of the Model Administrative Code referenced in Section 5-3 of Chapter 5 of the Codified Ordinances of the City of Boynton Beach, Florida is hereby amended to read as follows: 103.7.2 Work Commencing Before Permit Issuance. If any person commences any work on a building, structure, plumbing, mechanical or gas systems before obtaining the necessary permit, he shall be subject to a penalty of deub~e four times (4X) the permit fees. 103.7.4.3 Major working drawing review fee $150.00 deducted from permit fee if permit is within 8 months from submission date. $~88~80 obtained 103.7.4.4 Major change fee after plans are approved and permit issued $~58 $300.00 fee but in no case more than the original permit fee, plus additional cost if value increases. (Major chanqes are defined as substantial substitutions or redesigns.) Section 2: Section 103 of the Model Administrative Code is amended to add the following new subsections. 103.7.4.6 Minor plans rechecking fee (revisions to permitted plans) - minimum fee per fee schedule plus actual cost of value increase. 103.7.4.7 Emerqency Or Miscellaneous Inspection Fee 130.00 (This inspection includes but is not limited to code compliance, structure relocation, condemnation, occupational license, fire damage assessment, and other miscellaneous inspections which cost is not captured by the issuance and collection of permit fees.) 103.7.4.8 Refunds may be granted in accordance with l.this section or policies and procedures set by the Building I~iOfficial. Refunds will be granted only on permit fees in !!~excess of $200.00. For permit fees in excess of $200.00, 1!1!50% of the fee is refundable on valid per, its. No refund ishall be granted on permits for which work has commenced. iRe-validation of permits are subject to all other appropriate city or county fees which may have come into effect, and all permits which are not re-validated within the given time period set by code will be voided. 103.8.10.1 Special Inspector Administrative Fees - An administrative fee of 5% of the contract fees paid to the special inspectors shall be charged for service to the account. Section 3: Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Should any section or portion of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 5: This Ordinance shall become immediately upon passage.
