AN ORI~INANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
ESTABLISHING ANNUAL FEES FOR FIRE SAFETY
INSPECTIONS FOR COMMERCIAL ACTIVITY;
PROVIDING FOR A CONFLICTS CLAUSE;
PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AUTHORITY TO CODIFY; AND AN
EFFECTIVE DATE.
WHEREAS, Section 166.201 Florida Statutes authorizes
the collection of charges or fees in an amount necessary for
the efficient conduct of municipal government; and
WHEREAS, the City Fire Department currently inspects
commercial establishments on an annual basis at no charge;
and
WHEREAS, the City Administration has conducted a study
to establish a fair and reasonable charge for fire and
safety inspections for commercial enterprises.
NOW TR~(EFORE, BE IT ORDAINED BY THE CITY COmmISSION OF
THE CITY OF BOYNTON BEACH,
Section 1. There

conducted by the Fire Department for commercial enterprises.
The owner of each commercial enterprise or business
operating from a business location within the City of
Boynton Beach shall be charged an annual fire and safety
inspection fee as set forth on Exhibit "A".
Section 2. The fees established herein shall accrue
annually on the first day of October of each year and shall
not be prorated.
Section 3. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 4. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
this ordinance.
Section 5. Authority is hereby granted to codify said
ordinance.
Section 6. This ordinance shall become effective
immediately upon passage.
