GARBAGE, TRASH AND OFFENSIVE CONDITIONS, ARTICLE II, SECTION 10.29 OF THE CODE OF ORDINANCES OF THE CITY OF BOYNTON BEACH, TO ESTABLISH RATES AND CHARGEs F . SERVICEs; PROVID~'~ .... OR CITY OTHER PROVISiON F ' 'H?33- AND EVERY nafT~R 10 NOT SPECIFICALLY AMENDED HEREIN SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING FOR AN IMPLEMENTATION DATE; PROVIDING FOR A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AUTHORITY TO CODIFY; AND AN EFFECTIVE DATE. WHEREAS, due to increasing costs of disposal and Operations, it is necessary to amend the existing rates and charges to solid waste services; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION DF THE CITY OF BOYNToN BEACH, FLORIDA: Section 1__~. That Chapter 10. Garbage, Trash and Dffensive Conditions, Article II, Section 10-29 is deleted in its entirety, and a new section 10-29 is created, as follows: Sec. The following rates and charges shall be 2ollection Service provided by the city. A. Commercial Containerized, excluding Units: 10-29. Rates and charges for city Service. for refuse Residential Monthly commercial charges shall consist of a total of the following six items: (a) Container rental charge - A monthly charge to cover the actual cost of the container (amortized Over calculated and Commission. The charge will be as five (5) years) as annually certified by the City certified container rental follows: 2 cu yd Container - $3.95 per month 3 cu yd container - 4.85 per month 4 cu yd COntainer - 5.43 per month (2) (3) 6 cu yd container - 7.37 per month 8 cu yd container - $8.25 per month (b) Disposal charge - a fixed charge per cubic yard as charged by the Palm Beach County Solid Waste Authority for disposal of waste at the landfill as annually calculated and certified by the City Commission. The amount certified as the disposal charge for 1990/91 is Eighty-Three ($83.00) Dollars per ton. (c) Operating charge A fixed charge per cubic (d) yard to cover the operating cost less disposal cost. The operating charge for 90/91 will be Three Dollars and twenty-five cents ($3.25) per cubic yard per pick-up per month. Capital pick up vehicles by the equipment charge - A fixed charge per to cover total capital costs for as annually calculated and certified City Commission. The certified capital equipment charge for 1990/91 will be Seven dollars and ninety-five cents ($7.95) per month per pick up. (e) Overhead charge - The monthly overhead charge will be a fixed charge of Fourteen dollars and forty-three cents ($14.43) per month per pick up. (f) Landfill closure charge - A fixed charge of eighty-seven cents ($.87) per cubic yard per pick up will be charged to meet the cost of closing the City's landfill. Partial monthly service will be charged on a prorated basis, as appropriate, based on the guidelines in (1) above. Removal charges for mechanically compressed refuse in a dumpster shall be computed at three-to-one (3:1) (containers furnished by owners). (4) Two (2) or more places of business establishments using a single container per pick up as outlined in (1) above. Any joint use generating two (2) cubic yards or less per month shall be charged a minimum of Fifty-two dollars ($52.00) per month to Service: be shared equally. Non-Containerized Commercial (1) Refuse picked up from bins shall be charged at Twenty-four dollars ($24.00) per cubic yard (non-compacted measure). Small business generating one cubic yard a month or less shall be charged at the rate of Twenty-four dollars ($24.00) per month. (2) Refuse picked up from residential type cans at commercial establishments shall have their level of service negotiated by the Public Works Department with an opportunity to appeal the rate to City Commission. Residential Rates (Non-containerized): (1) Ten dollars and fifty cents ($10.50) per month for single family dwellings. (2) Ten dollars and fifty cents ($10.50) per month for each family unit duplex or triplex. (3) Ten dollars and fifty cents ($10.50) per month for each family unit for apartments and condominiums. (4) Trailer parks, Ten dollars and fifty cents ($10.50) per month per trailer. Residential Rates (Containerized): (1) Eight dollars ($8.00) per month for each family unit for apartment and condominiums that are served by high volume (Containerized). (2) Eight dollars ($8.00) per trailer parks. Special Pick-Up - Scheduled: containers in trailer Special Pick Up will be scheduled by contacting the Public Works Department. Roll-off container collection will be charged One hundred twenty-five dollars ($125.00) per transfer plus the actual cost of the landfill charge. (Roll-off container will be supplied by user of service). All properties shall be assessed no less than the minimum applicable rate schedule provided for in this section. If a utility account is temporarily discontinuted, there shall continue to be a monthly charge calculated as the base rate for the applicable bill category. ~ection 2. That each and every other provision of )ter 10. Garbage, Trash and Offensive Conditions., Article II, not specifically amended herein shall remain in full force and effect as previously enacted. Section 3. That the new rates and charges for city services will become effective on October 1, 1990. Section 4. That all ordinances or parts of ordinances, Dr resolutions in conflict herewith be and the same are hereby repealed, specifically Resolution No. 89-RRR, adopted December 5, 1989. Section 5. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be .invalid, such decision shall not affect the remainder of this ordinance. Section 6. Authority is hereby granted to codify said ordinance. Section 7. This ordinance shall become immediately upon passage.
