O90-35ORDINANCE NO. 90-~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, A/~ENDING CHAPTER 26. WATER, SEWERS AND CITY UTILITIES; AMENDING SECTION 26-34. CAPITAL FACILITIES CHARGES AND CONNECTION CHARGES; CREATING A NEW SECTION 26-36. ESTABLISHING FEES AND SERVICE CHARGES FOR WATER AND SEWER SERVICE; METER CONNECTIONS AND DEPOSITS; AND MISCELLANEOUS SERVICES; CREATING A NEW SECTION 26-37. ESTABLISHING MONTHLY RATES FOR WATER AND WASTEWATER; PROVIDING THAT EACH AND EVERY OTHER SECTION OF CHAPTER 26. NOT SPECIFICALLY AMENDED HEREIN SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING FOR A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AUTHORITY TO CODIFY; AND AN EFFECTIVE DATE. WHEREAS, due to the increasing growth of the water and wastewater system of the City of Boynton Beach and various improvements are required of the system to provide safe, sanitary potable drinking water and to provide for adequate collection and disposal of wastewater; and WHEREAS, to fund the additional operating costs of the system and the additional capital expansion costs of the system, monthly rates, capital facilities charges and miscellaneous fees and charges need to increase, NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. That Chapter 26. Water, Sewers and City Utilities, Article II. Section 26-34. Capital facilities charges and connection charges, is hereby amended, in part, by adding the words and figures in underlined type and by deleting the words and figures in struck-through type, as follows: Sec. 26-34. Capital facilities charges and connection charges. (A) CAPITAL FACILITIES CHARGE IMPOSED. When property receives water and/or sewage service from systems owned or controlled by the city, the owner of such property shall pay unto the city a water and/or sewage capital facilities charge as follows: (1) Water: (a) (b) 2. "Equivalent dwelling unit" is defined as a unit of construction having the same water usage as a one-bedroom single-family home, and the number of equivalent dwelling units, for the purpose of this calculation, contained within the property shall be determined in accordance with the schedule attached to Ordinance Number 80-10 (Article II of this Chapter) and by reference made a part hereof. Section 2. Fees and Charges. structure for fees That a new Section 26-36. Miscellaneous is hereby created to establish a fee and service charges for water and sewer service, turn-ons, meter connections and deposits and miscellaneous services as set forth on Schedule "A". Section 3. That a new section 26.37. Water and Wastewater Rates is hereby created to establish a fee structure for monthly billings as set forth in Schedule "B". The rate schedule for Water and Wastewater set forth in Schedule "C" shall become effective October 1, of each of the fiscal years indicated on the attached Schedule. Section 3. The fees established herein shall become effective on the first day of October of each year and shall not be prorated. Section 4. That each and every other provision is Chapter 26. not specifically amended herein shall remain in full force and effect as previously enacted. Section 5. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this ordinance.
