O90-34ORDINANCE NO. 90-~6Z AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ARTICLE II. SECTION 4-28(B), IMPOUNDING, REDEMPTION OF DOGS.,TO IMPLEMENT NEW FEES; AMENDING SECTION 4-12. IMPOUNDING FEES, CHARGES. ESTABLISHING FEES FOR OTHER IMPOUNDED ANIMALS; PROVIDING FOR AN IMPLEMENTATION DATE FOR SAID FEES; PROVIDING FOR A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AUTHORITY TO CODIFY; AND AN EFFECTIVE DATE. WHEREAS, the City is authorized to collect charges or fees in an amount necessary for the efficient conduct of municipal government and to offset regulatory activity; and WHEREAS, the City currently collects fees animals; and for impounded WHEREA~, the City wishes to amend its impound fee charges and add new fee levels for activities not previously the subject of any fee or charge; WHEREAS, the City Administration has conducted a study to establish a fair and reasonable charge for said fees. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. Effective October 1, 1990, Article II. Section 4-28. Impounding, redemption of dogs. (b) shall be amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: Sec. 4-28. Impounding, redemption of dogs. (b) Redemption by owner; notice of impounding; fees. The owner of any dog impounded may redeem the same for a period of three (3) days after notice of impounding, which may be by one publication at the city hall, upon the payment of an impounding fee of ~ve -do~a~s -~$5~88~ ten dollars ($10.00) for the first offense, ten de~ars-~$~8~88~ twenty-five dollars ($25.00) for the second offense and {~{%een-~okka~s -%$}5=88~ forty dollars ($40.00) for the third offense, and in addition thereto, three-dokka=s -%$~=88~ five dollars ($5.00) for keep of the dog for each day impounded; provided that the dog shall be vaccinated, tagged and registered as herein provided, and a fee in the amount of twe-dekka~s ~$~80~ three dollars ($3.00) for spraying. I_~ the event the animal is adopted~ an adoption fee of ten dollars ($10.00) will be charged. Section 2. Section 4-12. Impounding fees, charges. of the Code of Ordinances of the City of Boynton Beach, is hereby amended by adding the words and figures in underlined type and by deleting the words and figures in struck-through type, as follows: Sec. 4-12. Impounding fees, charges. (c) Any other animal, other than dogs, not specifically enumerated in another Section of this Code, may be redeemed upon payment of an impounding fee of four dollars ($4.00) for the first offense, six dollars ($6.00) for the second offense, and twelve dollars ($12.00) for the third offense, and in addition thereto five dollars ($5.00) for keep of the animal for each day impounded; and a fee of $3.00 for spraying. In the event the animal is adopted, there will be a charge of $10.00. Section 3. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 4. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this ordinance. Section 5. Authority is hereby granted to codify said ordinance. Section 6. This ordinance shall become effective October 1, 1990. FIRST READING this ~ day of 1990.
