SPECIFICALLY HEREIN AMENDED SHALL REMAIN
IN FULL FORCE AND EFFECT AS PREVIOUSLY
ENACTED; PROVIDING A CONFLICTS CLAUSE;
PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AUTHORITY TO CODIFY; PROVIDING
AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY CObIMISSION

Section 1. That Chapter 7.5, Article IV.

V. Community
7.5-70. Title.
This article shall be known and may be cited as the
Boynton Beach Community Design Plan".
~ec. 7.5-71. Purpose.
The purpose of this article is to set forth architectural
~nd landscape criteria for the exterior design of buildings,
)n-site streetscape landscaping, and off-site median and
~ight-of-way landscaping.
7.5-72. Definitions.
(a) Addition - An expansion, extension, or increase in the
usable space within a building or facility.
(b) Alteration - Any change or modification in
construction or occupancy.
(c) Assessed value - The monetary worth expressed in the
latest tax records of the Palm Beach County Tax
Assessor.
(d)
Substantial improvement - Any repair, reconstruction,
or improvement of a structure or site, the cost of
which equals or exceeds fifty (50) percent of the
market value of the structure, either (1) before the
improvement or repair is started, or (2) if the
structure
before the

Sec. 7.5-73. Applicability of the community design plan.
(a)
New construction. This article shall apply
concurrently and in direct relation with the
requirements of Chapter 19, Planning and Development
Generally.
(b) Existing construction. This article is applicable
under any of the following conditions:
1. When a building and/or site is substantially
improved.
2. When the occupancy classification of the building
changes as defined by the Standard Building Code.
3. When exterior alteration or reconstruction
substantially changes and/or affects the architectural
design of the building.
4. When an existing building is proposed to be
enlarged.
~ec. 7.5-74. Design plan district requirements.
The community design plan shall be implemented for
each design district as identified by the Community
Design District Boundary Map. (Appendix I)
7.5-75. Required improvements.
(a)
Ail applicable sites shall comply with the Community
Design Plan Standards for architectural style and
streetscape landscaping. (Appendix II and III)
(b)
Ail applicable sites which have adjacent public
rights-of-way and median islands and which meet the
jurisdiction agency's minimum size requirements shall
comply with the community design plan standards for
median and right-of-way landscaping. (Appendix III)

The following structures and sites are exempt from this
ordinance:
(a) Single family and duplex dwelling units on
individually platted lots.

(b) Individual buildings contained within previously
approved site plans.
~ec. 7.5-78. Administration and interpretation of code
~egulat£ons and provisions.
(a)
The interpretation and application of the regulations
and provisions of this code by the building department
shall be reasonable and uniformly applied to all
property within the jurisdiction of the Boynton Beach
Community Design District Boundary Map.
(b)
The regulations and provisions of this code shall be
held to be the minimum requirements adopted for the
protection and promotion of the public health, safety,
comfort, convenience, order, appearance, prosperity or
general welfare.
(c)
Whenever the regulations and requirements of this code
are at variance with the requirements of any other
lawfully enacted and adopted rules, regulations,
ordinances or laws, the most restrictive shall apply.
;ec. 7.5-79. Community appearance boards; appeals.
Appeals to the Community Appearance Board may be taken
by any person aggrieved by a decision of the Building
Department within thirty (30) days of such decision.
There shall be an application fee as adopted by
resolution of the City Commission for Appeals of
Administrative Decision to the Community Appearance
Board.

Section 4. That all ordinances or parts of ordinances
tn conflict herewith be and the same are hereby repealed.
Section 5. Should any section or provision of this
)rdinance or portion hereof, any paragraph, sentence, or
~ord be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
~his ordinance.
Section 6. Authority is hereby granted to codify said
)rdinance.

COMMUNITY DESIGN DISTRICT BOUNDARY MAP

APPENDIX II
BOYNTON BEACH COMMUNITY DESIGN PLAN STANDARDS
All applicable projects shall comply with the design standards
as fOllows:
(a)
New projects
New projects shall comply with the site plan review process
contained in Chapter 19. Plans submitted for review shall
show and identify a minimum of one (1) type of finish
roofing material and one (1) type of exterior wall finish
material from the appropriate architectural style list.
Alternately, the applicant may submit to the Community
Appearance Board, materials that are harmonious with the
required architectural style for roof and exterior wall
covering material. Submitted plans shall also incorporate
at least fifty (50) percent of the architectural features
and/or treatments identified on the appropriate
Drchitectural style list into the design of the building,
or show architectural features and/or treatments that are
harmonious with the required architectural style.
(b)
Modifications to existin~ projects
Ail other projects which must comply with the community
design plan shall show and identify on the plans submitted
for review a minimum of one (1) type of finish roofing
material and one (1) type of exterior wall finish material
from the appropriate architectural style list or present to
the Community Appearance Board, materials that are
harmonious with the required architectural style for roof
and exterior wall covering material. Submitted plans shall
also incorporate at least twenty-five (25) percent of the
architectural features and/or treatments identified on the
appropriate architedtural style list into the design of the
building, or show architectural features and/or
treatments that are harmonious with the required
architectural style.
(c)
Architectural amenities
Ail projects subject to compliance with the community
design plan may choose an architectural amenity from the
appropriate architectural style list or present amenities
that are harmonious with the required architectural style
and incorporate the amenity into the site and receive
credit as a required architectural feature and/or
treatment.
(d)
Colored elevations
Ail projects subject to compliance with the community
design plan shall submit elevation drawings of all sides of
each building proposed to be developed on the site.
Colored elevation drawings will only be required for the
front elevation of a structure when all sides of a
building are consistent in color and materials. Each
colored elevation drawing shall identify the type of each
exterior finish material and state the color by name,
manufacturer and model or style number. A color sample
shall be submitted as an example along with the color or
product identified on the plans. The sample will be used
for the final site inspection to ensure that the correct
product and color were used for the project. For projects
which require site plan approval, all color elevation
drawings and/or samples shall be submitted to the Planning
Department by the site plan approval deadline date.
