O90-32ORDINANCE NO. 90~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 2. ADMINISTRATION. ARTICLE 1. IN GENERAL. OF THE CODE OF ORDINANCES OF THE CITY OF BOYNTON BEACH, FLORIDA, BY SPECIFICALLY AMENDING SEC. 2-15., ENTITLED "PER DIEM AND TRAVEL EXPENSE SCHEDULE"; PROVIDING FOR A PER DIEM INCREASE RELATIVE TO MEALS AND TRANSPORTATION EXPENSES WHEN TRAVELERS ARE ENGAGED IN THE PERFORMANCE OF OFFICIAL DUTIES; PROVIDING THAT EACH AND EVERY OTHER PROVISION OF CHAPTER 2. ARTICLE 1. NOT SPECIFICALLY AMENDED HEREIN SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AUTHORITY TO CODIFY; PROVIDING FOR AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City Commission of the City of Boynton ~each, Florida, deems it in the best interests of the ~itizens and residents of Boynton Beach, Florida to revise ~he per diem for public officials, public employees, or any ~uthorized person, when performing authorized travel; NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO~4IMSION )F THE CITY OF BOYNTON BEACM, FLORIDA: Section 1. That Chapter 2. Article I. in General, ~ection 2-15(11)(e)(4). is hereby amended by adding the ~ords and figures in underlined type and by deleting the ~ords and figures in struck-through type, as follows: Sec. 2-15(11)(e). 4. Meals only. All travelers may be allowed an amount for meals, while on official business, up to the following amounts: a. Breakfast, %h~ee --do~ars --~$~88~ eight dollars ($8.00). b. Lunch, s~x--~o~ars--~$6~88~ ten dollars ($10.00). c. Dinner, ~we~ve --do~ars --~$~88~ twenty dollars ($20.00). d. Total for twenty-four period, twen%y-ene dekkars thirty-eight dollars. e. Additional amounts where special circumstances are appropriate as approved by the city manager. Section 2. That Chapter 2. Article I. in General, :ection 2-15(11)(f)(3) is hereby amended by adding the words .nd figures in underlined type and by deleting the words and ~igures in struck-through type, as follows: Sec. 2-15(11)(f)(3). a. The use of privately owned vehicles for official travel in lieu of publicly owned vehicles or common carriers may be authorized by the city if a publicly owned vehicle, the -traveler -sha~ -be -entitled-to -a m~keage-ak~owance-at-a-f~xed-rate-net-to-excee~-twenty eents-~$8~8~-pe~-m~e-or-the-common-carr~e~-~a~e-~o~ such-trave~-t~-be-~eeerm~ned-by-%he-~ty-manage~ the traveler shall be entitled to a mileage allowance at a rate based upon the current allowable rate of the United States Internal Revenue Service. As the mileage rate allowed by the Internal Revenue Service is subject to change, the City Manager may conduct an annual review of the mileage rate. The mileage allowance shall be at a rate not to exceed twenty-six cents ($.26) per mile or the common carrier fare for such travel, to be determined by the City Manager. Reimbursement for expenditures related to the operation, maintenance, and ownership of a vehicle shall not e allowed when privately owned vehicles are used on public business and reimbursement is made pursuant to this paragraph, except as provided for in paragraph (7) of this subsection. Section 3. That each and every other provision of hapter 2. Article I. In General. Section 2-15 not specifically amended herein, shall remain in full force and ~ffect. Section 4. That all ordinances or parts of ordinances .n conflict herewith be and the same are hereby repealed. Section 5. Should any section or provision of this paragraph, sentence, or jurisdiction to be the remainder of to codify said become effective ~rdinance or portion hereof, any ~ord be declared by a court of competent .nvalid, such decision shall not affect .his ordinance.
